Two waivers to the block length requirements in the UDO are being requested. The first is needed due to the distance of block four along Rock Prairie Road, between Town Lake Drive and the proposed Double Mountain Road thoroughfare, which lines up with Harris Drive. The second waiver is needed for block eleven which extends from Rock Prairie Road down the shared property line with the adjacent Savage tract, to the Toledo Bend Drive stub. Parkland Dedication 23.928 acres of Community Parkland and 9.434 acres of Neighborhood Parkland are included in this preliminary plan. Additional Parkland may be required based on future Multi-Family development in the Midtown City Center portion of the proposed subdivision in accordance with the terms of the PDD. Traffic Impact Analysis An updated TIA was performed with the rezoning of the additional acreage added to the development. It specifies the traffic mitigation needed as part of future phases of the development. Compliant with Comprehensive Plan (including Master Plans) and Unified Development Ordinance Yes, with the exception of waivers previously approved in July 2019 and the two waivers being requested with this preliminary plan. As shown in the exhibit below, the first block length waiver request is for block 4 along Rock Prairie Road from Town Lake Drive to the proposed projection of Double Mountain Road towards Harris Drive. This distance is approximately 2,622 feet, which exceeds the maximum block length by 1,722 feet. The applicant is requesting this waiver as their intention is to not disturb the tributary and natural protected area that runs through block 4 (shown in green below). Page 11 of 49 The second block length waiver request is along the shared property line of the subdivision with the adjacent Eugene B. Savage Tract. This block length is measured from Rock Prairie Road in the north to the Toledo Bend Drive stub in the southwest corner. This distance is approximately 1,780 feet, which exceeds the maximum block length by 880 feet. The applicant is requesting this waiver as their intention is to provide cross access to the Savage tract closer to Rock Prairie Road. If the block break occurred closer to the natural protected areas, traffic accessing the Savage tract would have to travel farther within the Midtown Subdivision. In accordance with the Subdivision Regulations, when considering a waiver, the Planning and Rock Prairie Road Page 12 of 49 Zoning Commission should make the following findings to approve the waivers: 1) That there are special circumstances or conditions affecting the land involved such that strict application of the provisions of this chapter will deprive the applicant of the reasonable use of his land; The developer’s intent is to follow the proposed alignment of the Double Mountain Road thoroughfare with Harris Drive and provide cross access to the Savage tract at a location near to Rock Prairie Road. Special conditions on the land such as a tributary that runs through both blocks creates restrictions on where the blocks can be broken. The Rock Prairie Baptist Church property is also already platted and the block cannot be broken at the location. 2) That the waivers are necessary for the preservation and enjoyment of a substantial property right of the applicant If the waivers are not granted, the subject tract can still be subdivided. However, the waivers help limit the number of access points to Rock Prairie Road, which is classified as a major arterial, and in the case of the second waiver, allows for access to Rock Prairie with minimal residential disruption. 3) The granting of the waiver will not be detrimental to the public health, safety, or welfare, or injurious to other property in the area, or to the City in administering this chapter; and The granting of the waivers for this development will not be detrimental to the public health, safety, or welfare, or injurious to other property in the area. 4) That the granting of the waivers will not have the effect of preventing the orderly subdivision of other land in the area in accordance with the provisions of this chapter. The granting of these waivers will not have a negative impact on the orderly subdivision of other land in the area. The Baptist Church property is already platted and has two access points to Rock Prairie. The Savage property to the east has yet to be platted and once developed will take access from the new Calaveras Court connection to Rock Prairie Road. Page 13 of 49 MIDTOWN RESERVE SUBDIVISION Waiver to Section 12-8.4.E. Blocks. 1. Block Length Justification for Waiver 1 – Block 4: The requested waiver is for Block 4, the block length along the north side of the boundary in between Town Lake Drive and the proposed Double Mountain Road, which is 2,626 feet in length exceeding the maximum block length of 1200’. 1. There are special circumstances or conditions affecting the land involved such that strict application of the subdivision regulations will deprive the applicant of the reasonable use of his land. There is Natural Protected Area that cuts through middle of Block 4 and a street should not be constructed through it. There is an existing church, Rock Prairie Baptist Church, that sits on a lot in the middle of the proposed Block 4. The special circumstances or conditions for this Block is that a public street or public way would have to go near the Natural Protected Area, and a public street or public way cannot pass through the existing church and lot since it is already platted. 2. The waiver is necessary for the preservation and enjoyment of substantial property right of the applicant. The PDD zoning for Midtown along the block along Rock Prairie Road allowed the block to not be broken by a street that connects to Toledo Bend Drive. Adding another public street off Rock Prairie Road is not desirable since Double Mountain Road will eventually be constructed and there are two driveways to the Rock Prairie Baptist Church. Access to Arterial Street should be limited. 3. The granting of the waiver will not be detrimental to the public health, safety, or welfare, or injurious to other property in the area, or to the City in administering subdivision regulations. The granting of the waivers for this development will not be detrimental to the public health, safety, or welfare, or injurious to other property as the development will comply with all other standards and requirements. 4. The granting of the waiver will not have the effect of preventing the orderly subdivision of other land in the area in accordance with the previsions of the Unified Development Ordinance. The granting of this waiver will not have the effect of preventing the orderly subdivision of other land in the area Page 14 of 49 MIDTOWN RESERVE SUBDIVISION Waiver to Section 12-8.4.E. Blocks. 1. Block Length Justification for Waiver 2 – Block 11: The requested waiver is for Block 11, the block length along the east side of the boundary bordering the Savage property line, which is 1780 feet in length exceeding the maximum block length of 1200’. 1. There are special circumstances or conditions affecting the land involved such that strict application of the subdivision regulations will deprive the applicant of the reasonable use of his land. There is Natural Protected Area that cuts through middle of Block 11. The land to the east of Block 11, the Savage land, is arranged in such a way that an entrance would be more convenient closer to Rock Prairie Road. The special circumstances or conditions for this Block is that a public street or public way near the Natural Protected Area may give the Savage land an undesirable location for connecting street. 2. The waiver is necessary for the preservation and enjoyment of substantial property right of the applicant. An additional public street to break the block would require a revision to this subdivision layout which is not necessary since two public streets are proposed to connect to the Savage land. 3. The granting of the waiver will not be detrimental to the public health, safety, or welfare, or injurious to other property in the area, or to the City in administering subdivision regulations. The granting of the waivers for this development will not be detrimental to the public health, safety, or welfare, or injurious to other property as the development will comply with all other standards and requirements. 4. This an initial step toward developing a mixed-use destination adjacent to the BioCorridor. REZONING REVIEW CRITERIA 1. Whether the proposal is consistent with the Comprehensive Plan: The Comprehensive Plan Future Land Use and Character Map designates the subject property as Neighborhood Center. The Comprehensive Plan generally describes the Neighborhood Center land use designation as follows: Neighborhood Center – Areas that are appropriate for a mix of uses arranged in a compact and walkable pattern at a smaller scale than Urban Centers. These areas consist of residential, commercial, and office uses arranged horizontally in an integrated manner and may be mixed vertically within structures. Neighborhood Centers should also incorporate consolidated parking facilities, access to transportation alternatives, open space and recreational facilities, and public uses. The proposal for a mixed-use development with restaurants, retail, hospitality services, and apartments to be built at this site is consistent with the Comprehensive Plan. With easy access to Easterwood Airport and being in close proximity to the BioCorridor and Texas A&M Health Science Center, this development is providing a place of entertainment and living for those who work and play in the area. Whether the uses permitted by the proposed zoning district will be appropriate in the context of the surrounding area: The property has frontage on SH 47 to the south and HSC Parkway to the north. Adjacent properties to the north and east are zoned PDD Planned Development District and BP Business Park. Adjacent properties are partially developed and continuing to build out with medical science facilities and laboratories. The proposed PDD zoning is appropriate in the context of the surrounding area. 3. Whether the property to be rezoned is physically suitable for the proposed zoning district: The proposed concept plan for the property totals approximately 21 acres, fronting on HSC Parkway and SH 47. The proposed zoning offers a higher and better use than the existing R Rural zoning and helps stimulate commercial development and density in the area. The development will help provide an atmosphere capable of creating a mix of uses desired for the BioCorridor area. Emphasis will be placed on walkability and internal connection around a central steady state retention pond with boardwalks and commercial tenant spaces surrounding it. The property is physically suitable for the proposed rezoning. 4. Whether there is available water, sanitary sewer, storm water, and transportation facilities generally suitable and adequate for uses permitted by the proposed zoning district: Domestic water and fire flow service for this tract will be provided by the City of College Station via extending existing 8” waterline infrastructure stubbed to the property. Wastewater service for this tract will be provided by the City of Bryan. Water and sewer capacity for the proposed development is currently available. Detention is required in accordance with the BCS guidelines. Drainage and any other infrastructure required with the site development shall be designed and constructed in accordance with the BCS Unified Design Guidelines. The subject tract within the city limits has frontage on SH 47 frontage road. SH 47 is designated as a Freeway/Expressway on the City’s Thoroughfare Plan. A traffic impact analysis was performed for the rezoning requested and did not identify any traffic mitigation needed beyond potential right-turn deceleration lanes for the proposed access locations. 5. The marketability of the property: The applicant states that the proposed PDD will significantly increase the marketability of the property by providing a higher range of uses, more businesses, more accessibility and ultimately more economic opportunities. REVIEW OF CONCEPT PLAN The Concept Plan provides an illustration of the general layout of the proposed building areas as well as other site related features. In proposing a PDD, an applicant may also request variations to the general platting and site development standards provided that those variations are outweighed by demonstrated community benefits of the proposed development. The Unified Development Ordinance provides the following review criteria as the basis for reviewing PDD Concept Plans: 1.The proposal will constitute an environment of sustained stability and will be in harmony with the character of the surrounding area; 2.The proposal is in conformity with the policies, goals, and objectives of the Comprehensive Page 36 of 49 Plan, and any subsequently adopted Plans, and will be consistent with the intent and purpose of this Section; 3.The proposal is compatible with existing or permitted uses on abutting sites and will not adversely affect adjacent development; 4.Every dwelling unit need not front on a public street but shall have access to a public street directly or via a court, walkway, public area, or area owned by a homeowners association; 5.The development includes provision of adequate public improvements, including, but not limited to, parks, schools, and other public facilities; 6.The development will not be detrimental to the public health, safety, welfare, or materially injurious to properties or improvements in the vicinity; and 7.The development will not adversely affect the safety and convenience of vehicular, bicycle, or pedestrian circulation in the vicinity, including traffic reasonably expected to be generated by the proposed use and other uses reasonably anticipated in the area considering existing zoning and land uses in the area.
