Visitors: City Councilman O. M. Holt
The commission discussed a letter received from Bardin Nelson requesting
rezoning of one certain tract of land on Dexter from # 1 residential to # 3
apartment for the purpose of operating a kindergarten. City Manager
Boswell reviewed to the commission the zoning ordinances in that area and
stated that two other kindergartens have been in operation in the immediate
area without protest from adjoining property owners. City Attorney Dillon
further explained the legal aspects and explained further that due to the
• fact existing kindergartens are operating in that area does not constitute
grounds for the operation of another kindergarten. Legal action could be
taken by adjoining property owners by seeking an injunction. City Attorney
Dillon reviewed the alternatives for the city as follows:
(1) City of College Station could secure the injunction.
(2) Charge in corporation court a violation of city ordinances.
(3) Private citizens can seek an injunction. City Manager Boswell related
that two complaints have been received from two private citizens in the
neighborhood.
On a motion by Janne, second by Horne, the commission recommended
that the request by Mr. Nelson be denied due to the fact it involves spot
zoning and also from the fact that oral objections have been received from
the surrounding neighbors. Motion passed.
On a motion by Home, second by Preston, the commission recommended that
the kindergarten situation should be reviewed and considered in the revision
of Ordinance No. 38. Motion passed.
Meeting adjourned at 6:15 P. M.
