AN ORDINANCE REZONING A TRACT OF LAND TOTALLING 3.03 ACRES, LYING
AND BEING SITUATED IN THE J. W. SCOTT LEAGUE, A-49, AND MARIA KEEGANS
LEAGUE, A-25, AND BEING OUT OF THE 37 ACRE TRACT OF LAND CONVEYED TO
LEE ROSS BATSON, ET UX, BY RAYMOND JONES, RECEIVER, AND OUT OF THE
MISSIONARY BAPTIST CHURCH TRACT OF LAND IN BRAZOS COUNTY, TEXAS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION,
TEXAS:
PART 1:
That the City of College Station Zoning Ordinance #1638, more specifically the
Official Zoning Map, be amended as set out in exhibits "A", "B", and "C" attached
hereto and made a part of this ordinance for all purposes.
PART 2:
That if any provisions of any section of this ordinance shall be held to be void or
unconstitutional, such holding shall in no way affect the validity of the remaining
provisions or sections of this ordinance, which shall remain in full force and effect.
PART 3:
That any person, firm or corporation violating any of the provisions of this chapter
shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be
punishable by a fine of not less than Twenty-five dollars ($25.00) nor more than Two
Thousand dollars ($2000.00). Each day such violation shall continue or be permitted
to continue, shall be deemed a separate offense. Said Ordinance, being a penal
ordinance, becomes effective ten (10) days after its passage by the City Council, as
provided by Section 35 of the Charter of the City of College Station.

EXHIBIT "A"
That the Official Zoning Map of the City of College Station, and part of Zoning Ordinance #1638,
is hereby amended as follows:
The following property is rezoned from A-O Agricultural Open to C-B Business
Commercial:
.4 tract of land lying and being situated in the J. W. Scott League, A-49, and Maria
Keegans League, A-28, in Brazos County, Texas, and being out of the 37 acre tract of
land conveyed to Lee Ross Batson, ex us, by Raymond Jones, Receiver, in Brazos
County, and out of The Bethel Missionary Baptist Church tract of land, described by
metes and bounds in Exhibit "B'; and shown graphically in Exhibit "C".
This tract shall be rezoned from .4-0 Agricultural Open to C-B Commercial Business with
the condition that height be restricted to R-land with the condition that there be a buffer
easement along the western and northern property lines that meet R&D requirements.

This is a Field Note Description of that certain Tract of land lying and being situated in the
J. W. SCOTT LEAGUE, A-49, AND MARIA KEEGANS LEAGUE, A-28, in Brazos
County, Texas, and being out of the 37 Acres tract of land conveyed to Lee Ross Batson,
et ux, by Raymond Jones, Receiver, by Deed dated December 9, 1952, and recorded in
Volume 157, Page 158, Deed Records of Brazos County, Texas, and out of The Bethel
Missionary Baptist Church tract of land, said tract of land being more particularly
described by metes and bounds as follows:
BEGINNING at a the intersection of the Fergusson Crossing Road and the League Line in
Brazos County, Texas, same being the most Northeasterly comer of the Batson 37 acres
tract,
THENCE N. 63° 00' 00" W. continuing with the South line ofsa~d Road, and the North
line of said 37 acres tract for a distance of 210 feet;
THENCE S. 45° 00' 00" W. for a distance of 630 feet;
THENCE S. 63* 00' 00" E. for a distance of 210 feet;
THENCE N. 45° 00' 00" E. for a distance of 630 feet TO THE PLACE OF
BEGINNING.
