Box 9960 College Station, Texas 77842 Phone 979.764.3570 / Fax 979.764.3496 MEMORANDUM DATE: November 7, 2019 TO: Planning and Zoning Commission / Impact Fee Advisory Committee FROM: Carol Cotter, P.E., City Engineer SUBJECT: Semi-Annual Report - System-Wide Impact Fees for Water, Wastewater, and Roadway The City of College Station adopted “System-Wide” Impact Fees for water, wastewater, and roadways in the latter part of 2016. Fee implementation has occurred in phases, with full fees having occurred in December of last year. The service area for roadway impact fees is bounded by the city limits; however, service areas for system-wide water and wastewater impact fees do not strictly follow city limit lines and include some areas of the City’s Extra-Territorial Jurisdiction (ETJ). Local Government Code requires Semi-Annual Reporting to monitor the progress of impact fees and to determine if an update to the fee study is necessary before the statutory five-year requirement. There have been no major changes in the water, wastewater, or roadway impact fee programs during this reporting period. Staff recommends that the Advisory Committee forward this report to City Council for their update. The City of College Station Code of Ordinances Chapter 107, Impact Fees, designates the Planning and Zoning Commission as the Impact Fee Advisory Committee (IFAC) with the inclusion of an ETJ representative for service areas extending into the ETJ. The IFAC is established to: 1. Advise and assist the City in adopting Land Use assumptions. 2. Review the Capital Improvements Plan and file written comments. 3. Monitor and evaluate implementation of the Capital Improvements Plan. 4. File semi-annual reports with respect to the progress of the Capital Improvements Plan. 5. Advise the City Council of the need to update or revise the Land Use Assumptions, Capital Improvements Plan, and Impact Fees. System-Wide Impact Fees System-wide impact fees for water and wastewater were adopted September 22, 2016, with roadway impact fees following on November 10, 2016. The City’s adopted collection rates are lower than the maximum allowable fees calculated as presented in the table below. Water and wastewater fees were phased in over a two-year period, starting at 50% of the adopted rate, but are now being collected at the full rate. Roadway impact fees were phased in over a three-year period, beginning with zero fee collection in year one and 50% in year two. Full implementation of the fees occurred in December of 2018. Land Use Assumptions and the related Capital Improvements Plans have remained unchanged over the reporting period April 1, 2019 through September 30, 2019. Impact fees can only be spent on eligible projects identified in the CIP. Status of the various programs are as follows: Water $500/Service Unit System-wide water impact fee revenues collected over the reporting period were $129,600 for a total amount of $736,350. Eligible costs of the adopted water system capital improvements plan are estimated at $34,140,850. Projected revenues at the adopted rate are estimated to be $5,852,048 based on the study’s 10-year growth assumptions. Collected amounts are budgeted to help fund Well #9 and Well #9 Collection Loop projects currently under construction. It is anticipated that the revenue will also support the SH6 Water Line project. Wastewater $3,000/Service Unit System-wide wastewater impact fee revenues collected over the reporting period were $641,550 for a total amount of $3,336,650. Eligible costs of the adopted wastewater system capital improvements plan are estimated at $72,285,486. Projected revenues at the adopted rate are estimated to be $39,292,708 based on the study’s 10-year growth assumptions. Collected amounts will be used to help fund the Lick Creek Wastewater Treatment Plant expansion, currently under construction. Roadway $375(Res) $80(Non-Res) /Service Unit Roadway impact fees collected over the reporting period were $23,144 for total amount of $127,166 (Zone A), $43,807 for total amount of $113,425 (Zone B), $163,858 for total amount of $542,703 (Zone C), and $98,931, for total amount of $183,526 (Zone D). Eligible costs of the adopted roadway capital improvements plan are estimated at $134,000,000. Projected revenues at the adopted rates are estimated to be $12,000,000 based on the study’s 10-year growth assumptions. Specific allocations will be made to eligible projects within the applicable zones in FY20. the previously approved preliminary plan in 2010, which created Emerald Ridge Estates Phases 1-4, a gated single family residential subdivision. Emerald Ridge Estates Phase 1 has been platted and a portion of the lots have been sold and developed. The proposed revision of the preliminary plan includes modifications in phasing to create 19 new, single family lots on 86 acres in Emerald Ridge Estates Phases 2, 3A, 3B, and 4. There is significant floodplain on Phase 4. The entirety of Emerald Ridge Estates features 40 single family lots with one point of access to a street and a second point of access being a 20’ remote emergency access. Preliminary Plan Preliminary Plan for Emerald Ridge Estates, Phases 2, 3A, 3B and 4 PP2018-000009 SUBDIVISION WAVIER REQUEST The proposed Preliminary Plan is in compliance with the applicable Subdivision Regulations contained in the UDO except for the following waiver request: UDO Section 12-8.3.H.1.d. ‘Access Ways’– Per the requirements of this section, an Access Way may be required to provide additional pedestrian and bicycle circulation within a subdivision, between subdivisions, between culs-de-sac, or to provide access to schools, parks, shopping centers, multi-use paths, transportation, and other community facilities in the vicinity. The pedestrian plan proposes a 10 foot multi-use path located along the Gulf States Utility Easement, which crosses the property in Phases 2 and 4. The ordinance requires a connection to the proposed multi-use path via an access way in order to provide adequate connectivity to the larger pedestrian network. The applicant is requesting to not provide the required access way, but has indicated plans to provide a 30 foot public access easement for the future multi-use path, which will be dedicated with the final plat, as shown in the graphic below. In accordance with the Subdivision Regulations, when considering a waiver the Planning and Zoning Commission should make the following findings to approve the waiver: 1) That there are special circumstances or conditions affecting the land involved such that strict application of the provisions of this chapter will deprive the applicant of the reasonable use of his land; A ten foot multi-use path is proposed on the Pedestrian Plan to connect through phases two and four of the proposed development in order to provide adequate connectivity to the larger pedestrian network. The applicant has requested to eliminate this point of access because the applicant believes the pedestrian connectivity reduces the desirability of a private development. Staff finds that there are no special circumstances affecting the land that deprive the applicant of reasonable use of the land for a single family development. 2) That the waivers are necessary for the preservation and enjoyment of a substantial property right of the applicant; If the waiver is not granted, the subject tract can still be subdivided as a single family subdivision, and there will be one public access easement including a public sidewalk dedicated as a connection to the proposed multi-use path with the final plat. The applicant finds that the waiver is necessary to preserve privacy for the community of individuals that already live in the private subdivision. If the waiver is not granted, the applicant has an opportunity to connect into the larger pedestrian network, and the connection will be dedicated by a public access easement that shall be located between 2 of the 19 lots proposed. Staff does not find that the waiver is necessary for the preservation and enjoyment of a substantial property right. 3) The granting of the waiver will not be detrimental to the public health, safety, or welfare, or injurious to other property in the area, or to the City in administering this chapter; and With the provision of the required access way, there will be a public access easement in place allowing for the connection of a larger pedestrian network and increased walkability within the City. The applicant has offered to provide a required access way outside the boundaries of the preliminary plan, as shown on page 1 of the exhibit. With the proposed connection being located outside the bounds of this preliminary plan, there is no guarantee that this access way will be constructed. Staff believes that the granting of the waiver for this development will be detrimental to the public health and welfare by depriving existing and future residents’ pedestrian access to the larger network. 4) That the granting of the waivers will not have the effect of preventing the orderly subdivision of other land in the area in accordance with the provisions of this chapter. Granting the requested waiver will not affect the ability of surrounding tracts to meet the ordinance when platting. However, staff believes the requested waiver would allow for reduced pedestrian connectivity in the immediate area. Staff is recommending denial of the waiver request. Rather than the referenced Access Way near the center of the block, the proposed preliminary plan provides an access way from the area before the Gate House to the future Pedestrian Greenway located north east of the development. There are special circumstances or conditions affecting the land involved such that strict application of the Subdivision regulations will deprive the applicant of the reasonable use of his land. The current subdivision is a gated community and having an access point within the subdivision will not preserve privacy. The gated subdivision is a private community and is a major reason people are living in the subdivision. Any public access will defeat the purpose of the gated subdivision. Only a location change is being requested. The waiver is necessary for the preservation and enjoyment of a substantial property of the applicant. Once again, this is a gated subdivision and providing a public access through the subdivision will not allow the applicant to provide privacy to the community of individuals that already live in the subdivision. Lots were purchased and homes built with the understanding that the subdivision was gated and private. The granting of the waiver will not be detrimental to the public health, safety, or welfare, or injurious to other property in the area, or to the City in administering subdivision regulations. Granting this waiver will not be detrimental to the public health, safety or welfare, to property in the area because we are proposing to allow for another access point outside of the subdivision. See attached metes and bounds description. The proposed access point will provide a closer connection to the bike lanes already existing on Emerald Parkway and avoids the gates of the private Emerald Ridge Subdivision. The granting of the waiver will not have the effect of preventing the orderly subdivision of other land in the area in accordance with the provisions of this UDO. The land on three sides of the subdivision is already developed and the remaining side is flood plain. The possibility of future development is unlikely. Granting this waiver will not prevent the orderly subdivision of other land in the area in accordance with the provisions of the UDO. All provisions of the UDO have been met for the proposed subdivision and granting this waiver will not affect the ability of any future development from also meeting such requirements.
