Project Engineer Keating.
AGENDA ITEM NO. 1: Approval of minutes from the meeting of November 19, 1992.
Commissioner Hall moved to approve the minutes from the meeting of November 19, 1992 as written.
Commissioner Mariott seconded the motion which passed unopposed (5 - 0). (Commissioner Herring was not
present for the approval of minutes.)
AGENDA ITEM NO. 2: Consideration of a final amending plat of the Timber Ridge Subdivision. (92-
222)
City Engineer Pullen presented the staff report. Due to the nature of the plat, a presubmission conference
was not held. All reviewing agencies were contacted and there were no problems identified. An amending
plat of the same area, excluding lot 4, was approved by City Council in June of 1992. The applicant has since
acquired lot 4 and is platting the lot sizes more evenly.
Commissioner Mariott moved to recommend approval of the final amending plat of the Timber Ridge
Subdivision. Commissioner Lane seconded the motion which passed unopposed (5 - 0). (Commissioner
Herring was not present during consideration of this item.)
AGENDA ITEM NO. 3: Consideration of a preliminary plat of the Oakbrook Valley Subdivision located
on the north side of Deacon, approximately 450' east of Wellborn Road. (92-310)
Senior Planner Kee presented the staff report and recommended approval of the preliminary plat with the
recommendation that open channel drainage not be allowed. The applicant is proposing single family lots;
however, the property is zoned R-5 and the lot size will allow for duplex and possibly fourplex development
under the current zoning. The applicant has been advised of this and may seek a zone change to single family
and/or deal with this through deed restriction. There are two sections of the Subdivision Regulations aimed at
generally avoiding double frontage lots and right angle lots. In this particular case the applicant has indicated
that the lot depths would be excessive if Heatherwood Lane were to be deleted. Staff has no problem with
this layout. The detention pond shown on lots 23 and 24, and the drainage easement at the rear of lots 11
through 22 will be maintained by individual lot owners as indicated in the covenants and restrictions for
Oakbrook Valley.
• Representative of the applicant Don Garrett approached the Commission and stated that the developer
intends to extend the same type of fencing that is currently along Deacon across this development. He
requested that surface drainage be allowed to drain into the detention area to the rear of the development.
The surface drainage area would not be deeper than 2' and would be maintained by the homeowners
association. The existing channel located behind the adjacent Southwood Valley development is sized to carry
the water from this area. If drainage is facilitated by underground pipe, off-site easements would have to be
obtained as well as 1000' of pipe to transport the water to Wellborn Road. The developer will request
rezoning of the property to R-1 single family residential.
City Engineer Pullen explained that staff recommended against open channel drainage because of the difficulty
in accessing the area for maintenance.
Applicant Duayne Faltycek approached the Commission and stated that he is currently constructing homes
along Aztec and there is often water standing along the rear of these lots. The best solution would be a
concrete ditch with a fence immediately next to it. Agate could be installed for maintenance accessibility.
The privacy fences would be placed above the ground enough so that water will be allowed to drain under the
fence. Mr. Faltycek concluded that sidewalks will be installed along the both sides of streets.
Commissioner Mariott stated that these lots are bigger than the ones along Durango and Cortez. He added
that he does not have a problem with the proposed open channel drainage; all of the Southwood Valley area
uses open channel drainage. Commissioner Mariott moved to recommend approval of the preliminary plat of
the Oakbrook Valley Subdivision without the recommendation made by staff to not allow open channel
drainage. Commissioner Smith seconded the motion.
Commissioner Hall stated that he would like to make sure that the existing fencing is continued along Deacon.
He expressed concern of allowing this developer to use open channel drainage when the Commission has
denied this type of drainage with previous developments. The City cannot assure that the fences will be
installed in the right places to allow adequate drainage. There is also no assurance that access can be
obtained if the City has to maintain the channel. If the Commission allows open channel drainage for this
development, a precedence may be set. If staff and the developer can agree on a solution and staff feels
comfortable allowing open channel drainage, he would feel more comfortable.
Engineer Earl Havel approached the Commission and stated that there are easements in addition to the rear
50' detention area to cover the drainage areas and allow access for maintenance.
The motion to recommend approval of the preliminary plat of the Oakbrook Valley Subdivision without the
staff recommendation to not allow open channel drainage failed (2 - 4); Commissioners Mariott and Herring
voted in favor of the motion.

Commissioner Mariott moved to adjourn the meeting of the Planning and Zoning Commission. Commissioner
Smith seconded the motion which passed unopposed (6 - 0).
