situated in the,Richard Carter Survey, Abstract No. 8, College Station, Brazos
County, Texas, and being part of the 34.13 acre tract described in the Partial
Release of Lien executed by Bert Wheeler, Inc., to Davis & Scarmardo Construction
Co., Inc., as recorded in Volume 1082, Page 337, of the Official Records of

COMMENCING at the 1/2" iron rod marking the west corner of the
beforementioned 34.13 acre tract in the easterly right-of-way line of State
Highway No. 6 (East By-pass);
THENCE N 76' 11' 24" E along the north line of the beforenrentioned 34.13
acre tract, for a distance of 610.00 feet to a 1/2" iron rod marking the angle
point corner of the 34.13 acre tract, same being the PLACE: OF BEGINNING of this
description;
THENCE N 51" 27' 25" E along the northwest line of the beforementioned
34.13 acre tract, for a distance of 535.69 feet to a 1/2" iron rod marking the

1) Current Garner: Regency Parkway, Inc., 34.13 acre tract described in Volume
1082, Page 337 (November 1988).
2) 1/2" iron rods set at all corners unless otherwise noted.
3) Total subdivision acreage is 23.50 acres in 3 lots.
4) The 100 Year Flood Plain Boundary was obtained from Federal Emergency
Management Agency "Flood Insurance Rate Map" - Cormxanity Panel No. 480083
0001B, Effective Date July 2, 1981.
5) Overhead electrical service will be extended southward along the east right-
of-way line of State Highway 6, within recently executed 20 foot utility
easement granted by Bert Wheeler, from existing distribution poles at Farm
to Market Road 60.
6) Water service will be extended northward from an existing 18" water line
which crosses beneath Highway 6 at a point approximately 1550 feet north of
State Highway 30. The proposed waterline extension will be placed 5' west
of the existing highway R.O.W. Development requires an 8" diameter, line
extension with the City's oversize line participation increasing said line
to 18" diameter.

7) The Exxon pipe lines and the blanket easement recorded in Volume 49, Page
19, along the northeast line of Lot 3 will not be affected by proposed
development and usage (9 hole golf course) of said lot. No city owned
utilities are proposed in the vicinity of the existing petroleum products
lines:
a) Low Pressure lines transport gasoline and like grade products at.3 to
4 feet depth of cover.
b) High Pressure lines are rated at approximately 2500 psi and are buried
at 6 to 7 feet of cover.
There are no specific restrictions to full usage and enjoyment of subject
tract by grantor in the previously mentioned blanket easement.
8) The owner supplied contours information for Lot 1 fran construction surveys.
Kling Engineering and Surveying field checked and verified e l evat ions on Lots
2, 3, and west bank of creek (all lands lying southwest of Carter's Creek).
Based on above described work all of Lot 3 lies above elevation 259 which
is one foot above the 100 year f 1 oodwater e 1 evat ion of 258 adjacent said lot.
9) Project Benchmark is the lowest point of steel on private bridge across
Carter's Creek at elevation 259.20 obtained fran Table 5 on page 22 of the
U. S. Army Corps of Engineers study for Carter's Creek dated March 2�,�, 1973.
K1 ing Engineering and Surveying found this datum to be 0.40 feet highter than
an elevation established from a city benchmark. Said city benchmark is a
railroad spike in power pole north of University Oaks at west frontage road
of State Highway 6; elevation = 292.40.
