AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS,
CANVASSING RETURNS AND DECLARING RESULTS OF THE GENERAL AND
SPECIAL ELECTION, HELD ON NOVEMBER 2, 2021, FOR THE PURPOSE OF ELECTING
CITY COUNCILMEMBERS PLACE 4 AND 6; AND FOR THE PURPOSE OF SUBMITTING
PROPOSED AMENDMENTS TO THE CITY CHARTER TO THE VOTERS.
RECITALS:
1. On August 3, 2021 the City Council ordered that a General and Special Election be held on
November 2, 2021 for the purpose of electing a City Councilmembers Place 4 and 6; and
for the purpose of submitting proposed amendments to the City Charter.
2. Notice of this election was duly published in The Eagle on October 6 and 13, 2021 and in
La Voz Hispana on October 8 and 15, 2021.
3. A copy of the notice was posted on the bulletin board at City Hall on October 1, 2021.
4. This election was duly and legally held on November 2, 2021, in conformity with the
election laws of the State of Texas, and the results of the election have been certified and
returned by the proper judges and clerks.
5. The City Council of the City of College Station, Texas with the following members present:
Mayor Karl Mooney, Councilmembers Bob Brick, John Crompton, Linda Harvell,
Elizabeth Cunha, John Nichols, and Dennis Maloney have today considered the returns of
the General and Special Election held on November 2, 2021.
6. It appears to the Council, and the Council finds, that the election was in all respects lawfully
held.
7. It appears to the Council, and Council finds, that the tabulation of the results of the election
is correct.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION,
TEXAS:
SECTION 1. The General and Special Election of November 2, 2021 was duly called, notice of
the election was given in accordance with law, and the election was held in accordance with law.
SECTION 2. The tabulation of votes cast in the General and Special Election held on November
2, 2021, for the purposes stated in Recital 1 above, a copy of which is attached to and made a part
of this ordinance. is adopted as the official tabulation of the votes cast at the election, and the
tabulation will be filed and recorded in the official records of the City of College Station a s the
official canvass of the election.
SECTION 3. The official canvass of the returns of the election reflects the following:
A. For the City Councilmember, Place 4, the following votes were cast:
Elizabeth Cunha 3,273
William Wright 2,545
B. For the City Councilmember, Place 6, the following votes were cast:
Dennis Maloney 2,619
Marie-Anne Mousseau-Holland 939
David Levine 2,198
SECTION 4. That Elizabeth Cunha received a majority of the votes and is elected to serve as
City Councilmember, Place 4.
That no candidate received a majority of the votes to serve as City Councilmember, Place 6. This
will require a runoff election of the two candidates receiving the highest votes.
The following votes were cast for and against the following numbered propositions:
PROPOSITION A
Shall Article XII (General Provisions), Section 116 (Personal Interest) of the College Station City
Charter be amended to read as follows? No member of the City Council shall have a financial
interest, direct or indirect, or by reason of ownership of stock in any corporation, in any contract
with the City, or be financially interested, directly or indirectly, in the sale to, or purchase from,
the City of any land, materials, supplies or services except on behalf of the City; provided,
however, that the provisions of this section shall only be applicable when the stock owned by the
member of City Council exceeds one percent (1%) of the total capital stock of the corporation.
Any violation of this section with the knowledge express or implied of the person or corporation
contracting with the City shall render the contract voidable by the City Council or City Manager.
Votes for Proposition A: 5,341
Votes against Proposition A: 647
PROPOSITION B
Shall Article XII (General Provisions) of the College Station City Charter be amended to add a
new section requiring City Council Members to both disclose any campaign contribution in excess
of $500.00 by filing an affidavit with the City Secretary and abstain from participating in and
voting on any matter before the City Council if the matter before the City Council would materially
benefit the campaign contributor or any business entity in which the campaign contributor has a
substantial interest?
Votes for Proposition B: 5,293
Votes against Proposition B: 695
PROPOSITION C
Shall Article III (The City Council), Section 17 (Number, Selection, Term), Subsection (d) of the
College Station City Charter be amended to provide that the general election is to be held on the
November uniform election date of each odd-numbered year instead of on the November uniform
election date of each even-numbered year; and to provide a process to transition from even-
numbered election years to odd-numbered election years?
Votes for Proposition C: 2,118
Votes against Proposition C: 3,749
SECTION 5. That Amendments to the City Charter in the Propositions A and B having been
approved by a majority of the votes cast in the election, shall take effect from and after the effective
date of this ordinance.
PASSED, APPROVED AND ADOPTED this the 11th day of November 2021.
