January 17, 1991 MEMBERS PRESENT: Chairperson Sawtelle, Members Colson, Hall, Michel, and Esmond. MEMBERS ABSENT: Vice Chairperson Dresser and Member Gentry. STAFF PRESENT: Senior Planner Kee, Sr. Asst. City Attorney Bailey-Graham, Planning Technician Thomas, Development Review Coordinator Volk, Asst. to City Engineer Morgan, City Engineer Pullen. AGENDA ITEM NO. 1: Approval of Minutes - meeting January 3. Mr. Colson moved to approve the minutes of the meeting on January 3, 1991. Mr. Michel seconded the motion which passed unopposed (5-0). AGENDA ITEM NO. 2: Public Hearing to consider a Conditional Use Permit request for a home day care at 3000 Cochise Court. Applicant is Beth Rnight. (90-700) This item was rescheduled to be considered at the next meeting of the P&Z Commission on Thursday, February 7, 1991. AGENDA ITEM NO. 3: Preliminary Plat - Woodcreek Phases Four and Five. Section Four fronts on both sides of Woodcreek Drive beginning about 600' northwest of SH 6 and ending 1400' northwest. Section Five abuts Section Four to the north. Applicant is Buchanan Soil Mechanics. (90-302j Senior Planner Kee presented the staff report recommending approval with conditions outlined in the Presubmission Conference Report specifically: Brookwater is required to be a 39' pavement in a 50' ROW due to the number of lots fronting it, Additional access to Rock Prairie should be coordinated at the time of final platting, A general note on the plat should indicate that drainage channels are in utility easements but will not be maintained by the City. • Ms. Kee added that the Thoroughfare Plan shows no collectors or arterials in Sections Four or Five. It should be noted that the connection of Woodcreek Drive to Faulkner in the Foxfire subdivision and Stone Bridge to Rock Prairie and Foxfire Drive will provide the opportunity for better access to and from this subdivision. It will also provide the opportunity for thru traffic to • volume streets. These streets have been made wider future demand for traffic in the subdivision. As around this subdivison, it is anticipated Bridge/Woodcreek Drive intersection will eventually for a four way stop. Sidewalks are not required however; P&Z has discretion to require sidewalks on use these now low to accommodate the the area develops that the Stone meet the warrants by the Ordinance, 50' rights-of-way. Fain McDougal of TAC Realty approached the Commission and asked that Brookwater be allowed to be a 28' wide pavement instead of the requested 39' wide pavement. He understood the 28' wide pavement to be agreeable with staff in the Presubmission Conference Meeting on May 23, 1990; but then, on December 19, 1990 staff recommended the 39' wide pavement due to the number or lots fronting Brookwater. Mr. McDougal agreed to install sidewalks along the south side of Brookwater. City Engineer Pullen stated that as an operational policy, a 39' wide pavement is recommended for streets with more than 52 fronting lots. The 39' wide street is preferred for longer distances and works as a "collector street". In the Presubmission Conference on May 23, rights-of-ways were discussed with the assumption of the use of 39' wide streets. If a 28' wide street is used, the residents in the cul- de-sacs, as well as residents along Brookwater, will suffer. On the other hand, a 39' wide street tends to increase the speed of traffic. John Peters of Buchanan Soil Mechanics approached the Commission requesting 28' wide pavement along Brookwater. The understanding at the initial Presubmission Conference Meeting was that all streets, except extentions, have 28' wide pavement. The 52 lot standard is not published and is not required by the Zoning Ordinance or Subdivision Regulations. Mr. Peters added that the policy was not fair and would place a financial burden on the applicant. Mr. Colson suggested the installation of sidewalks and the use of 39' wide pavement along Brookwater due to the length and lot density along the street. Mr. Esmond agreed that sidewalks should be installed; however, favors a 28' wide street to control speed. He moved to approve the Preliminary Plat of Woodcreek Phases Four and Five with the following provisions: (1) sidewalks be installed along one side of Brookwater, (2) additional access to Rock Prairie should be coordinated at the time of final platting, (3) a general note on the plat should indicate that drainage channels are in utility easements but will not be maintained by the City, (4) Brookwater have 28' wide pavement. Mr. Michel seconded the motion which passed 4 - 1. (Chairperson Sawtelle voted in opposition of the item.) r • • AGENDA ITEM NO. 4: Consideration of a CN zoning on lot 2, block A of Culpepper Plaza Subdivision. Senior Planner Kee presented the request of City Council to reconsider the rezoning request from R-6 Apartment High Density to CN Commercial Neighborhood. If CN zoning is granted, a Conditional Use Permit will be required prior to development. Roy Hammons, representative of the owner J. C. Culpepper, approached the Commission and stated that CN zoning would be suitable for the site and neighboring residents have no objection to the zone change. A-P zoning would not be appropriate due to the restriction and exclusion of certain uses. Chairperson Sawtelle and Members Michel and Hall agreed that A-P zoning is preferred; however, CN zoning would be acceptable. Members Esmond and Colson supported the proposed CN zoning. AGENDA ITEM NO. 5: Other business. Mr. Colson questioned staff as to the status of the HEB project. He heard from an HEB employee that the project was cancelled due to the uncooperativeness of City staff and the P&Z Commission. Mr. Roy Hammons, HEB's representative, informed the Commission that a replat of Kapchinski Hill Subdivision would be filed the next week and the HEB company is proceeding with the project. He stated that he has heard no negative comments in regard to City staff, the Zoning Board of Adjustments, or the Planning and Zoning Commission. Mr. Michel expressed concern of the operational policies used in determining residential street width requirements not being published. Mr. Colson agreed and suggested these policies be included in the Subdivison Regulations. Development Review Coordinator Volk suggested the use of written handouts given to the applicant at the time of application or during the Presubmission Conference. City Engineer Pullen stated that these operational policies were in the process of being revised and published. AGENDA ITEM NO. 6: Adjourn. Mr. Colson moved to adjourn the meeting of the Planning and Zoning Commission. Mr. Esmond seconded the motion which passed unopposed. AP .
