Joint Workshop Meeting

COUNCILMEMBERS PRESENT: Mayor Mcllhaney, Mayor Pro Tem Mariott,
Councilmembers Maloney, Silvia, Massey, Garner and Hazen
PLANNING AND ZONING COMMISSIONERS PRESENT: Chairman Floyd,
Commissioners Williams, Happ and McMath
STAFF PRESENT: City Manager Brymer, City Attorney Cargill Jr., Director of Development
Services Callaway, Senior Assistant City Attorney Nemcik, Senior Planner Kuenzel and
Assistant City Secretary Casares
Mayor McIlhaney called the Council Special Joint Meeting to order at 1:10 p.m.
Chairman Floyd called the Planning and Zoning Commission Special Joint Meeting to order at
1:11 p.m.
Agenda Item No. 1 -- Presentation~ discussion and possible on the Unified Development
Ordinance.
Director of Development Services Jim Callaway stated that that draft Unified Development
Ordinance received included the changes from the July 11,2001 meeting. The purpose of this
meeting was to continue the review of the remainder of the document.
Mr. Callaway introduced Mr. Lee Einsweiler with Duncan and Associates.
P&Z Chairman Rick Floyd expressed concern that not everyone has a clear understanding of the
review processes. He suggested an additional workshop meeting with a pre-fixed schedule to
review all sections. The two groups discussed another meeting to receive additional input from
interested parties with a public hearing at the conclusion of the meeting.
The Council and Planning and Zoning Commissioners reviewed a list of key Unified
Development Ordinance issues. The issues were:

ZBA Variances
Mr. Einsweiler explained the Administrative Adjustments in Section 3.B. After deliberation, the
Council and the Planning and Zoning Commissioners agreed to the following changes:
· Allow administrative adjustments of up to 20%.
· Clarify that the administrator is not obligated to approve the adjustments. Allow the
Administrator to forward any case to the Zoning Board of Adjustment.
· Require the administration to provide a report of staff variances to the Zoning Board of
Adjustments.
Zero-rise rule
Following a brief discussion, Council and Planning and Zoning Commissioners directed staff
and Mr. Einsweiler to leave the zero-rise rule for future consideration. The draf~ Unified
Development Ordinance will include the current drainage regulations.
Council recessed the meeting at 2:40 p.m. for a short break. The meeting reconvened at
2:47 p.m.
Commercial Districts
The Council and Planning and Zoning Commissioners directed staff to combine C-G and C-C
into a single district. Also, change Commercial, Office and Retail to require Condition Use
Permit for certain uses.
Electronic Signs
The Council and Planning and Zoning Commissioners agreed that Electronic Signs would
remain prohibited in the Unified Development Ordinance.
Non-Conforming Signs
The Council and Planning and Zoning Commissioners agreed to require compliance of non-
conforming signs at the time of a structural change.
Commercial/Industrial Bulk Restrictions
The Council and the Planning and Zoning Commission directed staff to add height limits to
industrial/commercial districts and a provision detailing how the heights are measured.

Special Exceptions
The Council and Planning Zoning Commissioners agreed to delete the special exception
provision. Also, change some special Exceptions permits in the use table to Conditional Use
Permits and others to P* - Permitted Subject to Supplemental Standards.
Other Issues as identified by Council/Commissioners
The Council and Planning and Zoning Commissioners directed staff to schedule an all-day
workshop meeting to gather input from interested parties. Sections will be grouped according to
common themes. Additional workshop meetings will follow if the review is not completed.
During the 50-day review process, staff will provide educational engagements to interested
groups.
Councilman Massey asked staff to prepare a case study of certain provisions and how the new
ordinances would affect them.
After a brief discussion, Council and the Planning and Zoning Commissions directed staff to add
language to allow concurrent processing of the Comprehensive Plan regarding amendments and
zoning/rezoning, and general development.
Councilman Massey requested adding a statement that the City's Comprehensive Plan is the
fundamental guide for the development of the City.
Chairman Commissioner Floyd suggested clarifying the signage provisions in regards to back
and side of street surfaces of buildings.
