AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COLLEGE STATION,
TEXAS, PROVIDING FOR THE EXTENSION OF THE BOUNDARY LIMITS OF THE
CITY OF COLLEGE STATION, ANNEXING CERTAIN TERRITORY ADJACENT TO
THE PRESENT BOUNDARY LIMITS OF THE CITY OF COLLEGE STATION;
APPROVING A SERVICE PLAN FOR THE ANNEXED PROPERTY; PROVIDING A
SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of College Station has the power by ordinance to fix the boundary
limits of the City of College Station and to provide for the extension of such boundary limits and
the annexation of additional territory lying adjacent to the City of College Station by the City
Charter of the City of College Station, Texas, Section 7; and
WHEREAS, on July 11, 2002~ the City Council of the City of College Station directed staff to
begin annexation proceedings for annexation of approximately 4,200 acres of land; and
WHEREAS, the City Council finds that all the required notices were given in the time and
manner required by law; and
WHEREAS, public hearings before the City Council were held in the Council Chambers on
September 26, 2002, and October 2, 2002, both days being on or after the 20th day but before the
40th day before the date of the institution of the annexation proceedings to allow all interested
persons to state their views and present evidence bearing upon the annexation; and
WHEREAS, the City Council finds that the annexation will ensure consistent and orderly
development of the annexed areas; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION,
TEXAS:
SECTION I: The tracts of land described in Exhibits Al, A2, A3, A4, A5 and A6 attached
hereto and made a part of this ordinance for all purposes, are hereby added to and annexed to the
City of College Station, Texas.
SECTION 2: The Service Plan, Exhibit B, attached hereto and made a part of this ordinance for
all purposes, which provides for the extension of municipal services to the annexed property, is
approved as part of this ordinance. The Service Plan was made available for public inspection
and explanation to the inhabitants of the area being annexed at the public hearings on
September 26, 2002, and October 2, 2002.
SECTION 3: Should any part of this ordinance be held illegal or invalid for any reason, the
holding shall not affect the remaining sections or portion of sections or provisions of this

ordinance. If any part of the real property annexed in Exhibits A 1, A2, A3, A4, A5 and, A6 is
already included within the City Limits of the City of College Station or is not within the City of
College Station's jurisdiction to annex, the same is excluded from the territory annexed as fully
as if the excluded area(s) were expressly excluded by this ordinance.
SECTION 4: That upon final passage, approval and after the effective date of this ordinance, all
property annexed shall be zoned AO (Agricultural Open Space).
SECTION 5: That, upon final passage hereof and after the effective date of this ordinance, the
annexed territory shall be a part of the City of College Station, Texas, and the property situated
herein shall bear its pro rata portion of the taxes levied by the City of College Station and the
inhabitants thereof shall be entitled to all of the rights and privileges of all the citizens and shall
be bound by the acts, ordinances, resolutions, and regulations of the City of College Station.
SECTION 6: That this ordinance shall become effective after its passage and approval on
November 1, 2002.

1. ANNEXATION AREAS
The annexatxon areas are located in various parts of the City of College Station's Extra-Territorial Jurisdiction.
These properties are illustrated in Figure 1 and described below.
Area # 1 - located generally at the intersection of Harvey Mitchell
Parkway and Wellborn Road and containing approximately 644 acres.
Area # 2 - located generally south of Green Prairie Road and north
of Arrington Road and containing approximately 1077 acres.
Area # 3 - located in the Nantucket Subdivision and containing approximately 40 acres.
Area # 4 - located generally east of Rock Prairie Road and north of Carter Lake Subdivision
and containing approximately 655 acres.
Area # 5 - located generally east of Rock Prairie Road and south of the Carter
Lake Subdivision and containing approximately 1340 acres.
Area # 6 - located generally along the extension of Greens Prairie Road east from Carter
Creek to SH 30 and containing approximately 455 acres.
II. INTRODUCTION
This service plan has been prepared in accordance with the Texas Local Government Code, Sections 43.02
43.065, and 43.065(b)-(o) (Vernon 1999, AND VERSON Su?P. 2002) as amended). Municipal faciliues and
services to the annexed areas described above will be provided or made avmlable on behalf of the City in
accordance with the following plan. This plan provides a program under which the City of College Station wall
provide full mumc~pal services to the annexed areas. All services will be provided within the t~me provided in
TEXAS LOCAL GOVERN M ENT CO DE SEC. 43.056(H }.
This Service Plan does not:
· require the creation of another political subdivision;
· require a landowner in the area to fund the capital improvements necessary to provide
municipal services in a manner inconsistent with Chapter 395, Texas Local Government
Code; or
· provide services in the area in a manner that would have the effect of reducing by more
than a negligible amount the level of fire and police protection and emergency medical
services provided within the corporate boundaries of the municipality before annexation.
The level of services, infrastructure, and infrastructure maintenance provided to the annexed area is
comparable to the level of services, infrastructure, and infrastructure maintenance available in other
parts of the City with topography, land use, and population density similar to those contemplated or
projected in the annexed area
111. PERMITS REQUIRED
Construction activities underway prior to annexation may continue provided that all construction after
annexation must comply with City codes and ordinances. All permits required by City codes and
ordinances must be obtained for construction underway. Permit fees shall be waived for construction
underway prior to annexation.
IV. AD VALOREM (PROPERTY OWNER) TAX SERVICES
Certain municipal services will be provided on the effective date of annexation. These include:
A. Police Protection and Animal Control
Police service, including patrolling, response to calls, and other routine functions, will be
provided to the property upon the effective date of the annexation using existing personnel
and equipment. Animal control services will also be provided to the property upon the
effective date of the annexation.
B. Fire Protection and Emergency Medical Services
Fire protection and emergency medical services will be provided through emergency call
responses, fire prevention education, fire survey activities, and fire code enforcement.
Construction and development activities undertaken after the effective date of annexation
shall comply with all building and fire safety codes of the City of College Station. All
structures shall be brought into compliance with the address standards of the College Station
Code of Ordinances within sixty (60) days of the date of annexation.
C. Roads and Streets, and Street Signs
Roads and streets in the area annexed will be maintained by the City of College Station. State
highways are addressed in the City's maintenance agreement with Texas Department of
Transportation and will be added to the City's maintenance activities immediately following
annexation. Maintenance priorities shall be determined on a City-wide basis taking into
consideration such factors as: street width, volume of traffic, street conditions, nature of
maintenance needs, and public safety hazards.
Street signs shall be brought to College Station standards within 60 days of the annexation.
The City will install street signs in accordance with College Station standards for same within
sixty (60) days of the annexation.
D. Solid Waste Collection
The City is not required to provide solid waste collection services under this Service Plan to a
person who continues to use the services of a privately owned solid waste management
service provider. The City will not charge a fee to a person who continues to use the services
of a privately owned solid waste management service provider. Residential Service - All
services will be provided at a point of collection adjacent to, and accessible from, a public
right of way. Residential solid waste collection vehicles will not conduct operations on
private roads or property. In the case of multiple residences located on a privately owned
road, a mass collection point will be established at an area adjacent to the nearest public right
of way. The City will provide all residential containers. Commercial Service - Containers
and collection points may be located on private property, provided that it can be easily
accessed from a public right of way, and both the route of access and the collection point
meet sanitation division requirements for approved surfaces, vehicle clearance and turning
radii. The City will provide standard commercial containers. A private collection company
presently serves a portion of the annexed area in the Nantucket Subdivision. Service in this
area will continue to be provided by this business through a franchise agreement. In order to
secure solid waste collection services in the remaining areas, each property owner must
establish a utility account with the City of College Station.
Services will be initiated upon the effective date of annexation.
E. Building Inspections
Building inspections will be made available on the effective date of the annexation on the
same basis and at the same level as similar facilities are maintained throughout the City.
Service is provided on a "cost recovery" basis, and permit fees offset the costs of services
delivered. Incomplete construction must obtain building permits from the Building
Inspections Department of the City of College Station.
F. Planning and Development Services
Planning and Development Services will be made available on the effective date of the
annexation. The Development Services Department currently services this property by way
of administration of Chapter 9 of the CITY OF COLLEGE STATION Code o£ Ordinances,
concerning subdivision regulations.
The College Station City Council adopted the current Comprehensive Plan in August, 1997.
The Future Land Use Plan addresses both land in the City and its ETJ. The Plan designates
future land uses to manage the quality and quantity of growth by organizing the land use
patterns and by matching land use intensity with available infrastructure. The City's
Comprehensive Plan will be used as a basis tbr final zoning classifications after the properties
are annexed.
G. Parks and Recreation
The City Council of the City of College Station, Texas, is not aware of the existence of any
parks, playgrounds or public swimming pools now located in the areas proposed for
annexation. In the event any such facilities do exist and are public, they will be maintained to
the same degree and extent that the City maintains public parks, playgrounds and swimming
pools within the current City limits.
H. Other Publicly Owned Buildings and Facilities
The City Council of the City of College Station, Texas, is not aware of the existence of any
publicly owned buildings now located in the areas proposed for annexation. In the event any
such facilities do exist and are public, they will be maintained to the same degree and extent
that the City maintains these facilities within the current City limits.

V. WATER AND WASTEWATER SERVICE PROVISION
This Water and Wastewater Service Plan ("Plan") provides a program under which the City of
College Station will provide full municipal services to the annexed area. For the purpose of this plan,
"full municipal services" includes water and sewer services provided by the City within its full-
purpose boundaries. The level of water and sewer service, infrastructure and infrastructure
maintenance provided in the annexed area will be comparable to the level of services, infrastructure
and infrastructure maintenance available in other pans of the City before annexation with topography,
land use, and population density similar to those reasonably contemplated or projected in the area.
Municipal services to be provided within the annexed area may be any of the methods by which the
City provides services to other comparable areas. All services will be provided within the time
provided in TEXAS LOCAL GOVERNMENT CODE SEC. 43.056(H).
Water and Wastewater facilities as shown within this service plan have been sized to accommodate
projected demands that will occur within the effective time of the service plan (10 years) for the
annexed area. Water and Wastewater facilities for future development that increases densities beyond
the capital improvements specified in this plan will be extended in accordance with the City's Water
and Wastewater policy in existence at the time of development. The water and wastewater extension
policy is discussed in Section VII Water and Wastewater Capital Improvements.
The City may extend facilities under this plan or otherwise serve this area through the use of Impact
Fees as permitted under CHAPTER 395 OF THE TEXAS LOCAL GOVERNMENT CODE.
A. Area 1
Wastewater
Properties within Annexation Area 1 are currently on septic systems except for the residents
of University Acres who are served by University Acres Wastewater Treatment Plant. This
plant is owned and operated under TPDES wastewater permit No. 12284-001 by Dr. Albert
Prescott Ribisi. Upon annexation, the treatment plant will remain in operation to provide
private wastewater treatment and disposal to the buildings currently connected to the plant.
The City of College Station will obtain a Certificate of Convenience and Necessity (CCN) for
the entire Annexation Area to provide retail wastewater services as required.
As in other areas of College Station with similar topography, land use, and population density
these rural density areas will remain on septic systems or small wastewater treatment plants.
This status will remain until such time as significant development occurs to warrant the
extension of an organized sanitary sewer collection system.
W~teF
All properties with water service in Annexation Area 1 arc currently served by private well
or the Wellborn Special Utility District. Wellborn currently supplies water to this area via a
2'' water line located along Wellborn Road and another 2" water line along Cain Road.
Exhibit A-1 illustrates these existing service lines.
Where these Wellborn Special Utility District lines exist within Annexation Area 1, service
will be continued to be provided by Wellborn Special Utility District (SUD) under the
contract between the City of College Station and Wellborn SLID until the City takes over
service fi.om Wellborn SUD.
Area 2 Wastewater
All properties within Annexation Area 2 are currently on septic systems. As in other
similarly developed areas of College Station, these rural density areas will remain on septic
systems until such time as significant development occurs to warrant the extension of an
organized sanitary sewer collection system.
Water
All properties with water service in Annexation Area 2 are currently served by private well or
the Wellborn Special Utility District. Wellborn currently supplies water to this area via a 2"
water line, which is located along Arrington Road. Exhibit A-2 illustrates these existing
service lines.
Where these Wellborn Special Utility District lines exist within Annexation Area 2, service
will continue to be provided by Wellborn Special Utility District under an existing contract
with the City until service is taken over by the City from the Wellborn SUD pursuant to the
contract.
B. Area 3
Wastewater
The sanitary sewer service to Annexation Area 3 is currently provided by a small private
wastewater treatment plant and collection system owned and operated by Nantucket, Ltd.
which has filed for a Certificate of Convenience and Necessity with the TCEQ.
Upon annexation, the City of College Station will allow Nantucket Ltd. to continue to provide
full retail wastewater services until such time that TCEQ has granted CCN to Nantucket, or
an agreement with the City is reached to allow all property, easements, sewer lines, manholes,
lift stations, equipment, treatment plant and appurtenances and any other facilities required to
provide full retail wastewater services to all customers currently served by Nantucket Ltd. to
be transferred to the City at no cost. Should an agreement be reached, the City will take over
the operation and maintenance of the plant. The plant may be removed from service once a
gravity sewer line can be constructed to the plant location. The plant will remain in service
until the City constructs an organized sanitary sewer collection system to serve this area.
Water
All properties with water service in Annexation Area 3 are currently served by private well or
the Wellborn Special Utility District. Wellborn currently supplies water to this area via an 8"
water line, which is located along SH6 and a 2" water line along Nantucket Drive. Exhibit A-
2 illustrates these existing service lines.
Where these Wellborn Special Utility District lines exist within Annexation Area 3, service
will continue to be provided by Wellborn Special Utility District under an existing contract
with the City until service is taken over by the City t¥om the Wellborn SUD pursuant to the
contract.
C. Area 4
Wastewater
All properties within Annexation Area 4 are currently on septic systems. As in other similarly
developed areas of College Station, these rural density areas will remain on septic systems
until such time as significant development occurs to warrant the extension of an organized
sanitary sewer collection system. In accordance with the City of College Station's Water and
Waste Water Extension Policy, these collection line extensions will be designed and
constructed by the developer or the Cay may extend them as Impact Fee Lines.
Water
All properties with water service in Annexation Area 4 are currently served by private well or
the Wellborn Special Utility District. Wellborn currently supplies water to this area via a 2"
water line, which is located along Bird Pond Road. Exhibit A-3 illustrates these existing
service lines.
Where these Wellborn Special Utility District lines exist within Annexation Area 4, service
will continue to be provided by Wellborn Special Utility District under an existing contract
with the City until service is taken over by the City from the Wellborn SUD pursuant to the
contract.
D. Area 5
Wastewater
All properties within Annexation Area 5 are currently on septic systems. As in other similarly
developed areas of College Station, these rural density areas will remain on septic systems
until such time as significant development occurs to warrant the extension of an organized
sanitary sewer collection system. In accordance with the City of College Station's Water and
Waste Water Extension Policy, these collection line extensions will be designed and
constructed by the developer or the City may extend them as Impact Fee Lines.
Water
All properties with water service in Annexation Area 5 are currently served by private well or
the Wellborn Special Utility District. Wellborn currently supplies water to this area via a 2"
water line located along Rock Prairie Road. Exhibit A4 illustrates these existing service lines.
Where these Wellborn Special Utility District lines exist within Annexation Area 5, service
will continue to be provided by Wellborn Special Utility District under an existing contract
with the City until service is taken over by the City from the Wellborn SUD pursuant to the
contract.
E. Area 6
Wastewater
All properties within Annexation Area 6 are currently on septic systems. As in other similarly
developed areas of College Station, these rural density areas will remain on septic systems
until such time as significant development occurs to warrant the extension of an organized
sanitary sewer collection system. In accordance with the City of College Station's Water and
Wastewater Extension Policy, these collection line extensions will be designed and
constructed by the developer or the City may extend them as Impact Fee Lines.
Water
All properties with water service in Annexauon Area 6 are currently served by private well,
Wellborn Special Utility District, or Wickson Special Utility District. Wellborn currently
supplies water to this area via a 16" line. Wickson Special Utility District currently supplies
water to this area via an 8" line. Exhibit A-5 illustrates these existing service lines.
Where the Wellborn Special Utility District lines exist within Annexation Area 6. service will
continue to be provided by Wellborn Special Utility District under an existing contract with
the City until service is taken over by the City from the Wellborn SUD pursuant to the
contract. Wickson Special Utility District, however, does not have an existing contract with
the City of College Station that will allow the City to assume their customers. Therefore, as
development occurs within Annexation Area 6 Wickson SUD will continue to serve these
customers. This may prove problematic, as the Wickson Special Utility District may not be
capable of serving these properties with fire protection as required within the City's
development ordinances. Therefore as these properties develop, in order to comply with the
City's fire protection ordinances, they may be required to install a pond with a dry hydrant
system, a chemical fire sprinkler system, or obtain a variance to the respective fire protection
ordinance.
VI. CAPITAL IMPROVEMENTS
Should the City make capital improvements to serve the annexed areas, the City reserves the right to
levy an impact fee to the properties annexed according to Chapter 395 of the Texas Local
Government Code and the City's Code of Ordinances. The City may, from time to time, include
construction of new, expanded or replacement facilities in its Capital Improvements Program(CIP).
Facilities to be included in the CIP shall be determined on a City-wide basis. Priorities shall be
established by the CIP plans of the City, growth trends and direction and the City Council through its
development plans and policies.
A. Police Protection
Police protection services will be provided to the annexed area through existing City facilities
at a level of service comparable to the level of service in other pans of the City before
annexation with topography, land use and population density similar to those reasonable
contemplated or projected in the area.
B. Fire Protection
Fire protection and emergency medical services will be provided will be provided to the
annexed area through existing City facilities a level of service comparable to the level of
service in other parts of the City before annexation with topography, land use and population
density similar to those reasonable contemplated or projected in the area.
C. Solid Waste Collection
Solid waste collection services will be provided to the annexed area through the City's
existing facilities or through franchise agreements with private services at a level of service
comparable to the level of service in other parts of the City before annexation with
topography, land use and population density similar to those reasonable contemplated or
projected in the area.
D. Roads and Streets
Streets and drainage will be provided through the existing facilities at a level of service not
less than exists in the area immediately preceding annexation. The improvement and
enlargement of roads within existing rights-of-way will be included in future capital

improvements programs as practical and where needed to facilitate the maneuvering of
emergency and sanitation service vehicles.
E. Parks, Playgrounds and Swimming Pools
Parks and recreation services will be provided through the existing facilities at a level of
service not less than exists in the area immediately preceding annexation.
Additional park development in the area will be addressed through the development standards
and procedures of the City as additional residential development occurs. Such park
development includes, but is not limited to, dedication of park land and/or money in lieu of
land in accordance with the City of College Station subdivision regulations.
F. Other Public Building and Facilities
Other public facilities, buildings or services will be provided through the existing facilities at
a level of service not less than exists in the area immediately preceding annexation.
WATER AND WASTEWATER CAPITAL IMPROVEMENTS
The water and wastewater utility extension policy of the City of College Station is as follows:
The cost of water and wastewater major facilities (i.e. water storage, wastewater treatment facilities
and large diameter water transmission and trunk sewer lines) shall be borne by the City;
The cost of off-site extension of water and wastewater facilities to serve a lot, tract, plat, or land
development shall be borne by the owner or developer of the lot, tract, plat, or land by direct
installation or through the use of Impact Fees. Where such extension is consistent with plans for the
development of the City and its utility system the City may, by decision of the City Council,
participate in the cost of construction so as to provide for additional capacity for the overall
development of an area.
The cost of water and wastewater facilities necessary to serve existing lots or new development within
a subdivision plat or land development shall be borne by the lot owner or developer of the plat or land
by direct installation or through the use ofbnpact Fees. Standard tap fees or other fees that are put into
effect on a citywide basis are in addition to ~mpact fees levied.
A. Area 1
Wastewater
The City of College Station will construct as part of Annexation Area I's Capital
Improvement Plan, an 18" trunk sewer line along the north fork of Bee Creek to terminate just
west of the Union Pacific Railroad right-of-way. This line will act as the main trunk sewer
line for Annexation Area 1. The Luther Street Lift Station, which was completed May 1,
2002, serves the 130 acres located west of I&GN Road.
Water
The City of College Station will construct as part of Annexation Area I's Capital
Improvement Plan, two 12" water mains located at Navarro Drive and Rock Prairie Road
extending from the east side of Wellborn Road to terminate just west of the Union Pacific
Railroad right-of-way. These two lines will serve as the water main transmission lines to
serve the eastern portion of Annexation Area 1. An 18" water line along FM 2818 is
currently under design that will serve the western portion of Annexation Area 1. The water
line is being built in accordance with the West Side Utility Master Plan. Exhibit A-I
illustrates the proposed improvements.

B. Area 2
Wastewater
The City of College Station will construct as part of Annexation Area 2's Capital
Improvement Plan a 12" trunk sewer line from Annexation Area 3 along Harpers Ferry Road
to Annexation Area 2. A portion of Annexation Area 2 will not be able to gravity feed to the
12" trunk sewer line. This area is planned to develop as rural density residential, which can
be served by septic systems. If redevelopment of this area warrants the extension of a force
main and lit~ station, those improvements would be constructed by the developer or by the
City as an Impact Fee Improvement.
Water
The City will construct as part of Annexation Area 2's Capital Improvement Plan, a 12" water
main from the Castlegate Subdivision to Area 2. Exhibit A-2 illustrates the proposed
improvements.
C. Area 3
Wastewater
The City of College Station will construct as part of Annexation Area 3's Capital
Improvement Plan a 12" trunk sewer line from SH 6 and through Annexation Area 3 along
Nantucket Drive or along the rear of several lots in this location.
Water
The City of College Station will construct as part of Annexation Area 3's Capital
Improvement Plan, an 8" water along Nantucket Drive to Area 3. E.xhibit A-2 illustrates the
proposed improvements.
D. Area 4
Wastewater
Area 4 will remain on septic systems until such time as development warrants the extension
of an organized sanitary sewer collection system.
Water
The City of College Station will construct as part of Annexation Area 4's Capital
Improvement Plan, a 12" water main under Rock Prairie Road at Bird Pond Road. Exhibit A-3
illustrates the proposed improvements.
E, Area 5
Wastewater
The City of College Station will construct as a part of Annexation Area 5's Capital Improvement
Plan an 8" sewer line from the western side of Area 5 at the Rock Prairie/Greens Prairie
Intersection along Greens Prairie Road to the existing sewer at the entrance to Pebble Creek. If
Area 5 is not annexed, the sewer portion of Area 5 will still need to be constructed to serve Area 6.
Water
The City of College Station will construct as a part of Annexation Area 5's Capital Improvement
Plan two 12" water line extensions to the east and west of Greens Prairie Road. If Area 5 is not
annexed, the water portion of Area 5 will still need to be constructed to serve Area 6. Exhibit A4
illustrates the proposed improvements.

F. Area 6
Wastewater
The City. of College Station will construct as a part of Annexation Area 6's Capital
Improvement Plan a lift station and 6" force main through Area 6 from the Greens Prairie
Road/Rock Prairie Road intersection to just northeast of Tonkaway Lake Road.
Water
The City of College Station does not have an agreement with Wickson Special Utility District,
therefore, the customers within Wickson's CCN shall continue to be served by Wickson Special
Utility District. The CCNs areas are indicated on Exhibit A-6.
The City will install a 12" water line from the Greens Prairie Road/Rock Prairie Road
intersection to the southern end of Area 6, along Greens Prairie Road. Exhibit A-5 illustrates
the proposed improvements.
VIII. UNIFORM LEVEL OF SERVICES MAY NOT BE REQUIRED
Nothing in this plan shall require the City to provide a uniform level of full municipal services to each
area of the City, including the annexed area, if different characteristics of topography, land use, and
population density are considered a sufficient basis for providing different levels of service.
IX. TERM
This service plan shall be valid for a term often (10) years. Renewal of the service plan shall be at
the discretion of City Council.
X. AMENDMENTS
The service plan may be amended if the City Council determines at a public hearing that changed
conditions or subsequent occurrences make this service plan unworkable or obsolete. The City
Council may amend the service plan to conform to the changed conditions or subsequent occurrences
pursuant to Texas Local Government Code, Section 43.056 (Vernon 1999 and Vernon Supp. 2002).
