MEMBERS PRESENT: Vice Chairman MacGilvray, Members Dresser, Wendler, and Paulson MEMBERS ABSENT: Chairman Kaiser, Members Brochu and Stallings STAFF PRESENT: Assistant Director of Planning Callaway, City Engineer Pullen and Planning Technician Volk AGENDA ITEM N0. 1: Approval of Minutes - meeting of September 5, 1985. Mr. Wendler made a motion to approve the minutes as presented; Mr. Paulson seconded the motion which carried unanimously (4-0). AGENDA ITEM N0. 2: Hear Visitors. No one spoke. AGENDA ITEM N0. 3: 85-712: A public hearing on the question of granting a Conditional Use Permit for a church to be located on 3.41 acres (Tract A Block 55 Southwood Valley Section 24A) at the • northwest corner of the intersection of the proposed extensions of Welsh and Deacon. Applicant is Marion 0. Lawrence, Jr. for The Corporation of the Presiding Bishop of the Churh of Jesus Christ of Latter-Day Saints. Mr. Callaway explained this request, pointed out that the subject tract and the adjacent tracts are vacant, but will be developing as single family residential. He further explained that the Land Use Plan reflects this area as medium and low density residential, with the zoning being R-1. He reminded the Commissioners that Conditional Use Permits are granted by the Commission when certain criteria are met and then read from the ordinance the section referring to those criteria. He pointed out that the site plan included with this application, although it has been reviewed and is accompanied by P.R.C. recommendations, is a conceptual plan, and a finalized site plan (which must meet the conditions listed) will be presented after approval of the use of this tract for a church. Mr. MacGilvray asked staff if notification had been made to area residents and Mr. Callaway replied in the affirmative. The public hearing was opened. Marion 0. Lawrence, Jr., applicant, came forward to explain the site plan presented has not been developed to the fullest because he wanted Commission approval of the use on this tract before finalizing the plans. Mr. Dresser asked what uses are proposed for this facility and Mr. Lawrence stated there would be no school or daycare, but there would be early morning seminary classes for high school youth 5 days a week, several evening meetings, as well as regular services twice on Sunday. He referred to a letter addressed to the Zoning Official which lists specifically • the meeting schedules. Mr. Dresser asked if additional buildings will be developed on this tract and Mr. Lawrence replied that there are no additions planned far this building, and if the need for additional facilities arise, different facilities 1 PAZ Minutes 9-19-85 will be sought at another location. • No one else spoke. The public hearing was closed. Mr. MacGilvray stated that although this site plan appears to be almost complete, perhaps site plan approval would be premature since complete landscape plans have not been included. Mr. Callaway advised that the applicant is aware of the incompleteness of the landscape plans, and is asking for a conditional use permit for the proposed use of this land on this application. Mr. Paulson stated that he was the P&Z Representative on the P.R.C. when review of this project was held, and in his opinion, this site plan is sufficient for this body to give site plan approval as well as a conditional use permit, and the P.R.G. and staff can handle what is left to be done. Mr. Wendler agreed, stating that if the finalized site plan is approved by the P.R.C. and staff, it would be acceptable. Mr. Lawrence stated that a licensed landscape architect and a licensed irrigator will finalize the plans. Mr. MacGilvray asked the applicant if he would object to site plan approval in addition to a conditional use permit now. Mr. Lawrence indicated that would be quite acceptable. Mr. Paulson said there is even more parking provided than required and he has no objections to both site plan/conditional use permit approval being given at this meeting. Mr. Wendler made a motion to approve this request for a conditional use permit, and to also grant site plan approval subject to a finalized plan meeting all P.R.C. conditions listed, and additionally subject to determination by P.R.C. if the finalized plan must come back before this Commission for further review. Mr. Paulson seconded this motion which carried unanimously {4-0}. • AGENDA ITEM N0. 4: 85-221: Final Plat - Replat of Part of Block G, College Heights Addition & Part of Lot 22, D. A. Smith Subdivision. Mr. Callaway located the land included on this plat, explained this replat consolidates 3 small lots into 2 larger lots, and advised that staff recommends approval as shown as all Presubmission Conference conditions have been met. In answer to a question he explained the zoning on the front of the lots is C--1 and the back is zoned A-P. Mr. Paulson made a motion to approve this plat as shown; Mr. Dresser seconded the motion which carried unanimously (4-0). AGENDA ITEM N0. 5: Other business. Mr. Callaway referred to the memo which lists staff's response to Commission suggestions and Mr. Gardner's suggestions regarding the proposed revised Zoning Ordinance, advising that staff would hope to get final action as soon as possible, but assured the Commission that more workshops could be scheduled if requested. Discussion followed with instructions given to staff to incorporate the changes suggested into the ordinance and to schedule it as an agenda item on the next agenda. Mr. MacGilvray announced that there would be a public meeting held on Friday, September 20 at 2:00 p.m. to discuss the Wellborn Road corridor. 2 PAZ Minutes 9-19-$5 AGENDA ITEM N0. 6: Adjourn. • Mr. Paulson made a motion to adjourn; Mr. Wendler seconded the motion which cap unanimously (4-0).
