MINUTES
Planning and Zoning Commission
December 20, 1971

Liaison Don Dale; and City Planner George Eby
MEMBERS ABSENT: Commissioner Carl Landiss

1. The meeting was called to order by the Chairman at 7:00 P.M. On motion by
Commissioner Boyett, seconded by Commissioner Cooley, the minutes of the December
6, 1971 meeting were unanimously approved.
2. P&Z Case No. 32-71
After a brief presentation of a preliminary plat of Southwood Section 10 by Mr. W. D.
Fitch, on motion by Commissioner Calliham, seconded by Commissioner Wallace, the
preliminary plat, as submitted by the Area Progress Corporation, was unanimously
passed and approved.
3. P&Z Case No. 33-71
• This is a preliminary plat of Southwood Section 19 submitted by Parkway Investments
(Richard Smith). A substantial amount of discussion was held concerning the need for
the provision of access to the city property behind the city cemetery and of the need for a
green belt area along Bee Creek. After substantial debate, Commissioner Boyett moved
to deny approval of the plat. There was no second. After additional debate, Commissioner
Boyett made a motion to approve the plat with the condition that the land referred to on this
plat entitled "Proposed Park" be included on the final plat as a city park. The motion,
seconded by Commissioner Wallace, was unanimously passed and approved.
4. Mr. J. D. Shanks of the General Telephone Company of the Southwest explained the
telephone company's policy of not furnishing underground conduit in certain large scale
developments such as apartment complexes, mobile home parks and shopping centers. He
explained that these underground conduits would have to be installed at the property owner's
expense, and done under the supervision of the telephone company engineer.
Commissioner Boyett moved that the city accept the telephone company guidelines and
for the City to inform developers of the policy. Motion was seconded by Commissioner
Wallace and vote was unanimous.
5. Zoning Ordinance
The final examination of the zoning ordinance was conducted and the city attorney's
recommendations were considered.
The commission considered the letter of December 16, 1971 from Mr. Tom Giesenschlag,

It was decided to: reject the recommended change to section 6-C, add section
9-E.3, change 10-A, change 11-A, and reject change in 11-C. (See enclosed letter
from Mr. Giesenschlag).
Commissioner Boyett moved that the zoning ordinance, as revised on December 20,
1971, be approved by the Commission along with the zoning district map and that the
ordinance and the map be submitted to the City Council as the final draft of the Planning
and Zoning Commission for the City Council's consideration at the earliest possible
date. Commissioner Cooley seconded the motion and the vote was unanimous.
The Chairman asked the Subdivision Committee to review possible names for
State Highway 30 for recommendation to the City Council.
The City Planner reported that the presentation of the population and land use pro-
jections were postponed due to technical difficulties.
On motion by Commissioner Boyett, seconded by Commissiner Wallace, the meeting
was adjourned, subject to call.

Dear Mr. Wells :
This is to advise that I have again reviewed the Proposed Zoning
Ordinance with special emphasis upon revisions of November 15,
1971.
In connection with this review, I have the following suggested
alterations:
CHANGE: 6-C to read ALTERED BUILDING PLOTS:

ant to Section 15 of this ordinance. •
CHANGE: 10-A (First paragraph only) to read:
A use permit is a document authorizing the existence of
3 a non-conforming use, a conditional use, or a variance as these
terms are herein defined. The issuance of a use permit may be
prerequisite to the issuance of a Building Permit or Certificate
of Occupancy but,,shall not alleviate the requirement for a
Building Permit or Certificate of Occupancy where this requirement
would otherwise exist.
