Possible action. The City Council may seek advice from its attorney regarding a pending or
contemplated litigation subject or settlement offer or attorney -client privileged information .
Litigation is an ongoing process and questions may arise as to a litigation tactic or
settlement offer, which needs to be discussed with the City Council. Upon occasion the City
Council may need information from its attorney as to the status of a pending or
contemplated litigation subject or settlement offer or attorney -client privileged information .
After executive session discussion, any final action or vote taken will be in public. The

UDO Section 12-5.7.C - Planned Development District (PDD)
C. Planned Development District (PDD)
The purpose of the Planned Development District is to promote and encourage
innovative development that is sensitive to surrounding land uses and to the natural
environment. If this necessitates varying from certain standards, the proposed
development should demonstrate community benefits.
The PDD is appropriate in areas where the land use plan reflects the specific
commercial, residential, or mix of uses proposed in the PDD. A PDD may be used to
permit new or innovative concepts in land utilization not pe rmitted by other zoning
districts. While greater flexibility is given to allow special conditions or restrictions that
would not otherwise allow the development to occur, procedures are established to
insure against misuse of increased flexibility.

Recommendation(s):Staff is seeking guidance from Council.
Summary:On October 26,2017,Council instructed staff to prepare and release a request for
information related to investigating and evaluating the possibility of privatizing solid waste services.
Members of Council also discussed having estimated costs from respondents to provide solid waste
services,which is a different type of request that would need to be released.In addition,to obtain
the best information possible from the request release,staff is seeking direction related to the types
and level of solid waste service that Council would like to evaluate.Finally,staff is requesting
permission to engage a solid waste consultant to prepare the request and assist in evaluating the
responses.
This analysis will include identifying the pros and cons to the City of privatizing solid waste services
versus providing the services in house.
Staff will make a presentation to provide the decision points for the City Council to consider with
regard to the preparation of a solicitation related to investigating and evaluating the possibility of
privatizing solid waste services.
Budget &Financial Summary:The financial impact on solid waste disposal services will vary
depending on the direction established by Council.
