COMMISSIONERS ABSENT: Commissioner Hall. Smith, Garner, STAFF PRESENT: Assistant Director of Economic & Development Services Callaway, City Planner Kee, Project Engineer McCully, Planning Technician Thomas, Staff Planner Kuenzel and Transportation Planner Hard. AGENDA ITEM NO. 1: The Consent Agenda consists of non-controversial or "housekeeping" items required by law. Items may be removed from the Consent Agenda by any citizen, City staff member, or Commissioner by making such a request prior to a motion and vote on the Consent Agenda. (1.1) Approval of minutes from the meeting of August 4, 1994. (1.2) Consideration of a final plat for the Franklin Estates Subdivision. (94-237) Agenda items l . l and 1.2 were approved by consent. AGENDA ITEM NO. 2: Public hearing to consider a conditional use permit request for the Protutors Tutoring service at 1406 Texas Avenue South in the Redmond Terrace Shopping Center. (94-708) Staff Planner Kuenzel presented the staff report and recommended approval of the conditional use permit request with the condition that actual group tutoring take place after normal business hours and not during 8:00 a.m. - 5:00 p.m. Shopping Centers are designed for a mix of uses that have varying parking requirements and hours of operation. The proposed use should not be detrimental to the existing situation as it is no more intense than other intense uses that are allowed by right in any shopping center. Five surrounding property owners were notified with one inquiry. Chairman Hawthorne opened the public hearing. Applicant Larry Hodges informed the Commission that all group tutoring will be between 6:00 p.m. and 12:00 a.m.. Mr. Hodges stated that he does not object to the proposed limitation on the hours of group tutoring as recommended by staff. Chairman Hawthorne closed the public hearing. • Commissioner Gribou moved to grant a conditional use permit to allow the Protutors Tutoring Service to operate at 1406 Texas Avenue South in the Redmond Terrace Shopping Center with the condition that group tutoring only occur after normal business hours, (not between 8:00 a.m. and 5:00 p.m.). Commissioner Smith seconded the motion which passed unopposed (6 - 0). AGENDA ITEM NO. 3: Consideration of a driveway variance request for lot 1, block 17 of the Southwood Valley Section SB Subdivision. (94-804) • This item was removed from the agenda at the request of the applicant. AGENDA ITEM NO. 4: Consideration of a driveway variance request for lots 5A and SB, block 2 of the Woodway Village Subdivision. (94-805) Transportation Planner Hard presented the staff report and recommended denial of the proposed variance request for the following reasons: (1) This tract is part of a larger R-3 development platted with a 20' alley in the rear for the sole purpose that access not be allowed on Holleman since it is a minor arterial. The 20' alley provides for adequate access to the on-site parking provided for in the rear of the property. (2) It is not the intended function of Holleman, as a minor arterial, to provide access for low density residential development. (3) While this one driveway would obviously not create a traffic problem on Holleman, approving this request would set a precedent for the twelve remaining duplexes. (4) The Commission may authorize a variance to the driveway ordinance when a strict enforcement of the ordinance would result in an unnecessary hardship. Staff feels that denying a secondary access to this property would not result in an unnecessary hardship and that approving it could be contrary to the public interest due to the potential for the twelve additional curb cuts on Holleman. Commissioner Gribou moved to deny the driveway variance request for lots SA and SB, block 2 of the Woodway Village Section I Subdivision. Commissioner Lane seconded the motion which passed unopposed (6 - 0). AGENDA ITEM NO. 5: Other business. In response to traffic concerns expressed during the proposed Furrow's expansion project, Transportation Planner Hard informed the Commission that staff and the highway department are aware of the traffic situation at the intersection of Highways 6 and 30 including the entrance to the Windwood Subdivision. At one time the state had plans to add a right turn lane from Highway 30 to the Windwood Subdivision; however, that project did not rank high enough to get the necessary funding. Since that time, the state has changed the operation of the existing signal and created two turning lanes from Highway 30 onto the Highway 6 Frontage Road allowing only one lane to be carried through the intersection instead of two. AGENDA ITEM NO. G: Adjourn. Commissioner Lightfoot moved to adjourn the meeting of the Planning and Zoning Commission.
