HomeMy WebLinkAbout11/11/1977 - Minutes - Planning & Zoning Commission MINUTES 1 Planning and Zoning Commission Meeting November 11, 1977 7:00 P.M. 4111 MEMBERS PRESENT: Chairman Stover; Commissioners Bailey, Mathewson, Etter, White, Sweeney, Burke; City Planner Mayo; City Engineer Ash; Community Development Planner Callaway; Planning Assistant Longley; Council Liaison Gardner MEMBERS ABSENT: None VISITORS PRESENT: See guest register Agenda Item No. 1 -- Approval of minutes of meeting of November 3, 1977. Commissioner White moved that the minutes be approved as presented. The motion was seconded by Commissioner Sweeney and unanimously approved. Agenda Item No. 2 -- Hear visitors. No one spoke. Agenda Item No. 3 -- Consideration of a petition requesting the rezoning of areas bounded by F.M. 2818, Wellborn Road, Southwest Parkway and Welsh Avenue to low density residential zones. Mr. Mayo presented a plan showing the final recommendations for rezoning in 41/0 the area in question. He also pointed out that a protest had been received from Dr. 0. D. Butler and that this protest would require that the City Council pass any rezoning plan by a 3/4 majority. Mr. W. E. Benton stated that he was concerned that this plan would put too much more traffic on Welsh Avenue and Southwest Parkway. Mr. Ash pointed out that Southwest Parkway was now operating far below its design capacity and that it would soon be restripped to be four lanes which would further reduce the traffic problem. Mr. Benton asked what type of buffer was to be provided between the property north of Southwest Parkway and the area around Nevada Street. Dr. Stover recommended that the best way to insure a buffer for this neighborhood was through the conditional use process rather than rezoning. Commissioner Mathewson moved that proceedings be instituted to hold a public hearing on the proposed rezoning as presented. The motion was seconded by Commissioner Etter and unanimously approved. Agenda Item No. 4 -- Consideration of a final plat, Woodson Village, Fifth Installment, Section II. Mr. Mayo explained that the Council had asked the Commission to consider this 11, plat in light of the fact that the plat had remained unfiled for four years. Commissioner Stover suggested that Hawthorne Street should not connect to Holleman as it would only worsen the traffic problem at the Holleman, Winding r"-- _II MINUTES, Planning and Zoning Commission Meeting Page 2 November 11, 1977 7:00 P.M. Road intersection. Oro Mr. Ash indicated the approximate location of the flood hazard zone on the property. Commissioner Mathewson moved that the Commission recommend that the plat be denied, subject to the approval of this action by the City Attorney, for the following reasons: 1. The long delay in filing the plat after its original approval. 2. The plat does not comply with the City's flood hazard ordinance passed since the original approval of the plat. 3. Most of the lots on the east half of the property are in the flood hazard zone. 4. The extension of Hawthorne Street to Holleman would only increase traffic problems at the Holleman, Winding Road intersection. The motion was seconded by Commissioner Burke and unanimously approved. Agenda Item No. 5 -- A public hearing on the question of granting a conditional use permit to the A&M Church of Christ for the construction of classroom buildings on their existing facility located at 1001 West Loop South (F.M. 2818) . The public hearing was opened. Mr. J. D. McReady of the Church's Building Committee spoke and answered questions of the Commission. 4110 The public hearing was closed. Commissioner Mathewson moved that the use permit be granted. The motion was seconded by Commissioner Etter and approved with Commissioner Bailey abstaining. Mr. Bailey noted that he abstained because Mr. McReady was his department head. Agenda Item No. 6 -- Consideration of a landscape-parking plan for the Half Century House located at the intersection of Luther Street and Wellborn Road. Mr. William Patch stated that, as requested, the entire parking area would be pabed and curbed. Mr. Stover suggested that since the parking area was to be paved, the wheel stops shown on the plan could be removed. Mr. Patch agreed. Commissioner White moved that the plan be approved. The motion was seconded by Commissioner Bailey and approved with Commissioner Mathewson voting against. Mr. Mathewson stated that he voted against because the north arrow on the plan III was down. Agenda Item No. 7 -- Consideration of a preliminary plat, White Creek located in the Extraterritorial Jurisdiction on F.M. 60, west of F.M. 2818. Mr. Mayo suggested that Welcome Lane should be constructed with a turn-around on J r MINUTES, Planning and Zoning Commission Meeting Page 3 November 11, 1977 7:00 P.M. the south end. 4111 Mrs. Ivey Johnson, the property owner, stated that Welcome Lane would tie into a small county road at its south end. Mr. Mayo noted, that in this case, no turn around would be needed. Mr. Ash suggested that the notes concerning cost of sewer lines extension be shown on this plat. Commissioner Sweeney moved that the Commission recommend approval of the plat with the provision that the final plat include notes concerning cost of sewer line extension and septic system design approval by a registered engineer. The motion was seconded by Commissioner Bailey and unanimously approved. Agenda Item No. 8 -- Consideration of a final plat, RainTree Section II. Mr. Eddie Schultz, developer, spoke to explain the slight changed made in the final plat. Commissioner Burke moved to recommend approval of the plat. The motion was seconded by Commissioner Mathewson and unanimously approved. Agenda Item No. 9 -- Consideration of a final plat, Windwood Phase I located at 4110 the southeast corner of the intersection of Harvey Road and the East Bypass. Mr. Mayo noted that the plat was identical to the preliminary plat. Commissioner Mathewson moved to recommend approval of the plat with the following conditions: 1. That the flood zone line be shown. 2. That a note be put on the plat which denies access from any lot to Appomattox, Highway 30, and the East Bypass frontage road. The motion was seconded by Commissioner Bailey and unanimously approved. Agenda Item No. 10 -- Consideration of a master preliminary plat, Emerald Forest located east of the East Bypass between the RainTree Addition and the Foxfire Addition. Mr. Mayo reviewed the recommendations made in the presubmission conference. Dr. Stover pointed out that, due to the location of one of ARC's buildings, the overpass of F.M. 2818 would have to be shifted to the north. Mr. Larry Wells, of Bishop Engineering, presented a series of drawings representing changes made as recommended at the presubmission conference. 41/0 Mr. Ash suggested that the City might want to consider a participation policy for the construction of structures where Appomattox Avenue would have to cross flood plains. It was agreed that the Commission was agreeable to the development concept. MINUTES, Planning and Zoning Commission Page 4 November 11, 1977 7:00 P.M. Agenda Item No. 11 -- Other business. Commissioner White advised the Commission that the Land Use Subcommittee had met with staff and was working to identify commercially zoned areas which were inconsistent with the Comprehensive Plan. Commissioner Mathewson suggested that the City Attorney and David Pugh study an amendment to the Zoning Ordinance which would require the following: 1. That a final plat be filed within 18 months after its approval and that a building permit on the plat be filed for in a reasonable period of time. 2. That any rezoning not in compliance with the Comprehensive Plan revert to A-0 if not developed within 3 years following the rezoning. Agenda Item No. 12 -- Adjourn.
