The City Council may seek advice from its attorney regarding a pending or contemplated litigation subject or settlement offer or attorney-client privileged information. Litigation is an ongoing process and questions may arise as to a litigation tactic or settlement offer, which needs to be discussed with the City Council. Upon occasion the City Council may need information from its attorney as to the status of a pending or contemplated litigation subject or settlement offer or attoTI1ey-client privileged information. September 12, 2013 Workshop Agenda Item No. 5 Update on TxDOT’s Thoroughfare Transfer Program To: Kathy Merrill, Interim City Manager From: Chuck Gilman, P.E., PMP, Public Works Director Agenda Caption: Presentation, possible action, and discussion on TxDOT’s Thoroughfare Transfer Program. Relationship to Strategic Goals: 1. Core Services and Infrastructure Recommendation(s): Staff is providing an update and not making any recommendations at this time. Staff requests that the Council receive the presentation. Summary: On August 16, 2013 the City received a letter from the Texas Department of Transportation (TxDOT) introducing a program being considered by the Texas Transportation Commission that will transfer State owned thoroughfares (right-of-way and infrastructure) that are functioning as local streets, to the City. The letter from TxDOT did not include a timeline associated with the transfer, only that the program will be discussed by the Texas Transportation Commission in Austin on August 29, 2013. The August 29th meeting of the Commission clarified some details about the program, and also provided additional information. The program will consist of voluntary transfers from the State to the City, with possible one-time maintenance funds available from the State. City staff will be meeting with TxDOT in the near future to continue discussions on this program. Budget & Financial Summary: N/A Reviewed and Approved by Legal: N/A Attachments: 1. None 5
