AN ORDINANCE AMENDING CHAPTER 11, "UTILITIES", OF THE CODE OF
ORDINANCES OF THE CITY OF COLLEGE STATION, TEXAS, BY AMENDING
SECTION 10 ENTITLED "CROSS-CONNECTION CONTROL AND BACKFLOW
PREVENTION"; RELATING TO PUBLIC HEALTH BY PROTECTING THE POTABLE
WATER SUPPLY OF THE CITY OF COLLEGE STATION FROM CONTAMINATION OR
POLLUTION DUE TO ANY EXISTING OR POTENTIAL CROSS-CONNECTIONS;
PROVIDING A SEVERABILITY CLAUSE; AND DECLARING A PENALTY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION,
TEXAS:
PART 1:
That Chapter 11, "Utilities", of the Code of Ordinances of the City of College
Station, Texas, be amended as set out in Exhibit "A", attached hereto and made a
part of this ordinance for all purposes.
PART 2:
That if any provisions of any section of this ordinance shall be held to be void or
unconstitutional, such holding shall in no way effect the validity of the remaining
provisions or sections of this ordinance, which shall remain in full force and
effect.
PART 3:
That any person, firm, or corporation violating any of the provisions of this
chapter shall be deemed guilty of a misdemeanor, and upon conviction thereof
shall be punishable by a fine of not less than Twenty-five Dollars ($25.00) nor
more than Two Thousand Dollars ($2,000.00). Each day such violation shall
continue or be permitted to continue, shall be deemed a separate offense. Said
Ordinance, being a penal ordinance, becomes effective ten (10) days after its date
of passage by the City Council, as provided by Section 35 of the Charter of the
City of College Station.

EXHIBIT A
That Chapter 11,"Utilities", Section 10, "Cross-Connection Control and Backflow Prevention",
of the Code of Ordinances of the City of College Station, Texas, is hereby amended, by
amending Subsection B(2) and Subsection F(1) to read as follows:
"B. DEFINITIONS.
For the purpose of this ordinance, the following definitions apply unless the context
clearly indicates or requires a different meaning. If a word or term used in this ordinance
is not contained in the following list, its definition, or other technical terms used, shall
have the meaning or definitions listed in the most recent adopted edition of the City of
College Station Plumbing Code and/or the most recent Manual of Cross-Connection
Control published by the University of Southem California Foundation for Cross-
Connection Control and Hydraulic Research (USC FCCCHR). The following definitions
shall apply to this ordinance.
(2)
Atmospheric vacuum breaker backflow prevention device or atmospheric vacuum
breaker or AVB - shall mean a device used to prevent backsiphonage. This
device cannot be tested but can be field inspected to verify proper operation. This
device cannot prevent backpressure backflow."
"F. TESTING / INSPECTION OF DEVICES AND ASSEMBLIES
(1)
The regulatory authority shall require
assemblies to be both field inspected

Immediately after installation.
Whenever the device or assembly is moved.
A minimum of once a year for all commercial applications other than lawn
irrigation systems.
For premises that have been vacated and unoccupied for one year, prior to
re-occupancy.
Immediately after repairs.
Once every five (5) years for residential and commercial lawn irrigation
systems.
The AVB shall be excepted from the requirement in Subsection F(I) above that
such device be both field inspected and tested. The regulatory authority shall
require that the AVB be field inspected in each of the circumstances listed in
Subsection F(1)."
