Brymer City Council James Massey Ron Silvia Winnie Garner Dennis Maloney Anne Hazen MINUTES COLLEGE STATION CITY COUNCIL Special Meeting Tuesday, July 31, 2001 at 8:00 a.m. City Hall Training Room COUNCILMEMBERS PRESENT: Mayor Pro Tem Mariott, Councilmembers Silvia, Massey, Hazen, Maloney, Garner STAFF PRESENT: City Manager Brymer, Assistant City Manager Brown, City Secretary Hooks, City Attorney Cargill, Jr., Assistant to the City Manager Brandenburg Aoenda Item No. 1 -- Call to Order Mayor Pro Tem Mariott called the special meeting to order at 8:00 a.m. with Mayor McIlhaney absent. Agenda Item No. 2 - Presentafion~ discussion~ and possible action approving an ordinance amending the current smoking ordinance. City Manager Tom Brymer introduced the proposed amendment for council deliberation. The proposed amendment would delete Subsection B (2)(a). The current ordinance exemption under this subsection provides: "...it is an exception to the application of provision (1) of this subsection that the person is smoking in a situation in which the person is present at an event in which an entire room or hall is used for a private social function and seating arrangements are under the control of the sponsor of the function." City Attorney Cargill, Jr. commented on discussions held during a meeting held last week with the owners of the Wolf Pen Bowling Alley and their attorney. The Camps' informed the staff that if the city did not agree with the Camps' position, the city could do three things: 1. City could amend ordinance 2. City could file for declaratory relief or take some other legal action 3. Camps could take legal action against the city Council Meetings 07/31/01 Page 2 Mr. Cargill proposed two options for council consideration. 1. The city council could take no action, if they agreed with the Camps' view of the exception. 2. If Council wants no smoking in the bowling alley then delete the exception for private social functions. Motion was made by Councilman Massey to adopt Ordinance No. 2503 amending Chapter 7, "Health and Sanitation", of the Code of Ordinances of the City of College Station, Texas by amending Section 9, "Tobacco Products and Smoking", and providing an effective date. Motion seconded by Councilman Garner. The ordinance amendment deletes the following subprovision "a" in subparagraph (2). "a. in a situation in which the person is present at an event in which an entire room or hall is used for a private social fimction and seating arrangements are under the control of the sponsor of the function;" That no other changes are made to Section 9. All other provisions in Section 9 shall remain in full force and effect. Subprovision (a) shall be reserved for future use and the other subprovisions shall not be renumbered. Motion carded unanimously, 6-0. FOR: Mariott, Massey, Garner, Maloney, Silvia, Hazen ABSENT: Mcllhaney Agenda Item No. 3 -- Adiourn. Councilman Massey made a motion to adjourn.
