AN ORDINANCE AMENDING APPENDIX A "UNIFIED DEVELOPMENT
ORDINANCE," ARTICLE 4 "ZONING DISTRICTS," SECTION 4.2, "OFFICIAL
ZONING MAP" OF THE CODE OF ORDINANCES OF THE CITY OF COLLEGE
STATION,TEXAS,BY CHANGING THE ZONING DISTRICT BOUNDARIES FROM R
RURAL TO GC GENERAL COMMERCIAL AND NAP NATURAL AREAS
PROTECTED AFFECTING APPROXIMATELY 2.3 ACRES BEING SITUATED AT 4075
STATE HIGHWAY 6 SOUTH;PROVIDING A SEVERABILITY CLAUSE;DECLARING
A PENALTY; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION,
TEXAS:
PART 1: That Appendix A "Unified Development Ordinance," Article 4 "Zoning Districts,"
Section 4.2 "Official Zoning Map" of the Code of Ordinances of the City of College
Station, Texas, be amended as set out in Exhibit "A", Exhibit "B" and Exhibit "C"
attached hereto and made a part of this Ordinance for all purposes.
PART 2: If any provision of this Ordinance or its application to any person or circumstances is
held invalid or unconstitutional, the invalidity or unconstitutionality does not affect
other provisions or application of this Ordinance or the Code of Ordinances of the City
of College Station, Texas, that can be given effect without the invalid or
unconstitutional provision or application, and to this end the provisions of this
Ordinance are severable.
PART 3: That any person, corporation, organization, government, governmental subdivision or
agency, business trust, estate, trust, partnership, association and any other legal entity
violating any of the provisions of this Ordinance shall be deemed guilty of a
misdemeanor,and upon conviction thereof shall be punishable by a fine of not less than
twenty five dollars ($25.00) and not more than five hundred dollars ($500.00) or more
than two thousand dollars($2,000)for a violation of fire safety,zoning,or public health
and sanitation ordinances, other than the dumping of refuse. Each day such violation
shall continue or be permitted to continue, shall be deemed a separate offense.
PART 4: This Ordinance is a penal ordinance and becomes effective ten (10) days after its date
of passage by the City Council, as provided by City of College Station Charter Section
35.

amended to read as follows:
The following property is rezoned from R Rural to GC General Commercial and NAP Natural
Areas Protected:

A METES &BOUNDS description of a certain 2,259 acre tract situated in the Robert Stevenson
League,Abstract No. 54 in Brazos County, Texas, being all of a called 2.236 acre tract
conveyed by Warranty Deed in Lieu of ForeclOsure. to Joanne Fraleigh recorded in Volume
12826, Page 259 of the Official Public Records of Brazos County,all of a called 0.298 acre tract
conveyed by Correction Quitclaim Deed to Blue Dolphin Club, Inc_a Texas corporation
recorded in Volume 4208, Page 159 OPRBC,and all of a called 0.298 acre tract conveyed by
Quitclaim Deed to Blue Dolphin Club, Inc_a Texas corporation recorded in Volume 4029, Page
99 OPRBC;said 2.259 acre tract being more particularly described as follows with all bearings
based on the Texas Coordinate System of 1983: Central Zone:
BEGINNING at a found 518-inch iron rod(with cap stamped-Kern marking the most southerly
west corner of said 2.236 acre tract being in a southeasterly line of a called 10,01 acre tract
(Tract One)conveyed by Warranty Deed to Wheeler, Ltd, recorded in Volume 3007, Page
341 of the Official Public Records of Brazos County, being the same tract of land described as
9.665 acres in Volume 147, Page 212 of the Deed Records of Brazos County and in the
occupied northeast right-of-way of State Highway No_6 (variable width),from which a found
disturbed concrete monument bears North 422820"West, 104.93 feet;
THENCE North 41'42'46"East, along a common line of the herein described subject tract,said
10.01 acre tact and said 9.685 acre tract, 194.47 feel to a found 112-inch iron rod marking a
westerly interior corner of the herein described subject tract,the southeast corner of said 0.298
acre tract, and being common with an easterly corner of said 10.01 acre tract and said 9.685
acre tract;
THENCE North 4738'68"West, along a common line of the herein described subject tract,said
0.298 acre tract and said 9_685 acre tract,passing at 140.46 feet a found 58-inch iron rod(with
cap stamped"Kerr")for reference,continuing in all a total distance 01164.60 feet to a point for
corner in the centerline of a creek marking the northwest corner of the herein described subject
tract;
THENCE along the centerline of said creek the following three(3)courses and distances:

stamped"Kerr"), continuing in all a total distance of 334.26 feet to a found 5/8-inch iron rod(with
cap stamped"Jone.slCarter)marking the east corner of the herein described subject tract being
common with the north corner of Lot 1, Block One of the Final Plat of Southside Plam-Phase 1
