AN ORDINANCE REZONING A TRACT OF LAND TOTALING 2.06 ACRES, BEING
191.89 FEET OF LOTS 1 AND 2 OF THE HENTON SUBDIVISION, IN COLLEGE
STATION, BRAZOS COUNTY TEXAS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION,
TEXAS:
PART 1:
That the City of College Station Zoning Ordinance #1638, more specifically the
Official Zoning Map, be amended as set out in Exhibits "A", "B", and "C" attached
hereto and made a part of this ordinance for all purposes.
PART 2:
That if any provisions of any section of this ordinance shall be held to be void or
unconstitutional, such holding shall in no way effect the validity of the remaining
provisions or sections of this ordinance, which shall remain in full force and effect.
PART 3:
That any person, firm or corporation violating any of the provisions of this chapter
shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be
punishable by a fine of not less than Twenty-five dollars ($25.00) nor more than Two
Thousand Dollars ($2000.00). Each day such violation shall continue or be
permitted to continue, shall be deemed a separate offense. Said Ordinance, being a
penal ordinance, becomes effective ten (10) days after its publication in the
newspaper, as provided by Section 35 of the City of College Station.

EXHIBIT "A"
That the Official Zoning Map of the City of College Station, and part of Zoning Ordinance
//1638, is hereby amended as follows:
The following property is rezoned from A-P Administrative Professional to C-B
Business Commercial:
A tract of land being 191.89feet of Lots I and2 of the Henton Subdivision, in College
Station, Brazos County, Texas, described by metes and bounds in Exhibit "B ", and
shown graphically in Exhibit "C"o
This tract shall be rezoned from A-P Administrative Professional to C-B Commercial
Business with the condition that a buffer be established meeting the R&D (Research and
DevelopmenO buffer requirements wherever the newly created C-B and the adjacent R-4
meet and that no penetration occur for vehicular access, and with the recommendation that
the buffer not be required to run through the drainage basin bttt that the buffer be placed
outside the parameters of the basin.

Field notes of a 2.06 acre tract or parcel of land, lying and being situated
in the Richard Carter Survey, Abstract No. 8, College Station, Brazos County,
Texas, and being part of Lots I and 2, Henton Subdivision, according to the
plat recorded in Volume 2017, Page 239, of the Official Records of Brazos
County, Texas, and being more particularly described as follows:
BEGINNING at the ~" iron rod found marking the south corner of the
beforementioned Lot 2, Henton Subdivision, said ~" iron rod being in.the
northeast line of the 6.9 acre tract described in the deed to E. L. Putz,
recorded in Volume 287, Page 821, of the Deed Records of Brazos County,
Texas;
THENCE N 45° 28' 03" W along the common line between the
beforementioned Lot 2 - 5.00 acres and the Putz - 6.9 acre tract, for a distance
of 191.89 feet to the southeast line of the Business Commercial Zoning
District;
THENCE N 44° 50' 37" E along the southeast line of the Business
Commercial Zoning District for a distance of 467.80 feet and corner in the
northeast line of the beforementioned Lot 1 - 4.99 acres;
THENCE S 45° 29' 15" E along the northeast line of the
beforementioned Lot 1 - 4.99 acres, for a distance of 191.89 feet to a ~" iron
rod found marking the east corner of Lot I - 4.99 acres, same being the north
corner of Lot 3;
THENCE S 44° 50' 37" W along the southeast line of Lots I and 2,
Henton Subdivision for a distance of 467.87 feet to the PLACE OF BEGINNING,
containing 2.06 acres of land, more or less.
