MEMBERS PRESENT: Chairman Hawthorne, Commissioners Mariott, Smith, Lane, Hall, Gribou and Herring. MEMBERS ABSENT: None. AGENDA ITEM NO. 1: Approval of minutes from the meeting of November 4, 1993. Commissioner Herring moved to approve the minutes from the meeting of November 4, 1993 as written. Commissioner Mariott seconded the motion which passed unopposed (6 - 0); Commissioner Lane was not present during the approval of minutes. AGENDA ITEM NO. 2: Public hearing to consider a rezoning request of 2.37 acres with frontage along Lincoln Street, adjacent and to the south of Cedar Creek Condominiums from R-lA Single Family Residential to R-2 Duplexes. (93-112) Staff Planner Kuenzel presented the staff report and recommended approval of the proposed rezoning. The comprehensive plan rellects this tract as low density residential with surrounding areas reflected as low density residential, medium density residential and business commercial. According to development policies, areas planned for low density residential will predominantly consist of single family housing and the overall density should not exceed six units per acre. The R-2 district allows up to twelve units per acre and duplexes are more typically classified in the City's policies as medium density residential housing which allows densities up to fourteen to sixteen units per acre. The tract being considered for rezoning is adjacent to the vacant Bert Wheeler property that is reflected as C-B business commercial, although currently zoned R-1 single family, and adjacent to the Cedar Creelc Condominiums which are zoned and developed as R-4 apartments. Development as duplexes on the proposed tract would not conflict with these surrounding proposed and future land uses. Although the plan specifically shows low density residential along Lincoln Street, this request is not mcompattble with that intent or with existing develol~~ment. Utility and street infrastructure is adequate to handle the proposed increase from ten dwelling units per acre to twelve units per acre. Staff Planner Kuenzel informed the Commission that there was an error in the original notices mailed to the surrounding property owners. The applicant has requested that the Planning and Zoning Commission and City Council consider the request due to a pending sale of the property. In order to ratify the decision of the Commission and Council, this request will come back before the two bodies for further consideration. Four responses were received to the notices, all in opposition to the rezoning request. Concerns expressed center mainly on traffic issues. Chairman Hawthorne opened the public hearing. Don Jones of 3201 Forestwood in Bryan approached the Commission and explained that he is a local broker involved with the subject property. Mr. Jones stated that there were two main points to consider when looking at the subject site. One, there have been concerns expressed pertaining to the increased intensrty of the proposed rezoning from R-lA to R-2; however, with the proposed R-2 zoning, there will be a total of eight duplexes built on the site with a total of sixteen living units. With the current R-lA zoning, there could be townhome units built with a total of seventeen living units. A second concern expressed is that the duplexes will encourage non owner occupied housing. The existing townhome development west of this site along Lincoln Avenue that is currently zoned R-lA, has three owner occupied units and fourteen non owner occupied units. The proposed duplexes for the subject site will be similar to the units being built in the Eastmark Subdivision near Wolf Pen Creek. They will be approximately 2200 square feet with three bedrooms and two baths on each side. Roy Hammons of 1700 Kyle in College Station approached the Commission and explained that he is the project engineer for the proposed development. With the depth of the subject lots, there is more land than you would normally need to for duplex lots. The developer is proposing to increase the front setbacks to 2~' instead of the requ-red 15' to allow more open space. An alley is proposed to enter and exit at two locations off of Lincoln Avenue to provide circulation through the site at the rear of the duplexes and all parking will also be contained in the rear of the lots. The developer would like to build an upscale, quality duplex development on the subject site. Stephen Miller of )06 Munson approached the Commission and explained that he owns the three lots at the southwest corner of Lincoln Avenue and Munson with approximately 360' of frontage along Lincoln. Mr. Miller expressed concern that the proposed "upscale" development will negatively effect the area and degrade the overall neighborhood. The profit of the developer for the subject property is very small when you look at the overall degradation that it would cause throughout the neighborhood. Mr. Miller stated that when he bought his home, he understood that single family homes would be built at the subject site and now with the proposed multi-family development and the proposed GB Commercial zoning for the adjacent Bert Wheeler property, the surrounding neighborhood will become a "ghetto" area. Since three bedroom and two bathroom duplexes are proposed, this will encourage more students to share rooms in order to make the rent payments. Mr. Miller explained that he did not agree with staff that Lincohi Avenue is an effective buffer. If the City allows this rezoning and begins the degradation in the neighborhood, how far will it continue down Lincoln and Munson Avenues? The existing townhomes along Lincoln are more of an "upscale" development and do not have a high turnover rate like the proposed duplexes would. Oran Nicks, the owner of the property located at the southeast corner of Lincoln and Munson stated that he is not opposed to the proposed development because he has had time to talk to the developer and see what is exactly proposed for that location. However, he is concerned with other possible rezonings in the area that may negatively effect his property values. It is not likely that single family homes will be built on the subject property and considering the current market and demand for housing, the proposed duplex development could be beneficial to the neighborhood. However, zoning should not be handled in a piecemeal approach and the entire neighborhood should be examined to determine a plan for the area. With the proposed signalization at Lincoln and University Drive, Lincoln will become a major access way to the Texas A & M campus and with that -n mind, we should look at this corridor and see that it adequately effects the high quality of life in our city. Chairman Hawthorne closed the public hearing. Commissioner Hall moved to recommend approval of the proposed rezoning request of 2.37 acres with frontage along Lincoln Street, adjacent and to the south of the Cedar Creek Condominiums from R-lA single family residential to R-2 duplexes. P & Z Minutes Drcrmber 2, 1993 Page 2 Chairman Hawthorne explained that anytime you have a situation where multi-family development abuts single family development, there are concerns with property values, traffic and aesthetic issues. However, ~n a growing population, these situations will occur more and more. In looking at the subject site, including the surrounding neighborhood, the proposed zone change does not have a big impact. Chairman Hawthorne stated that he understood Mr. Miller's concerns about the degradation of the surrounding area; however, he does not feel that the proposed rezoning will degrade the neighborhood. Commissioner Hall stated that possibly conditions could be placed on the zoning to help buffer some of the negative aspects associated with duplex development. Commissioner Hall moved to amend his original motion to recommend approval of the rezoning to require limited access to Lincoln Avenue and rear parking in order to help maintain the current quality of life in the area. Commissioner Gribou seconded the amendment which passed unopposed (7 - 0). The motion to recommend approval as amended passed unopposed (7 - 0). AGENDA ITEM NO. 3: Public hearing to consider a rezoning request of 13.65 acres with frontage along Dartmouth near the intersection of Colgate Street from R-2 Duplexes to R-5 Medium Density Apartments. (93-113) Staff Planner Kuenzel presented the staff rc l~~ort and recommend approval of the proposed rezoning with the condition that a buffer be installed to buffer the single family homes to the south from the proposed development In the mid 1950'x, a rezoning was approved for this property for a planned unit development This was to facilitate a high density fraternity project. The zoning was conditioned upon the project coming to fruition within a certain time period, which it never did. The zoning then reverted back to the current R-2 classification. With this previous rezoning there has been some precedent set for some increase in density in this immediate area. There is no conflict with the proposed R-5 zoning and surrounding land uses in the general area. The proposed zoning also generally complies with the comprehensive • plan for the area. Any residential rezoning which would increase the density should be conditioned upon a requirement for buffering the adjacent single family lots to the south from development on this tract Forty surrounding property owners were notched of the request with ten persons voicing opposition to the proposed rezoning. Chairman Hawthorne opened the public hearing. Representative of the owner, Greg Taggart of Municipal Development Group approached the Commission to give a brief overview of the proposed project. Mr. Taggart presented renderings of the proposed "Wolfpen Village" project. He informed the Commission that through various marketing studies, the developer has found that there is a need for high quality apartment housing which targets young professionals, families, professors, etc. instead of students. The current R-2 zoning on the property is not viable at the present time. Given the shape of the tract and current zoning, if developed in accordance with the R-2 zoning, it would be similar to the individually owned multi-family units along Manuel Drive. The proposed apartments would be an asset to the neighborhood and would be maintained more efficiently and more aesthetically pleasing in comparison to the individually owned duplexes in the area. Mr. Taggart stated that he understood the concerns of the adjacent single family property owners; however, the proposed development is much more appealing and would not devalue the surrounding properties. In working with staff, the developer and staff have determined that the proposed request is in compliance with the comprehensive land use plan. A representative of the Troy Group, Barry Gillingwater, the proposed developer of the property, approached the Commission and l~~resented slides of various projects done by this group throughout Texas. He showed the detail of each project and the high level of maintenance for new and older projects. Mr. Gillingwater explained that all of the projects are developed "inward" and away from the property line with buffer areas and access drives. All activity will occur within the center of the property. The developer is willing to provide additional buffers in addition to the privacy fence. P ~~ Z Minute. December 2, 1993 Page _3 Mr. Gillingwater stated that every living unit will have security alarms and be sprinklered for fire protection. There will be a gate controlled access into the site. There are proposed only twenty-tour three bedroom units only because of the need in the market for families, not to encourage multiple tenants. Rent will be approximately $.83 per square foot or, a one bedroom will rent for approximately $800 per month. A total of 260 units is proposed. Mr. Gillingwater stated that the proposed project is not designed to target the student market and feels that it will fit in with the surrounding land uses. He explained that he wants to work with the surrounding property owners and be a good neighbor. The following persons voiced their approval of the proposed rezoning request: Mary Lind Bryan -Real Estate I3rol<er of the property; and, David Lewis -Owner of subject pro~~erty. Both persons expressed that the property is difficult in that it is oddly shaped with various zoning districts. With individually developed and owned duplexes and fourplexes there is no uniformity in the area. With one project under one management, there will be a higher level of maintenance and one entity to contact if there are any problems. The proposed complex would improve the overall qual-ty of the neighborhood rather than lower property values and help eliminate trash and noise normally associated with duplexes and fourplexes. The following persons spoke in opposition to the rezoning request: Robert Horton of 230? Auburn Circle; Jerome Loving of 2305 Auburn Circle; Frances Satchell of ?304 Auburn Circle; Scott Sigle of 40I Princeton; Donald Little of X03 Princeton; Jim Gardner of 12].6 N Ridgefield Circle; Perry Sellers of 407 Princeton; Laurel Riesch of 405 Princeton; Jamey Vogel of 2300 Auburn Court; Steve Johnson of 405 Princeton; Dick Brother, speaking for owner of 400 Princeton Court; and, Paul Clarke of Clarke & Wyndham Realty. The following concerns were expressed in opposition to the rezoning request: ( 1) Luxury apartments do not exist in College Station because there is not a demand for them and the proposed complex will eventually become student housing. The higher rent will not deter students from living in this facility. ( 2) The existing R-2 zoning is a much better transition zone from R-4 to R-1. The proposed R-5 zoning doubles the density currently allowed in the R-2 zone. ( 3) In the proposed R-5 zone there will be more traffic, noise and a higher tenant turnover. There is currently a traffic problem along Dartmouth especially during peak hours. With the addition of the apartment complex in the area, rt would be difficult to cross Dartmouth at any tu»e of the day. This project is located along a hill on Dartmouth that ~~~ould make any ingress and egress extremely difficult and dangerous. ( 4) Any buffering that the applicant proposes cannot buffer an apartment complex of this magn-tude especially since three story buildings are proposed. The buffering will not help with the loud noise or trash associated with student housing. There will also be a decrease in privacy due to the proposed three story units. If it is true that There is more trash associated w-th the existing duplexes and fourplexes in the area, then more active code enforcement should be done instead of a rezoning. P & Z Minutes December 2, 1993 Page 4 ( 5) The proposed request is not in compliance with the comprehensive plan and the City should enforce and not vary from the current plan. A zoning district that allows 24 dwelling units per acre is not medium density but high density and therefore does not comply with the comprehensive plan. ( 6) Concerned about the overall drainage in the area with the development of a complex of this size. ( 7) Many of the surrounding property owners recently purchased their homes with the understanding that the subject tract was to be developed as duplexes. ( 8) Concerned with the decrease in property values and the overall quality of life in the area. ( 9) Concerned with security of the existing single family homes. (10) The existing R-2 zoning is a viable option in this neighborhood. There are currently duplexes being built across the street from the subject property in the Eastmark Subdivision. Chairman Hawthorne closed the public hearing Commissioner Hall moved to recommend denial of the proposed rezoning request of 13.65 acres with frontage along D~irtmouth near the intersection of Colgate Street from R-2 duplexes to R-5 medium density apartments. Commissioner Herring seconded the motion. Commissioner Hall stated that there will continue to be increased traffic along Dartmouth since it is intended to relieve traffic from Texas Avenue. With the development of the Wolf Pen Creek park, there will be even more traffic in the area. Commissioner Hall stated that he believes the developer in that there is a market for luxury apartments based on the fact that they are willing to invest eight to ten million doll~~irs in building them. The argument that apartments are more aesthetically pleasing than duplexes and fourplexes is not necessarily true based on the fact that there are several examples all over town in which that would not apply. Commission Hall stated that his main concern is with the intensity of the request. Commissioner Gribou agreed and stated that the project is out of scale with the surrounding neighborhood. He stated that he is not necessarily opposed to this particular project but the scale is too large to fit in with the surrounding single family homes. Chairman Hawthorne explained that there will be traffic and noise problems associated with any project built on the vacant subject lot. However, he will vote in favor to deny the rezoning request based upon the fact that the integrity of the comprehensive plan should be maintained. The Commission voted unanimously to deny the rezoning request, (7 - U). AGENDA ITEM NO. 4: Consideration of a temporary parlflng lot to be located between 130 Meadowland and Hampton Inn for overflow parlflng for the University Tower complex (93- 505) Staff Planner Kuenzel stated that the Zoning Ordinance provides for temporary overt7ow parking areas where the existing lot meets all current requirements but it ~s found that additional parking is needed. The Commission has the discretion to grant such permission for up to one year when all applicable stand~lyds are met. At the end of the twelve month period, the site must either come up to code or be returned to its original state. P c~~ Z Minutes December Z, 1993 Page S Applicant Mark Williams approached the Commission and stated that the overflow parking is not for the University Tower complex but for the existing fifteen fourplexes located along Meadowland Street. These units are part of their dorm leasing program and their visitors currently park on Meadowland Street. The owner would like to install a temporary parking lot to see if it would alleviate the problem along Meadowland Street. If it does, the owner will go to the expense of paving the lot and meeting all ordinance requirements. Commissioner Herring moved to allow a temporary parking lot to be located between 130 Meadowland and Hampton Inn for overflow parking. Commissioner Lane seconded the motion which passed unopposed (7 - 0). AGENDA ITEM NO. 5: Consideration of a final plat of the Henton Subdivision. (93-242) Due to the late hour oi' the Commission meeting, City Engineer David Pullen presented agenda items five through nine together and offered to answer any questions. Commissioner Marion moved to recommend approval of the final plat of the Henton Subdivision with staff recommendations. Commissioner Lane seconded the motion which passed unopposed (7 - 0). AGENDA ITEM NO. 6: Consideration of a final plat of the Edelweiss Estates Phase Three Subdivision. (93-240) Commissioner Gribou moved to recommend approval of the final plat of the Edelweiss Estates Phase Three Subdivision with staff recommendations. Commissioner Smith seconded the motion which passed unopposed (7 - O). AGENDA ITEM NO. 7: Consideration of a final plat of the Lodgeco Subdivision. (93-243) Commissioner Gribou moved to recommend approval of the final plat of the Lodgeco Subdivision with the comments in the Presubmission Conference report. Commissioner Herring seconded the motion which passed unopposed (7 - 0). AGENDA ITEM NO. 8: Consideration of a final E.T.J. plat of the Westminster Subdivision Phase One. (93-244) Commissioner Herring moved to recommend approval of the final E.T.J. plat of the Westminster Subdivision Phase One as presented. Commissioner Gribou seconded the motion which passed unopposed (7 - 0). AGENDA ITEM NO. 9: Consideration of a preliminary E.T.J. plat of the Estates at River Run. (93-313) Commissioner Gribou moved to recommend approval of the master plan and preliminary E.T.J. plat of the Estates at River Run at presented. Commissioner Herring seconded the motion which passed unopposed. AGENDA ITEM NO. 10: Presentation and discussion of the proposed changes to the Thoroughfare Plan. Transportation Planner Hard informed the Commission that staff is still in the preliminary stages of working on numerous amendments to the thoroughfare plan for street widenings and extensions as well as a major revision to the plan covering developing areas to the south. In addition, staff is also looking into changes to the subdivision regulations as they relate to street design and the thoroughfare plan. Transportation Planner Hard presented various amendments to the plan. P R~ Z Min~~tcs December 2, 7>93 Page 6 Commissioner Hall stated that we should look at the impact of the George Bush Library and the traffic that it will generate each year. The Bird Pond Road alternative seems more viable in that we already have right-of-way in this area and it could be upgraded and alleviate congestion from the city. Commissioner Hall stated that he is concerned with funnelling traffic to the entrance of Pebble Creek and encouraging more traffic into a single family subdivision with no exit. Commissioner Gribou stated that he preferred to see minor arterials that did not replicate major arterials. He expressed concern ~~~ith the discontinuity of the minor arterials and a higher intense turning into a lower intense street. AGENDA ITEM NO. 11: Other business. There was no other business.
