Upon stepping to the podium the speaker must state their name and city of residence, including the state of residence if the city is located out of state. Each speaker's remarks are limited to three minutes. A series of timer lights will change from green to yellow and an alarm will sound after two and one -half minutes to signal thirty seconds remaining to conclude the remarks. At three minutes the timer light will change to red and the final alarm will sound. The speaker must then conclude the remarks. The City Council will listen and receive the information presented by the speaker, ask staff to look into the matter, or place the issue on a future agenda. Topics of operational concerns shall be directed to the City Manager. Comments should not personally attack other speakers, Council or staff. Call to Order and Announce a Quorum is Present With a quorum present, the Workshop of the College Station City Council was called to order by Mayor Mooney at 5:00 p.m. on Thursday, March 9, 2017 in the Council Chambers of the City of College Station City Hall, 1101 Texas Avenue, College Station, Texas 7784 0. 2. Executive Session In accordance with the Texas Government Code §551.071-Consultation with Attorney, the College Station City Council convened into Executive Session at 5:06 p.m. on Thursday, March 9, 2017 in order to continue discussing matters pertaining to: A. Consultation with Attorney to seek advice regarding pending or contemplated litigation; to wit:  Kathryn A. Stever-Harper as Executrix for the Estate of John Wesley Harper v. City of College Station and Judy Meeks; No. 15,977-PC in the County Court No. 1, Brazos County, Texas; and  Charlton F. Clayton v. City of College Station; Case: 4:16-cv-03485 in the US District Court for the Southern District of Texas Houston Division. WKSHP030917 Minutes Page 2 B. Consultation with Attorney to seek legal advice; to wit:  Legal issues related to a proposed amendment to the Biocorridor Interlocal Agreement concerning east side sewer improvements. The Executive Session recessed at 5:15 p.m. 3. Take action, if any, on Executive Session. No action was required from Executive Session. 4. Presentation, possible action and discussion on items listed on the consent agenda. Items 2d and 2e were pulled from Consent for clarification. (2d): David Schmitz, Director of Parks and Recreation, these are part of the parkland dedication. This will finish out the park development. (2e): Donald Harmon, Director of Public Works, clarified the need for the right-of-way for the expansion and realignment of Royder Road. 5. Presentation, possible action, and discussion on a proposal for a historical, cultural and educational display in Northgate. Jay Socol, Director of Public Communications, reported that there is a proposal to establish a cultural marker in Northgate. Rob Clark, with The Eagle, noted that the marker would commemorate “this old porch” immortalized in song by Lyle Lovett and Robert Earl Keen. Mr. Socol further explained that, in concept, Keen and Lovett could be depicted sitting, singing and playing guitar - similar to how the men posed for a Texas Monthly cover photo - but with a chair in between them to create an interactive element that would be perfect for visitors taking and sharing photos. The idea to create a cultural, historical and educational display at Northgate has received verbal and written support from the Northgate District Association and from additional Northgate merchants. In addition to recognizing part of College Station’s history, there appears to be a unique opportunity to create an iconic "destination within a destination" that would attract and educate Aggies and visitors of all ages and generate a positive economic impact to our Northgate merchants. Texas A&M University System Chancellor John Sharp has generously pledged to fund half of the concept, should it become a reality. The balance would be sought through private fund raising efforts. Council consensus was to go forward. 6. Presentation, possible action, and discussion regarding the requirements for bicycle racks. Lance Simms, Director of Planning and Development, provided an overview of the requirements for bicycle racks in College station. He noted that for Texas cities over 50,000 population, College WKSHP030917 Minutes Page 3 Station ranks #1 in people biking to work. The UDO currently requires bike racks if the building is subject to non-residential architectural standards. There are certain zoning districts exempted: Business Park Industrial, Light Industrial, Heavy Industrial, and Research & Development. Northgate is excepted with different standards. Exempted uses include churches, educational facilities, municipal industrial facilities, and private utility buildings. The current UDO requires that each site provide parking for a base minimum of four bikes (more for more intense uses); bike racks should be located within 150 feet of the primary entrance; and bike racks are permitted on sidewalks or other paved surface provided they do not impede pedestrian or vehicle movement. Staff was asked to come back with recommendations. 7. Council Calendar Council reviewed the calendar. 8. MOTION: Upon a motion made by Councilmember Schultz and a second by Councilmember Moore, the City Council voted six (6) for and none (0) opposed, to approve the absence requests of Councilmember Benham. The motion carried unanimously. Recognition of the 75th anniversary of the U.S. Navy’s Construction Battalions, whose members are known as “Seabees.” Mayor Mooney recognized March 5, 2017 as the 75th anniversary of U.S. Navy Seabees and presented the proclamation to Dave Coleman and other veterans. Mr. Coleman recognized two WWII veterans, Carpenter’s Mate 2nd Class Bill Johnston and Painter 1st Class Jim Rothermel, and presented them with a commemorative coin commemorating the 75th anniversary of the U.S. Navy’s Construction Battalions, whose members are known as “Seabees.” A special Seabees coin was also presented to the Mayor. Mike Guidry and Chief Steward Diener, representatives of the RM030917 Minutes Page 2 Seabees, presented a signed Seabees flag that will be sent to an F-18 squadron on its way into battle. Hear Visitors Comments Ben Roper, College Station, came before Council to honor the service and sacrifice of Navy Seabee Chief Petty Officer Raymond Border. CONSENT AGENDA 2a. Presentation, possible action, and discussion of minutes for:  February 23, 2017 Workshop  February 23, 2017 Regular Meeting 2b. Presentation, possible action, and discussion regarding a three year professional services contract with McCord Engineering, Inc. for $1,800,000 for electrical engineering services. 2c. Presentation, possible action, and discussion on the approval of Amendment No. 1 to the Department of State Health Services Vital Statistics Unit Remote Birth Access Contract No. 537-16-0117-00001, to be denominated as Contract No. 537-16-0117-00001A, and authorize the Mayor to execute same. 2d. Councilmember Brick ask to do a review of the options for neighborhoods that are owner-occupied to maintain the integrity of their neighborhoods. Recommendation(s):Staff recommends Council approve the attached resolution directing publication of notice of the intention to issue certificates of obligation. Summary:The City Council is authorized to approve the issuance of certificates of obligation (COs) after approving a resolution directing notices to be published of the intent to issue the COs. The City of College Station typically issues debt to fund various capital projects identified and approved as a part of the annual budget. Certificates of Obligation (COs)are based on the full faith and credit of the City and are paid primarily through the debt service portion of the ad valorem tax rate.Certificates of Obligation normally include at least one additional revenue stream besides the debt service portion of the tax rate such as utility revenues.The City's policy for issuing Certificates of Obligation allows more flexibility in their issue than General Obligation Bonds,which are authorized by the voters,particularly when other revenues are anticipated to assist in debt service. The City’s Financial Advisor recommended that the City issue Certificate of Obligations for utility projects instead of Utility Revenue Bonds (URBs).The Utility systems will cover their associated portion of debt service through utility revenues. The Certificates issued will be used to fund street,public facilities,water and wastewater projects,and pay debt issuance costs.The maximum amount of Certificates of Obligation indebtedness that may be authorized to be sold is $70,000,000. At the May 11th meeting,the City Council will consider approval of the sale parameters for the General Obligation and Refunding Bonds,appoint a Paying Agent/Registrar,appoint Underwriters,adopt Bond Ordinances and authorized the preparation of the Official Statements for the General Obligation and College Station, TX Printed on 3/17/2017Page 1 of 2 powered by Legistar™ File #:17-0105,Version:1 Ordinances and authorized the preparation of the Official Statements for the General Obligation and Refunding Bonds and the Certificates of Obligations.If the ordinances are approved,the City Council will be delegating to the City Manager the authority to execute the bond sale and refunding. Budget &Financial Summary:Staff reviewed the impact of the Certificates on the City's ability to meet debt service requirements and the effect they may have on the ad valorem tax rate.The impact on the utility rates will be reviewed as part of the financial forecast and FY18 budget.Debt for the construction of the Police Station will require a tax increase in FY 18.The recommendation to move forward with this issue. Bulky waste and brush shall be exempt from this requirement. Plastic bags shall be of sufficient strength and puncture resistance to prevent the contents from spillage before and during collection. All bags shall be securely tied or otherwise fastened or closed so as to prevent spillage or entry by vector and vermin. Only garbage and household waste is to be placed in plastic bags. Construction demolition waste, tires, hazardous substances and stable matter such as dirt, brick, and rock will not be accepted. (h) City and City’s contractor shall provide door-side solid waste and recycling collection service for qualified handicapped households. (j) Automated containers shall not be placed curbside before 5:00 a.m. the day of which collection is scheduled. Automated containers shall be removed from the designated pickup point and placed either adjacent to their dwelling or at a location designated by the City within twelve (12) hours of their scheduled collection day. Under no circumstances, shall an automated container be placed for normal daily use within an area defined by the edge of the street, pavement, or curb and the building set back line. (k) Each single-family detached residential unit or housing unit with less than four (4) attached residential units that has been assigned a City-owned automated solid waste container will be provided with once per week garbage, brush, rubbish, and every other week recycling collection. (l) Each residential unit with four (4) or more attached residential units in a complex which has not been identified as a multi-family apartment complex by the City that has been assigned a shared large City-owned automated solid waste collection container, will be provided with twice per week garbage collection, once per week brush/rubbish collection, and every other week recycling collection. (q) Rock, construction demolition waste, building materials, or other refuse resulting from building or remodeling operations or resulting from a general cleanup of vacant or improved property, will not be removed by the City. Such waste shall be removed by the building contractor, owner, or occupant of the property at his own expense. Based upon traffic data collected by Traffic Engineering,current automobile delay for Alexandria Avenue in the worse condition is 50.7 seconds per vehicle with a two-way stop with the northbound approach experiencing more than 3 minutes of delay per vehicle (this happens between 7 am and 8 am).With an all-way stop intersection,the average delay for the intersection becomes 23 seconds per vehicle in the morning peak.In the afternoon,the average delay at the intersection becomes 16 seconds per vehicle.This intersection has had 3 crashes in the past 1 year that are correctable through the use of an all-way stop.Based upon the 2016 data,this intersection meets the 1 hour volume warrant for considering the installation of a traffic signal. At this time, traffic engineering recommends the installation of an all-way stop. Additionally, with the ongoing construction of the Park West Development, safe and orderly traffic flow along Luther Street West will become even more important. Given these observations, to improve safety, mobility, and emergency vehicle access along these streets, the City of College Station Traffic Management Team recommends approving this ordinance. This u-turn movement has contributed 4 crashes in the past 3 years. Summary: The applicant is requesting a zoning change from R Rural to MF Multi-Family and NAP Natural Areas Protected. This an initial step toward developing a multi-family residential development. REVIEW CRITERIA 1.Consistency with the Comprehensive Plan: The subject property is designated Urban and Natural Areas Protected on the Comprehensive Plan Future Land Use and Character Map. Land uses associated with this type of designation are reserved for townhomes, duplexes and high density apartments. Much of the area surrounding this tract is either flood way or floodplain as identified by FEMA, and is within the Natural Planning Corridor VIII, Carter Creek Corridor in the Comprehensive Plan Concept Map. The Natural Areas Protected designation is given in these areas to preserve the natural function of the water way and to limit development from encroaching into flood hazard areas. The proposed development is consistent with the future land use designations identified for this area. 2.Compatibility with the present zoning and conforming uses of nearby property and with the character of the neighborhood: The property is currently zoned R Rural. This zoning was given to this property as a land use placeholder upon annexation into the city pending further development complying with the Comprehensive Plan. The existing R Rural zoning allows for large lot residential and/or agricultural uses. While much of the land surrounding this property is located in the ETJ not guided by zoning regulation, the land use pattern is mostly large lot residential which is compatible with a Rural zoning. However, a Rural zoning does not support a more intense development pattern that is anticipated for the land directly along State Highway 30. 3.Suitability of the property affected by the amendment for uses permitted by the district that would be made applicable by the proposed amendment:The proposed land uses permitted through this request are those allowed in MF Multi-Family and NAP Natural Areas Protected. The Multi-Family zoning designation outside of the floodplain is suitable on this tract considering its access along State Highway 30 and the increase in more intense development activity along this corridor. The NAP will serve as buffer to the existing residential homes to the south, but more importantly will provide protection to the creek and surrounding land, preserving its natural function and aesthetic that is currently not being protected under the entitled Rural zoning. As mentioned this area is also seeing several changing conditions that warrant the suitability of this property changing land uses. With a continued rise in development in and around the Copperfield and Summit Crossing area and commercial development interest on adjacent tracts, a Multi-Family and NAP use is an appropriate request for this tract. 4.Suitability of the property affected by the amendment for uses permitted by the district applicable to the property at the time of the proposed amendment: The property is currently zoned R Rural. The current zoning district is suitable given the similar zonings and uses of nearby property in and out of the city limits. However, conditions in the area along this corridor are changing with increased development interest near Copperfield Parkway and Summit Crossing. Additionally, the adjacent tract to the west was also recently rezoned for General Commercial thus increasing potential for more intense development along Highway 30 and reducing the suitability of a rural land use along this corridor. 5.Marketability of the property affected by the amendment for uses permitted by the district applicable to the property at the time of the proposed amendment: The property can currently be marketed under the existing R Rural zoning district. However, the applicant has stated that rural designation is not appropriate or feasible for this property knowing the changing development pattern along the Highway 30 corridor. With continued growth along Copperfield Parkway and the expansion of the Summit Crossing development the need for rural or agricultural land is reducing when compared to the demand to have sites available for higher density residential and non-residential developments. 6.Availability of water, wastewater, stormwater, and transportation facilities generally College Station, TX Printed on 3/17/2017Page 2 of 3 powered by Legistar™ File #:17-0122,Version:1 suitable and adequate for the proposed use: There is an existing 12” water line located along the opposite side of Harvey road from the subject property. The tract has an 18” wastewater line available to serve the property that runs along the rear of the tract. The Developer’s engineer has provided a sealed sewer demand letter that proposes to not exceed the current capacity allocated for this line. Southern and western portions of subject property lay within the FEMA 100 fear floodplain of Harvey Hillside Creek. Detention is required with site development. Drainage and any other infrastructure required with the site development shall be designed and constructed in accordance with the BCS Unified Design Guidelines. The Thoroughfare Plan identifies Harvey Road (State Highway 30) as a future 4-lane Major Arterial. Harvey Road is currently constructed as a 2-lane rural highway with shoulders on each side. The subject tract has about 1,500 feet of frontage on Harvey Road and is not adjacent to an existing or planned intersection. Multiple driveways are anticipated and their location and potential need for right-turn deceleration lanes will be determined with a TxDOT driveway permit at the time of site development. A traffic impact analysis (TIA) was submitted and indicated that turning movements from three proposed site driveways would operate at a Level of Service (LOS) F having an average delay of about 60 seconds with the 95th percentile vehicle queue forecasted to be less than one vehicle. This indicates that despite the delay, there are adequate gaps in traffic on Harvey Road for exiting vehicles. As the LOS F is from private driveways not affecting the function of a public street, no traffic mitigation is required.
