Planning and Zoning Commission Meeting
June 5, 1980
7:00 P.M.
MEMBERS PRESENT: Chairman Maher; Commissioners Watson, Sears, Bailey, Hazen,
Gardner, Behling; Council Liaison Boughton.
MEMBERS ABSENT: None

AGENDA ITEM N0. 1 -- Approval of minutes - Meeting;~of May 15, 1980.
Commissioner Bailey noted that on page 2, paragraph 3 the word "tried" had been
misspelled and that in the heading of Item No. 5 "Holleman" should be capitalized.
Commissioner Hazen stated that Item 4 should refer to a "raised median".
Chairman Maher pointed out that his comments in regards to the plat of the regional
mall were contained in paragraph 4, page 6 under Other Business.
• Commissioner Bailey moved that the minutes be approved as amended.
The motion was seconded by Commissioner Sears and unanimously approved.
AGENDA ITEM N0. 2 -- Hear visitors.
No one spoke.
AGENDA ITEM N0. 3 -- A ublic hearin on the uestion of annexin an area of__
approximately 6 0 acres, including the Harvey Hillsides Addition and an area
bounded by the present city limits and the easternmost property line of the
Texas Instruments tract, F.M. 60, F.M. 158 and State Highway 30.
Mr. Mayo presented data showing costs to be incurred by the Gity in installation
of utilities to the area in question and for provision of fire and police pro-
tection and other services. He also showed data indicating revenues to be gained
by the City through sale of utilities and property taxes. A map was presented
showing three alternative annexations: Area A - the property between the Texas
Instruments tract and F.M. 158; Area B - a strip down the south side of Highway
30 and; Area C - the entire Harvey Hillsides Addition.
The public hearing was opened.
• Mr. Gayland Moulder spoke against the annexation questioning the costs to the res-
idents to tie onto city sewer and water lines.

Mr. Norman Beal spoke in opposition to the annexation.
• Mr. Carl Patton stated that he would file suit against the City of College Station
to block any annexation proceedings.
Mr. Richard Hartmann spoke in opposition to the annexation and stated that he
calculated the cost of tying onto the city sewer and water system at between
2500 and 3000 dollars.
M5. Joyce Devaney spoke against the annexation.
Mr. Konrad Eugster suggested that the city could gain adequate control of develop-
ment on Highway 30 by annexation of the strip shown as Area B.
Mr. Richard Hartman stated that the cost to connect to city services would be
higher than stated and that he was opposed to annexation.
Mr. Wilson Dow spoke in opposition to the annexation.
Mr. Larry Wilding spoke against the annexation.
Mr. C. D. Wallstein asked if the city could do anything about the proposed TMPA
power line extension to go through the subdivision.
Councilman Boughton said that the city would not be able to take any action on
this.
• Mr. Bob Kruppa stated that some houses in the subdivision could not be served
with a gravity sewer line and would need lift stations.
Mr. John Chevrrete spoke in opposition to the annexation ..and asked how city ord-
inances would effect persons in the subdivision who kept livestock.
The Commission suggested that these persons would have to obtain a livestock
permit.
Mr. Patton stated that he would be in favor of annexing the strip along Highway
30.
Mr. Jackson stated that he owned a house and lot in the strip called Area B and
he was opposed to the annexation of this area.
Mr. John Hogg asked what the zoning would be if the subdivision were annexed.
Mr. Mayo explained that all annexed property was zoned A-0 at the time of annex-
ation.
Mr. C.H. Vanbavel stated that the Harvey Hillsides Addition had filed a petition
for incorporation with the County in 1969 and that this petition had never been
acted upon. He suggested that this petition made annexation proceedings by the
City of College Station illegal.
• Mr. Mayo pointed out that under state law, Harvey Hillsides would have had to
obtained College Station's permission to incorporate due to the fact that the
subdivision was located in the College Station Extraterritorial Jurisdiction.

• Mr. Jose Montemayor asked what costs his restaurant would incur to hook up to
city services.
The Commission advised Mr.. Montemayor to call Mr. Mayo.
The public hearing was closed and Chairman Maher celled a 5 minute recess.
AGENDA ITEM N0. 4 -- A ublic hearin on the uestion of rezonin a 24.81 acre
tract from A-0 to C- land a 3. 9 acre tract from A-0 to R-3. Both tracts are
located east. of Texas Avenue near the intersection of Texas Avenue and the East
Bypass. The application being in the name of Raintree Joint Venture.
Mr. Mayo presented a map showing proposed major streets in the area of the pro-
posed rezoning. He suggested that the large commercial tract would give the
Commission a strong point from which to argue against strip commercial zoning
on Texas Avenue.
Mr. Ash showed the Commission how sewer service would be extended to the prop-
erty.
The public hearing was opened.
Mr. Joe Ferrari objected to the location of the extension of Rock Prairie Road
• suggesting that the major intersection should be located at the present point
of intersection between Rock Prairie and Texas Avenue. He stated that the
new proposed location of this intersection would hurt the value of his prop-
erty.
Mr. E.W. Shcultz, applicant, stated that the location of this road and the in-
tersection was incidental to the zoning of his property and that it did not
matter whether the road crossed his tract or not. Mr. Schultz explained the
development of the. land in question saying that his organization planned to
build an office-retail complex along the lines of Texas 707.
Mr. Mike Muth, representing the Rock Prairie Baptist Church asked when utilities
would be extended to the Church's property.
The Commission advised Mr. Muth to direct-this question to City Council.
The public hearing was closed.
Commissioner Gardner pointed out that a substansial amount of commercially zoned
property was located near this tract and that the requested rezoning was not in
compliance with the Comprehensive Plan. Mr. Gardner asked Mr. Schultz what changes
had taken place in this area which made the Comprehensive Plan in error.
Mr. Schultz stated that at the time the land was annexed, it was brought into the
City as A-0 and that now the land was ripe for development. He emphasized that
his request was not speculative.
• Commissioner Gardner presented a map showing existing vacant - commercially zoned
property in the City. He pointed out that this represented an abundance of avail-
able commercial property and that zoning this property commercial would be prem-
ature.

Commissioner Behling moved that the Commission recommend approva.h of the requested
rezoning.
Chairman Maher asked for clarification of the effect of the Comprehensive Plan
on a zoning change request. He noted that most rezoning requests, such as the
one now under consideration, were at variance with the Comprehensive Plan. He
asked if it were proper to, in effect, revise the Plan with each rezoning case.
Commissioner Watson said that, if strict compliance with the Plan were demanded,
very few rezoning requests could be approved, or even considered.
Chairman Maher asked if the City Council expected the Commission to strictly
enforce the Plan or to look to the future revision of the Plan in their consid-
eration of rezoning cases.
Councilman Boughton suggested that because of the rapid growth of the City over
the past 7 to 8 years, it had been impossible for the Council and staff to keep
up with constant revisions to the Comprehensive Plan.
Commissioner Behling pointed-out that, if Council decided the request was not
in compliance with the Plan, they could also turn it down.
Commissioner Behling restated his motion that the Commission recommend that Tract
1 be rezoned from A-0 to R-1 and that Tract 2 be rezoned from A-0 to R-3.
• The motion was seconded by Commissioner Watson.
Mr. Mayo pointed out that at the time C-1 zoning was granted for the tracts at
the intersection of Texas Avenue and Rock Prairie Road, The PAZ and the Council
indicated that they felt this area should be zoned commercial. He also stated
that he saw no way that a tract which is 700 feet deep and 1200 feet long a"strip",
and that this was the type of commercial tract the City has been trying to get
because it offered almost unlimited design flexibility.
Commissioner Hazen stated that the entire discussion pointed out the need to add
staff members to the Planning Department so that the City could keep up with
needed revisions to the Comprehensive Plan. She asked that Councilman Boughton
direct this recommendation to the City Council.
Commissioner Gardner stated that the requested rezoning was indeed a "strip"
because it had to be looked at in relation to the rest of the zoning on Texas
Avenue, and as such, was only a continuation of that strip.
The motion to recommend approval of the rezoning was approved with Commissioner
Gardner voting against. Commissioner Gardner pointed out that his no vote should
apply to both tracts in question.
AGENDA ITEM N0. 5 -- A public hearing on the question of rezoning a 4.5 acre tract
on the southwest corner of Dowling Road and F.M. 2154 from Single Family District
R-1 to Administrative/Professional District A-P. The request is in the name of
• Edsel G. Jones.

• Mr. Mayo pointed out the location of the tract and explained that since the large-
est part of the property was out of the-City limits, the rezoning could only apply
to that tract shown on the rezoning request. He advised that the applicant wished
to build a dance studio on the property. He suggested that the A-P zoning would
provide a good buffer between the residential property to the west of the tract
and the industrial property to the east.
The public hearing was opened.
Mr. Edsel Jones, applicant, spoke to explain his proposed project.
The public hearing was closed.
Commissioner Hazen moved that the Commission recommend approval of the requested
rezoning.
The motion was seconded by Commissioner Sears and unanimously approved.
AGENDA ITEM N0. 6 -- A public hearing on the question of rezoning Lot 20 of
the Meadowland Addition from General Commercial Distrcit C-1 to A artment Build in
District R- The application is in the name of Home Finder Realty.
Mr. Mayo explained that Home Finder Realty intended to rezone the remainder of the
• Meadowland Street area for four-plexes and that they had obtained permission from
ABM to gain access to the University Street at the north end of Meadowland. He
suggested that this proposed development would provide a means to improve Meadowland
Street and that the .four-plex zoning would make more sense in the area than the
existing commercial zoning. He also pointed out that the request was in compliance
with the Comprehensive Plan. He showed a group of slides showing the lot in question
and the surrounding area..
The public hearing was opened.
Mrs. Phyllis Hobson, of Home Finder, explained the proposed development.
Mr. Joe Ferrari spoke in favor of the request.
Mrs. Hobson pointed out that their request was to be for R-5 zoning rather than
R-6.
Mrs: Marvin Durrant said that she owned the car wash on Texas Avenue. She asked
what effect the proposed four-plexes would have on her property if she were to
build a restaurant which sold mixed drinks on her property.
The Commission advised Mrs. Durrant that the alcoholic beverage laws wobld only
effect a church or a school and not four-plexes.
The public hearing was closed.
• Commissioner Hazen pointed out that parking could not be .allowed on the street
due to its narrowness.

• Mr. Mayo advised that the Commission should send a recommendation to the City
Manager that Meadowland Street be signed for no parking.
Mr. Stan Whitley, builder of the proposed four-plex, stated that his plan would
include adequate off-street parking.
Commissioner Hazen pointed out that the problem was not resident parking as much
as it was overflow and visitor parking.
Commissioner Bailey moved that the Commission recommend approval of the proposed
rezoning.
The motion was seconded by Commissioner Behling and unanimously approved.
Commissioner Hazen asked that the Commission recommend to the City Manager that
Meadowland Street be signed for no parking.
AGENDA ITEM NO 7 -- Consideration of a final plat - University Industrial Center
Mr. Mayo stated that the final plat was identical to the preliminary but that
the Highway Department had advised him that 20 feet of additional right-of-way
might be needed in the case of future improvement to F.M. 2154.
Commissioner Watson moved that the plat be approved with the provision that 20
feet of right-of-way be added along F.M. 2154.
• The motion was seconded by Commissioner Sears.
Mr. Mark Paulson, project surveyor, said that the County Commissioners had re-
quired a 20 foot access and utility easement on the northeast side of the prop-
erty, and a standard not concerning the County septic tank permit.
The motion to approve the plat was unanimously approved.
AGENDA ITEM N0. 8 -- Consideration of a parking lot plan for the Grapevine

Mr. Mayo pointed out the location of the project.
Commissioner Gardner complimented the applicants for providing trees in the middle
of the parking area.
Commissioner Watson moved that the plan be approved.
The motion was seconded by Commissioner Bailey and unanimously approved.

• Commissioner Hazen suggested that the first two spaces off of Highway 30 be
eliminated.
Mr. Richard Smith suggested that the second space be designated for motorcycles
or for employees.
Commissioner Watson moved that the plan be approved subject to the recommendations
made by Mr. Mayo.
The motion was seconded by Commissioner Sears and unanimously approved.
AGENDA ITEM N0. 10-- Withdrawn from the agenda .
AGENDA ITEM N0. 11 -- Other business.
Commissioner Hazen asked that the Commission take another tour of current pro-
jects and city problems.
Mr. Mayo said he would try to set up such a tour.
Chairman Maher asked Mr. Ash what the status of the future water supply for the
city was in relation to discussions in the Plan 2000 meetings.
Mr. Ash stated that the City currently had a 20 year plan for the water system
• which had been prepared by the City's water and sewer consultant. He suggested
that when the Comprehensive Plan study reached the stage of utility availability,
this consultant be invited to speak to the Commission on the subject.

Commissioner Gardner moved that the meeting be adjourned.
The motion was seconded by Commissioner Sears and unanimously approved.
The meeting was adjourned at 10:00 P.M.
