At this time, the Chairman will open the floor to citizens wishing to address the Commission
on issues not already scheduled on tonight's agenda. The citizen presentations will be
limited to three minutes in order to accommodate everyone who wishes to address the
Commission and to allow adequate time for completion of the agenda items. The
Commission will receive the information, ask city staff to look into the matter, or will place
the matter on a future agenda for discussion. (A recording is made of the meeting; please
give your name and address for the record.)
All matters listed under Item 5, Consent Agenda, are considered routine by the Commission
and will be enacted by one motion. These items include preliminary plans and final plats,
where staff has found compliance with all minimum subdivision regulations. All items
approved by Consent are approved with any and all staff recommendations. There will not
be separate discussion of these items. If any Commissioner desires to discuss an item on
the Consent Agenda it will be moved to the Regular Agenda for further consideration.

Summary: Begin the first phases of updating the 2009

creating a public input and stakeholder outreach report and a best practices report, conducting
an analysis of the existing land use and transportation situation, building and testing

4.3 Presentation, discussion, and possible action regarding the 2019 P&Z Plan of Work.
Planning Administrator Golbabai provided updates on Plan of Work items including the stakeholder process with the Comprehensive Plan update.
4.4 Presentation, discussion, and possible action regarding an overview of existing and planned thoroughfares and intersections to accommodate long-term transportation needs along and across the Union Pacific railroad.

Transportation Planning Coordinator Schubert presented this item to the Commission to discuss
railroad crossings and thoroughfare planning including plans for intersections, optimized railroad crossings, and decreased railroad crossing demands.
Commissioner Christiansen asked if there is enough right-of-ray (ROW) to build a grade separation at Wellborn Road and Rock Prairie Road without acquiring additional ROW.
Transportation Planning Coordinator Schubert stated that there is not currently enough ROW. Commissioner Osborne inquired about the future of Old Wellborn Road with addition of the Deacon Drive crossing and upgrades. Project Manager, Engineer I James Smith stated that Old Wellborn Road will not be connected to the upcoming Deacon Drive crossing, and will be disconnected from Rock Prairie Road on the north side. Mr. Smith also stated that this is in effort to reduce connections to businesses along General Parkway. Commissioner Oldham asked in terms of prioritization, are improvements based off of traffic
flow, number of crossings, or is there consideration of accidents. Mr. Oldham also asked if there are any at-grade crossings where there is a low amount of crossings, but a high amount of accidents.
Transportation Planning Coordinator Schubert stated that the City takes magnitude of crashes within proximity related to safety improvements into account.
There was general discussion amongst the Commission.

Commissioner Guerra removed Consent Agenda Items #5.3 and #5.4 from the Consent Agenda for discussion.
Commissioner Christiansen motioned to approve Consent Agenda Items 5.1 and 5.2. Commissioner Osborne seconded the motion, motion passed (6-0).
Regular Agenda 6. Consideration, discussion and possible action on items removed from the Consent Agenda by Commission Action. Consent Agenda Items #5.3 and #5.4 were removed from the consent agenda for discussion. Commissioner Guerra asked general questions in regards to the parkland dedication. Mr. Guerra
asked if the park property is still dedicated to the City, if it would be maintained by the Home Owner’s Association (HOA), and if these plats were presented to the Parks and Recreation Advisory Board for approval.
Senior Planner Chafin responded that the property is still being dedicated to the City, and a separate maintenance agreement will be in place with the Developer of the property. Ms. Chafin also responded that the Parks and Recreation Advisory Board reviewed the preliminary plan for this project, and recommended approval of proposed parkland with maintenance by developer. Commissioner Guerra asked if both common areas and public parkland are figured into greenspace requirement for cluster development.

Senior Planner Chafin responded that the common areas are factored into the greenspace
requirement, but parkland dedication is calculated separately from the greenspace requirement. Commissioner Guerra stated that originally the Traffic Impact Analysis (TIA) also analyzed this development as 1,500 homes, however the property will be platted with less density. Mr. Guerra
also stated that two multi-family developments were submitted within the same time frame, corresponding with the existing TIA. Mr. Guerra asked if the third planned multi-family development would compensate for the missing capacity accounted for in the original TIA.
Transportation Planning Coordinator Schubert stated that the TIA included the other proposed projects in the area as part of the analysis. Commissioner Guerra stated that Staff needs to be mindful of future developments as current developments are being reviewed, specifically at the intersection of Arrington Road and Greens Prairie Road. Commission Oldham recused himself from the deliberation and vote on Agenda Items 5.3 & 5.4 Commissioner Mather motioned to approve Consent Agenda Items 5.3 and 5.4. Commissioner Christiansen seconded the motion, motion passed (4-0). Commissioner Oldham returned to the meeting.
The Commission moved to Informational Item #4.

The Commission may seek advice from its attorney regarding a pending or contemplated litigation subject or settlement offer or attorney-client privileged information. Litigation is an ongoing process and questions may arise as to a litigation tactic or settlement offer which needs to be discussed with the Commission. Upon occasion the Commission may need information from its attorney as to the status of a pending or contemplated litigation subject or

Project Overview In April 2017, the subject property was rezoned to PDD Planned
Development District. The original preliminary plan was approved in
November 2018. This revised preliminary plan changes the phasing of
the development and requests one additional waiver to block length.
Divided into 27 phases, this preliminary plan is in preparation for the
future subdivision of the property into 551 Single-Family lots and 31
multi-family and/or commercial lots and includes the extension and
right-of-way dedication of Bird Pond Road (a planned 4-lane minor
arterial), a portion of Lakeway Drive (4-lane minor arterial) and Double
Mountain Road (minor collector) through the property.
Parkland Dedication The Parks & Recreation Advisory Board recommended approval of 25.2
acres of Community Parkland and 7.4 acres of Neighborhood Parkland to
be dedicated and developed with this Preliminary Plan. Additional
Parkland may be required based on future Multi-Family development in
the Midtown City Center portion of the proposed subdivision in
accordance with the terms of the PDD.
Traffic Impact Analysis
The subject tract has frontage to Rock Prairie Road East which is
designated as a future 4-lane Major Arterial on the Thoroughfare Plan. It
is currently constructed as a 2-lane rural section roadway. A City capital
improvement project is underway to extend Lakeway Drive which is
constructing 2 lanes of the future 4-lane Minor Arterial across the tract.
Other thoroughfares to be constructed with the development of the
tract include the:
Extension of Bird Pond Road, a 4-lane Minor Arterial;
Remaining 2 lanes of Lakeway Drive to complete the 4-lane
Minor Arterial;
Midtown Drive, a 2-lane Major Collector; and
Extension of Double Mountain Road, a 2-lane Minor Collector.
A traffic impact analysis (TIA) was performed as part of the Preliminary
Plan application. The uses proposed by the applicant in the TIA include
2,112 residential units, 385,000 square feet of non-residential uses
(retail, restaurants, offices and a recreational community center) as well
as 365 hotel rooms. The proposed uses have been divided into 3 general

phases based on build-out timeframes and represent almost 32,000 daily
vehicle trips with 1,909 being in the AM Peak hour and 2,244 in the PM
peak hour. Given the magnitude and duration of the build out of the
proposed development, the TIA will likely need to be updated and
amended over time as assumptions related to the proposed uses and
timing of the development change.
Beyond completing the thoroughfares already mentioned, the TIA
identified other mitigation needed to retain an acceptable level of
service to the internal and surrounding roadway network as a result of
the development. The mitigation has been identified based on the 3
general phases of development identified in the TIA.
Phase 1 mitigation includes:
Constructing left turn lanes on each approach of Double
Mountain Road to Bird Pond Road and implementation of an all-
way stop at the intersection.
Modification of the intersection of Rock Prairie Road at
Stonebrook Drive to construct an eastbound right turn lane on
Rock Prairie at Stonebrook and a northbound left turn lane on
Stonebrook at Rock Prairie. A roundabout at Rock Prairie and
Stonebrook is a potential alternative to installing the turn lanes.
The City has a future project to widen Rock Prairie to a 4-lane
divided roadway from SH 6 through Medical Avenue. With either
alternative, there is the potential for the applicant to provide
funds to the City to implement this mitigation so it can be
included as part of the capital project that widens this section of
Rock Prairie.
Phase 2 mitigation includes:
Constructing a right turn lane on westbound Rock Prairie Road at
its intersection with the SH 6 Northbound Frontage Road.
Phase 3 mitigation includes:
Constructing a right turn lane on SH 6 Northbound Frontage
Road at its intersection with Rock Prairie Road.
Installing a traffic signal at the intersection of Rock Prairie Road
and William D. Fitch Parkway including left turn lanes on each
approach of Rock Prairie.
Constructing an acceleration lane on SH 6 Northbound Frontage
Road at Lakeway Drive. If Bird Pond Road has been extended to
SH 6 by others, this mitigation will not be needed.
Widening and realigning existing Bird Pond Road to the
proposed Bird Pond Road, providing a right turn lane on
eastbound Rock Prairie at proposed Bird Pond, and installing a
traffic signal at the intersection.

SUBDIVISION WAVIER REQUEST
A Preliminary Plan for this property was approved in November of 2018, and the Planning & Zoning Commission approved a total of seven waivers to block length
and one waiver to Parkland Dedication to allow the Parkland to be dedicated in multiple phases. In addition to those previously approved waivers, this revised Preliminary Plan is in compliance with the applicable Subdivision Regulations contained in the UDO except for the following waiver request:
UDO Section 8.3.G.2. Blocks. This property is subject to a Planned Development District (PDD) that includes a meritorious modification to the Subdivision Regulations to allow for a 1,200 foot block length of a linear park block adjacent and parallel to a Right-of-Way on Rock Prairie Road, Bird Pond Road, and Lakeway Drive. The eastern blockface of Bird Pond Road from McQueeny Drive to Lakeway Drive has a
block length of 1,510 feet, which exceeds the maximum by 310 feet.
In accordance with the Subdivision Regulations, when considering a waiver, the Planning and Zoning Commission should make the following findings to approve the
waiver (Staff findings are in italics):
1) That there are special circumstances or conditions affecting the land involved
such that strict application of the provisions of this chapter will deprive the
applicant of the reasonable use of his land;
This property is designated as “Town Center Commercial” on the PDD Concept Plan, and is intended to be developed as a walkable, vibrant, urban mixed-use environment.
The PDD states that in order to achieve the desired urban form, the development is
proposed to have no buffers between uses and minimal setbacks. The PDD also states that the availability of public parking is considered very important to the success of the
development. The applicant desires to construct a private drive aisle in lieu of a public
street, in order to develop the maximum number of “on-street” head-in parking possible with Phase 302 of this development. The proposed private drive aisle will achieve the
desired access and connectivity, while allowing the flexibility in setbacks and parking as
intended by the PDD.
Phase 302 also abuts Community Parkland which includes a pond, amphitheater and extensive trails that circle the pond and connect into the Single-Family portion of the
development and ultimately Lick Creek Trail; providing additional pedestrian access
throughout the subdivision.
2) That the waiver is necessary for the preservation and enjoyment of a substantial
property right of the applicant;
If the waiver is not granted, Phase 302, Block 1 can still be subdivided. However, it
would require a street through the property and limit the design flexibility of the site as intended by the PDD.
3) The granting of the waiver will not be detrimental to the public health, safety,
or welfare, or injurious to other property in the area, or to the City in
administering this chapter; and
The granting of the waivers for this development will not be detrimental to the public health, safety, or welfare, or injurious to other property as the development will comply
with all other standards and requirements.
4) That the granting of the waiver will not have the effect of preventing the orderly
subdivision of other land in the area in accordance with the provisions of this
chapter.
The granting of this waiver will not affect the subdivision of other land since cross access will be provided between tracts when they develop and the property will have
access to both Bird Pond Road and Lakeway Drive.
Summary of staff recommendations
Staff is recommending approval of the waiver request.
MIDTOWN ON LAKEWAY SUBDIVISION
Waiver to Section 12-8.4.E. Blocks. 1. Block Length
Justification for Waiver 1 – Block 1:
The requested waiver is for Block 1, the block length along the northeast side Bird Pond Road,
which is 1510 feet in length which exceeds the maximum block length of 1200’. Block 1 is
located near the southeast corner of the Midtown on Lakeway Subdivision, northeast of the
intersection of Lakeway Drive and Bird Pond Road.
1. There are special circumstances or conditions affecting the land involved such that strict application of the subdivision regulations will deprive the applicant of the reasonable use of his land. The land to the east of Block 1, Lots 1 through 3 is proposed to be
parkland and there is floodplain to the south so the only way to break the block is to
build a public street or public way between Bird Pond Road and Lakeway Drive. The
special circumstances or conditions for this Block is that a public street or public way
would not allow head-in parking on it. Per the PDD “availability of public parking is
considered very important to the success of the development.” A hotel is being
proposed on Lot 2 and its Site Plan has head-in parking along a private drive.
2. The waiver is necessary for the preservation and enjoyment of substantial property right of the applicant. A public street or public way to break the block would limit the
Developer’s ability to execute the current plan for a hotel on Lot 2. This waiver is
necessary to provide a walkable vibrant urban environment near the enhanced
amenities around the existing pond and proposed park. A Private Access easement
would be provided along the drive for access through the development.
3. The granting of the waiver will not be detrimental to the public health, safety, or
welfare, or injurious to other property in the area, or to the City in administering
subdivision regulations. The granting of the waivers for this development will not be
detrimental to the public health, safety, or welfare, or injurious to other property as
the development will comply with all other standards and requirements.
4. The granting of the waiver will not have the effect of preventing the orderly subdivision
of other land in the area in accordance with the previsions of the Unified Development Ordinance. The granting of this waiver will not affect the subdivision of other land
since this block break is in the interior of the Midtown on Lakeway Subdivision.

amendment to Appendix A, “Unified Development Ordinance,” Article 9, “Nonconformities”,
Section 9.4, “Nonconforming Lots of Record”, adding Subsection F, “Lots Made Nonconforming
by Annexation”. Case# ORDA2019-000007. (Final action on this item is scheduled for the
Thursday, August 8, 2019 City Council Meeting - subject to change)
Background:
Planning and Development Staff recently received multiple property owner inquiries about
replatting existing lots that were made nonconforming by the zoning regulations applied at the
time they were annexed into the City limits. These property owners were unable to meet full-
compliance with the dimensional standards of their current zoning regulations but desired to
replat in a way that would make their property come closer to compliance than their current
situation. Currently, it is not clearly stated in the Unified Development Ordinance that this type of
replat is allowed. Therefore, staff is initiating a new item, Article 9.4, Subsection F, “Lots Made
Nonconforming by Annexation” to explicitly state that replatting existing lots and platted or
partially-platted building plots made nonconforming through annexation are allowed to replat,
provided that the resulting replat brings the property closer to compliance with current zoning
district standards.

Sec. 9.4. - Nonconforming Lots of Record.
A. Authority to Utilize for Single-Family Residence.
In any district in which single-family dwellings are a permitted use, notwithstanding the regulations imposed by any other provisions of this Section, a single-family detached dwelling that complies with the restrictions below may be erected on a nonconforming lot that is not less than thirty (30) feet in width, consisting entirely of one (1) tract of land of not less than three thousand (3,000) square feet,
and that:
1. Has less than the prescribed minimum lot area, width, and/or depth;
2. Is shown by a recorded plat or deed to have been a lot of record owned separately and individually from adjoining tracts of land at a time when the creation of a lot of such size, depth, and width at
such location would not have been prohibited by any zoning or other ordinance; and
3. Has remained in separate and individual ownership from adjoining tracts of land continuously
during the entire time that the creation of such lot has been prohibited by the applicable zoning ordinance or other ordinances.
B. Regulations for Single-Family Use of Nonconforming Lots.
A nonconforming lot authorized to be used pursuant to this Section may be used for a single-family dwelling and no other structure except for a garage or carport. Construction of such single-family dwelling shall comply with all the regulations (except lot area, width, and depth) applicable to single-
family dwellings in the zoning district in which the lot in question is located, except that the following side yard requirements shall apply in place of the side yard requirements otherwise applicable:
1. The dwelling shall be placed on the lot so as to provide a yard on each side of the dwelling.
2. The sum of the widths of the two (2) side yards on such lot shall be not less than the smaller of:
a. Twenty-five (25) percent of the width of the lot; or
b. The minimum total for both side yards prescribed by the bulk regulations for said zoning district; and
3. No side yard shall be less than three (3) feet wide.
C. Regulations for Certain Nonconforming Lots Zoned R Rural.
1. A single-family dwelling and accessory structure(s) in areas zoned R Rural, may be erected or
structurally altered on a nonconforming lot of record, that is not less than five thousand (5,000) square feet in area and not more than one (1) acre in area, so long as the structure or the addition to the structure complies with the setbacks established by the GS General Suburban zoning district.
2. A single-family dwelling or accessory structure located on property within the area annexed by Ordinance No. 3331, adopted by the City Council on April 14, 2011, may be erected or structurally
altered on a nonconforming lot of record provided the proposed construction complies with the setback requirements established by the GS General Suburban zoning district.
D. Other Uses of Nonconforming Lots: Site Plan Required.
In any district in which single-family dwellings are not permitted, a nonconforming lot of record which
meets the requirements above may be used for any use permitted in the district in which it is located if, but only if, a site plan for such use has been approved in accordance with the provisions of the Site
Plan Review section of this UDO.
E. Lots Made Nonconforming by Right-of-Way Acquisition.
Any lot made nonconforming solely by means of area dedicated, condemned, sold or otherwise conveyed for public right-of-way shall be allowed to pursue any allowed use as if such area were a
part of the remaining lot, except that all applicable setbacks shall be adhered to.
F. Lots Made Nonconforming by Annexation. Existing lots and platted or partially-platted building plots made nonconforming by the zoning applied at the time of annexation shall be allowed to replat, provided that the resulting replat brings the property closer to compliance with current zoning district standards.

“Requirements for Park Land Dedication,” Appendix 1, “Park Land Dedication and Development Fees” of
the Code of Ordinances of the City of College Station, Texas, regarding multi-family parkland dedication.

Background:
Per direction from the Audit Committee, the Office of the City Internal Auditor conducted a
performance audit of the City’s parkland dedication program with the intent of analyzing the
effectiveness of the program and providing feedback for potential improvement. With audit fieldwork
occurring from October 2018 through January 2019, the resulting report identified several possible
modifications to the parkland dedication ordinance in an effort to reduce complexities in the program.
The findings of the report were presented to the City Council in March 2019, who subsequently
recommended that staff proceed with the simplification of the ordinance and present the information
to the Parks Board for further direction.
Included in the audit report is the recommendation that staff modify the parkland dedication ordinance
so that land dedication requirements for multifamily developments are proportional to the fee-in-lieu
dedication. Per the audit report, a cost neutral conversion that results in a multi-family land dedication
requirement proportional to the fee-in-lieu of dedication may be achieved by amending the multi-family
land dedication requirements from one acre per 49 bedrooms to one acre per 278 bedrooms for
Neighborhood Parks and from one acre per 53 bedrooms to one acre per 305 bedrooms for Community
Parks. The Parks Board heard this item at their July 9th meeting and recommended approval.
