This request is submitted by the Dobrovolny's and is a request for change in zoning from District No. 1, First Dwelling House District, to District No. 2, Second Dwelling House District. g. P&Z No. 29-69 - Consideration of rezoning a 33.234 acre tract in the Crawford Burnett League, bounded on the north by Wolf Pen Creek, on the south by Holleman Drive and on the west by Anderson Street. Cooley, Paul E. Pate and Joseph J. McGraw • The Chairman called the meeting to order at 7:00 p.m. in the Council Room in the City of College Station, Texas. The Minutes of August 18 were approved as written. The first item of business on the Agenda was the reconsideration of an amendment of a Mobile Home Ordinance. After discussion by the Commission members, Commissioner Gardner moved that the proposed revision to Mobile Home Ordinance No. 627 be recommended to the Council for approval. Motion was seconded by Commissioner Janne. Motion carried. The vote was unanimous. The next item on the Agenda was reconsideration of the extension of Welsh Street from Holleman Drive (Old County Road) South to the Southwest Parkway. Lee Roy George, City Planner, told the Commission that due to the fact that engineering surveys had not been completed, he had no recommendation to make regarding this extension. He stated that he would try and have something worked up for the next meeting. The next item on the Agenda was the rezoning requests for the Dobrovolny property which consists of five tracts (P&Z No. 25-69, 26-69, 27-69, 28-69 and 29-69). Mr. Wood, Architect for Caporina & Wood, presented the rezoning requests to the Commission by showing a planned development plat of what the Dobrovolny's were proposing to do. There were numerous questions from the Commissioners which were addressed to Mr. Wood regarding the rezoning requests. Chairman Wells pointed out that he, personally, felt there was a lot of right of way required on Anderson Street • and he didn't know whether some of the property owners in that area would grant the necessary right of way for the development of Anderson Street. Mr. Wood stated that this had been discussed with some of the property owners and that the Dobrovolny's were willing to grant the necessary right of way from their land if necessary. I Minutes of the Planning and Zoning Commission • September 2, 1969 Page 2 Commissioner Janne asked Mr. Wood what provision had been made for a buffer between such a high density area proposed and the single family residences not existing. Mr. Wood stated that the plan used went from single family residence to open space to duplexes to open space to apartment house. He stated that the open spaces were green areas which were heavily wooded. Commissioner Gardner asked the question of what access would be used to the apartment area. Mr. Wood stated that the apartment units parallel to Hollemen are to be designed in cluster form in order to control the traffic. Questions were also raised by commission members relative to who would maintain the green open space areas as well as streets in the apartment areas. Councilman Ransdell asked at what point in time the women's dormitory was envisioned. Mr. Wood stated that there was need for one at the present time according to surveys that had been made. Councilman Ransdell stated that buffering is not provided for the dormitory. Mr. Wood pointed out that there was 200 feet of Park area and then the apartment or dormitory area. Mr. Wood pointed out that the site from Park Place north is not large enough to allow single family units or duplexes. Another strip of buffering would need to be added. Chairman Wells asked Commissioner Gardner what thinking the Parks Committee . had for the type of park proposed in the two small areas in this development. He said that the national standard is for recreational facilities. Commissioner Gardner stated that the Committee had not adopted any plans but that they are reviewing plans from architectural students which makes use for areas of scenic parks and provides drainage facilities and that he felt there is a need for some active recreation area in the proposed development. Mr. Gardner stated that for dual purpose parks, there should be green areas as well as recreational facilities. Mr. Wood stated that a school would be needed in the area proposed for development to take pressure off South Knoll. Mr. Wood stated that in their talks with the School Board, the indications were for a school to be built in the area. Mr. Wells also pointed out that the City does not pay for utilities and streets in developments. Chairman Wells stated that the property exchange with the Dobrovolny's and the Catholic Church would have to be resolved before the Planning and Zoning Commission could act on that request. He stated that the Council has instructed the Planning and Zoning Commission to not send any recommendation on to them until provisions for drainage and necessary easements have been designated on the plat. The question of police protection in the dormitory area was raised in view of the access to the dormitory. Mr. Wells stated that he, personally, would prefer that a R.O. W. be given for street and put a solid line of duplexes between the single family residences and the apartment zone. Minutes of Planning and Zoning Commission • September 2, 1969 Page 3 Commissioner Janne asked why was the value of land such that the apartments could not be changed to single family residences. He stated he felt some of the de- preciation in land values could be absorbed by the developer rather than by the already existing property owners, whose homes in that area would be affected. Mr. Wood was asked by Commissioners where he would put single family residences if he were building them. He stated that south of the city, single family residences were developing quite well and that this was a good area for them. He stated that the property in question could not be developed as single family residence because it simply was not feasible. He stated it did not have trees, and was not suitable for single family residence. He said they have figured it out and they simply could not come up with any figures which would make the land pay for single family residence. Mr. Wood then showed the Master Plan of development and explained it to the Commission. Mr. Caporina, a partner with Mr. Wood, stated that they had studied a lot of • developments and projects in California and other states and had found "high-quality" uses of land were patio houses, town houses and apartment houses, such as they were proposing. He stated that he felt College Station had enough single family, shanty-type residences. Mr. Wells stated that in Texas, the average home costs $8,600 and in College Station the amount is $12,500 and that, in his opinion, there were no shanties or shacks in the area. Mr. Mel Lassell, a graduate student who had just returned to work at A&M University and who resides at 1407 Skrivanek Court stated that his home was valued at $30,500 and if apartment zoning was granted, he would have apartments facing his back yard. He felt there should be some type of a buffer zone. Mr. M. R. Calliham of 204 Redmond stated that he was speaking for himself as well as some of the other property owners in the area near the proposed development and that they were against the particular development proposed. He recommended that single family residences be retained in the area north of Park Place and in the area West of the proposed extension of Anderson Street, all the way through. Jim O'Brien stated that he had officially resigned as of 1:30 p.m. this date from the Planning and Zoning Commission and that as a citizen he resented the remark that Mr. Caporina made regarding houses in College Station as shanties. i L Minutes of Planning and Zoning Commission • September 2, 1969 Page 4 Commissioner Gardner asked for examples to be given which would show the effect of apartments being built next to single family residences as far as the real estate market value was concerned. Mr. E. B. Smith said that he lost about $4,000 from the sale of his house at 1312 Timm. Mr. David Chester stated that a neighbor who lived down the street from him had to sell his home about $1, 000 under the price that it was appraised for. Mr. Calliham stated that developers should have single family residence next to single family residence and then a buffer zone so that the people who purchase their single family residences would know they were buying next to lots that were zoned for apartments. Mr. C. S. VanDoren presented a petition signed by property owners on Glade Village Drive and Timm Drive protesting the passage of these rezoning requests. Also, Bill Oxley of 1405 Skrivanek Court presented some petitions protesting the passage of the rezoning requests. These petitions are made a part of these Minutes as Attachments A, B, C, D, E, and F. • Commissioner Gardner stated that he felt the petitions should influence the Commissioners decision regarding the rezoning requests. Mr. Bading, a brother-in-law and a representative of the Dobrovolny family, stated that they would certainly want to give consideration to what Mr. Calliham had proposed. Chairman Wells stated that they could bring it in in not so elaborate a form if they wished so that it might be discussed. Mr. Francis Gough, a citizen in the audience, stated that it did not matter whether it was in pencil form or what, it was still a request for apartments and the citizens were against it. Mr. Joseph McGraw stated that as a professional in the audience, he would like to go on record as encouraging a detailed presentation as the developers had given instead of bringing in a request in pencil form. After a considerable amount of discussion, Commissioner Horne moved the rezoning requests of 25-69, 26-69, 27-69, 28-69 and 29-69 be tabled until the owners have had an opportunity to make further plans as they indicated they would do. Commissioner Janne seconded the motion. Motion carried. The vote was unanimous. Mr. Van Doren stated that he felt the Council and the Commission should stop zoning of any type until the zoning ordinance was updated. • Minutes of the Planning and Zoning Commission September 2, 1969 Page 5 Mr. McGraw stated that a joint meeting between the Council and the Planning and Zoning Commission was to be held on September 10 and that the citizens who were interested could actually participate in writing the zoning ordinance if they would like to come to this meeting. Mr. Garner, an engineer for the University Oaks project, approached the commission to ask for their advice relative to a proposed plat. Mr. Wells informed him that he would need to get with the City Engineer and other city officials to work out drainage easements, etc. on the plat. Mr. Wells asked to be recorded in the Minutes as having signed the final plat on Southwood, Section 5, for Bill Fitch last Friday (August 29) so that it could be recorded with the County Clerk's office. On motion by Commissioner Baur, seconded by Commissioner Horne, the meeting was adjourned, subject to call.
