MEMBERS PRESENT: Commissioners George Boyett, Tom Chaney, Ed Miller, C. C. Mathewson, John B. Longley, and James Wallace; Council Liaison Don Dale; and City Engineer North Bardell. MEMBERS ABSENT: Chairman M. R. Calliham VISITORS PRESENT: See Guest Register Agenda Item No. 1 - Approval of the minutes of the June 18, 1973 , meeting. The meeting was called to order at 7 :10 P.M. by Commissioner Boyett, who conducted the meeting in Chairman Calliham' s absence, and on motion by Commissioner Chaney, seconded by Commissioner Miller, the minutes of the June 18 , 1973 , meeting were approved. Agenda Item No. 2 - P&Z Case No. 21-73 . A public hearing on the question of rezoning the Dorsey McCrory 10 . 99 acre tract from C-N (neighborhood business) to C-1 (General Commercial) . City Engineer Bardell presented the location and description of the tract. Commissioner Boyett asked for comments. Mr. McCrory stated that he had complied with the city regarding drainage easement and this reduced the business area by one acre. Council Liason Dale asked Mr. McCrory if there was any property taken away from him as a result of the easement. Mr. McCrory answered that the actual easement was not what the map indicated that it would be. Mr. Mathewson asked Mr. McCrory if he had any plans for C-l. Mr. McCrory stated that he had a prospect for a hardware store for this area, however a site had not been selected. Commissioner Boyett asked if there were any other comments before the public hearing was opened. The public hearing was opened. There was no response and the public hearing was closed. Commissioner Mathewson stated that he did not agree with the proposed change which allowed filling stations, eating establishments, etc. to come in adjacent to the larger lots . Commissioner Longley asked if the property owners involved were notified by registered mail . City Engineer Bardell answered that the property owner of record was notified but not those holding conditional sales contracts. Commissioner Chaney gave his opinion that he thought an eating establishment should not be allowed in this area relative to the school children leaving the school grounds for the purpose of eating lunch; and that such a place of business would be unsightly to the city. Mr. McCrory stated that he was being given singular treatment as compared to other business that was established 1969 . Commissioner Boyett advised that the city did not show preference and Mr. McCrory stated that he questioned this and that he was in the process of having a land utilization study made of his tract. Commissioner 410 Boyett asked for a motion relative to this case. On motion by Commissioner Mathewson and seconded by Commissioner Chaney, the request for rezoning the McCrory 10 .99 acre tract was unanimously denied. 4 MINUTES Page 2 Planning & Zoning Commission, July 16 , 1973 411 Agenda Item No. 3 - Other business. Approval of the final plat for University Park. City Engineer Bardell presented a description and an updated report regarding University Park, and stated that this did not involve any public streets. Commissioner Wallace asked for the specific boundaries. City Engineer Bardell described these boundaries and Commissioner Boyett asked for motion regarding this item. On motion by Commissioner Wallace and seconded by Commissioner Chaney, the final plat for University Park was approved. The commission then discussed plans for a workshop meeting on Monday, July 23 , 1973 at 7 :00 P.M. , in the Conference Room of the City Hall. Agenda Item No. 4 - Hear Visitors. No one spoke. Agenda Item No. 5 - Adjourn. On motion by Commissioner Longley, seconded by Commissioner Mathewson, the meeting was adjourned at 8 : 00 P.M.
