COMMISSIONERS PRESENT: Chairman Rife, Commissioners Horl n, Mooney, Warren, Floyd,
and Parker.
COMMISSIONERS ABSENT: Commissioner Kaiser.
COUNCIL MEMBERS PRESENT: Council Member Malon y.

AGENDA ITEM No. 1: Discussion of Conditional Use Permits.
Assistant City Attorney Ladd explained that she and Assistant City Attorney Nemcik were present at
this workshop to primarily answer question the Commissioners may have resulting from the February 3,
000 discussion of Conditional Use Permits. Ms. Nemcik and Ms. Ladd expressed that conditional use
permits were fact sensitive. They said that burden on the applicant should be avoided if the applicant is
reapplying for the use permit. Ms. Ladd said that Texas has enacted the Religious Freedom Act
patterned after the Federal Religious Freedom Restoration Act. Ms. Ladd explained that there was a
"substantially burden" test. This should be considered especially during consideration of a churches so
that there are no conditions or restrictions placed on a place of worship that would substantially burden
the right to worship.
Ms. Nemcik suggested that, if needed, there could be a semi- annual workshop meeting held with Legal
staff to address questions and concerns from the Commissioners.

AGENDA ITEM NO. : Subcommittee updates.
Commissioners Parker, Warren and Chairman Rife met with Director of Development Services
Callaway and Senior Planner McCully regarding the Highway 30160 special area study. They are
working on scheduling a public hearing. They have decided to expand the notification area to include
the residents n Highway 30.
The Wolf Pen Creep Subcommittee will meet on March 3, 2000.

Commissioner Parker moved to adjourn the workshop meeting of the Planning and Zoning Commission.
Commissioner Hrin seconded the motion, which passed unopposed 6-0.
