AN ORDINANCE REZONING ONE TRACT OF LAND TOTALING 2.088 ACRES, BEING
SITUATED IN THE CRAWFORD BURNETT LEAGUE, ABSTRACT 7, BRAZOS COUNTY,
TEXAS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION,
TEXAS:
PART l:
That the City of College Station Zoning Ordinance #1638, more specifically the
Official Zoning Map, be amended as set out in Exhibits "A", "B", "C", and "D"
attached hereto and made a part of this ordinance for all purposes.
PART 2:
That if any provisions of any section of this ordinance shall be held to be void or
unconstitutional, such holding shall in no way effect the validity of the remaining
provisions or sections of this ordinance, which shall remain in full force and effect.
PART 3:
That any person, firm or corporation violating any of the provisions of this chapter
shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be
punishable by a fine of not less than Twenty-five dollars ($25.00) nor more than
Two Thousand Dollars ($2000.00). Each day such violation shall continue or be
permitted to continue, shall be deemed a separate offense. Said Ordinance, being a
penal ordinance, becomes effective ten (10) days after its date of passage by the City
Council, as provided by Section 35 of the Charter of the City of College Station.

EXHIBIT "A"
That the Official Zoning Map of the City of College Station, and part of Zoning Ordinance
#1638, is hereby amended as follows:
The following property is rezoned from R-1 Single Family Residential to PDD-B
Planned Development District - Business.
2.088 acres being situated in the Crmxford Burnett League, Abstract No. 7, Brazos
CounO,, Texas. and being a part of that certain Called 7.16 acre tract as described itt
deed from Arapaho Ltd. to Osage Limited, of record in Volume 682, Page 672,
Deed/Official Records of Brazos Count)', Texas, said 2.088 acre tract being more
particular(v described by metes and bounds #~ the attached Exhibit "B" and shown
graphicall)' in EYhibit "C".
The purpose of the PDD-B Planned Development District - Business zoning
designation on the property described above is to allow for the development and
maintenance of a convenience store/service station with accessory uses limited to
restaurants with drive-thrus, cleaners, and other neighborhood serving businesses. The
site shall be developed and maintained in accordance with the attached development
plan (Exhibit "D"). The following specific site characteristics shall not be varied:
1) No direct driveway across to Harvey Mitchell. Two driveways as shown on the
plan to Holleman Drive. Should a frontage road be constructed on Harvey
Mitchell adjacent to the subject 2.088 acres, and a driveway is approved and
constructed to that frontage road, the western-most driveway along Holleman shall
be closed.
2) A buffer of trees to be planted and maintained along the common lot line of the
subject property and the R-2 zoned property to the east. The buffer shall be of
sufficient width to allow for the growth of trees within the buffer.
3) A buffer of green open space between the subject 2.088 acres and the R-6 zoned
tract to the north. This area may include a detention facility.
4) A 4 fi. sidewalk must be provided through this site to the adjacent R-5 zoned
neighborhood to the west.

distance of 389.12 feet to a 1/2' Iron Rod found for the southwest comer, said comer

THENCE N 3 ° 44 ' 58 ' W. along the east line of said Lot I a distance of 100.00 feet to
