HomeMy WebLinkAbout09-13-2001-11.07 - Resolution - 09/13/2001RESOLUTION NO. 9-13 -2001-11.07 A RESOLUTION OF THE CITY OF COLLEGE STATION, TEXAS, TO INCREASE THE NUMBER OF MEMBERS ON THE BOARD OF DIRECTORS OF THE BRAZOS COUNTY APPRAISAL DISTRICT AND TO CHANGE THE METHOD FOR APPOINTING THE MEMBERS ACCORDING TO SECTION 6.03 (b) OF THE TEXAS PROPERTY TAX CODE. WHEREAS, Section 6.031 (b) states: "The taxing units participating in an appraisal district may increase the number of members on the board of directors of the district to not more than 13, change the method of procedure for appointing the members, or both, if the governing bodies of three -fourths of the taxing units that are entitled to vote on the appointment of board members adopt resolutions providing for the change. ..."; and WHEREAS, the City Council of the City of College Station desires to have the composition of the appraisal district board of directors more closely reflect the proportionate share of the 2000 total levy rolls for each jurisdiction which is currently eligible to nominate and vote on board membership; and WHEREAS, the City Council of the City of College Station, desires to increase the membership of the board of directors to seven members; and WHEREAS, the City Council of the City of College Station, desires further desires to change the method of selection of board members to a simple appointment format based on the following schedule: Brazos County: Bryan Independent School District: College Station Independent School District: City of Bryan: City of College Station: One member Two members Two members One member One member NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS: PART 1: PART 2: PART 3: That the City Council hereby approves that the Brazos County Appraisal District's board of directors shall consist of seven members. That the City Council shall henceforth appoint [one] member to the Brazos County Appraisal District board of directors. That notification of the City of College Station's appointee to the Brazos County Appraisal District board of directors shall be made to the Chief Appraiser prior to November 15th of each odd number year. PART 4: That this action suspends the nomination and voting process as specified in Sections 6.03 (e)(f)(g)(h)(I)(j)&(k) of the Texas Property Tax Code. PART 5: That this action voids and rescinds any and all previously agreed upon methods of membership selection and board composition. Page 1 of 2 PART 6: That this resolution shall take effect immediately from and after its passage. PART 7: That Changes enacted by this resolution remain in effect until changed in a manner provided by Section 6.031 of the Texas Property Tax Code or rescinded by resolution of a majority of the governing bodies that are entitled to vote on appointment of board members under Section 6.03 of the Texas Property Tax Code.
