COMMISSIONERS PRESENT: Chairman Hawthorne and Commissioners Lightfoot„ Smith, Garner, Gribou and Lane. COMMISSIONERS ABSENT: Commissioner Hall. STAFF PRESENT: Senior Planner Kuenzel, Development Coordinator Volk and Planning Technician Thomas. AGENDA ITEM NO. 1: Public henrirrg to consider a conditional use permit request to allow the • expansion of the existing Sidepockets nightclub located at 700 University Drive East, Suite 111 in the southeast corner of The Village Shopping Center. (96-706) Senior Planner Kuenzel presented the staff report and stated that there are no site changes proposed, therefore there was no requirement for additional site plan review. The location was originally approved in April 1992, when a dance club requested a use permit. However, the use was never established in this location and several months later, the applicant requested use of the same lease space for the pool hall. Due to the fact that a use permit was already in place and had not expired, the applicant was not required to pursue a use permit at that time. At this point, parking is not a concern because the center complies with Zoning Ordinance requirements of one space for every 200 square feet. This requirement assumes that up to 25% of any shopping center may be used for intense uses such as restaurants, theaters and nightclubs. Staff sees no conflict between the proposed use- and the abutting fourplexes because the distance to those dwellings is substantial and there is a row of buildings between this lease space and the residential lots. There have been no complaints from the area residents and no responses received from the thirty-three notices mailed to surrounding property owners. Chairman Hawthorne opened the public hearing. Applicant Arthur Arranaga approached the Commission and stated that the proposed expansion will include twenty-two televisions, two of which are big screen televisions, to watch various sporting events. Karoke will be allowed twice a month but it will be no louder than the existing juke box. The expansion will seat approximately 135 people and the hours of operation should not change except for opening earlier so that the public can view games that begin at noon. Chairman Hawthorne closed the public hearing, • Commissioner Gribou moved to approve the conditional use permit request to allow the Sidepockets expansion of approximately 3800 square feet in The Village Shopping Center. Commissioner Lane seconded the motion which passed unopposed (6 - 0). AGENDA ITEM NO. 2: Other business. • There was no other business. AGENDA ITEM NU. 3: Adjourn. Commissioner Gribou moved to adjourn the meeting of the Planning and Zoning Commission.
