MEMBERS PRESENT : Chairman Scott Simpson, Linda Harvell , Sherri Echols , Justin Lopez, and Keith Roberts STAFF PRESENT : Lance Simms , John Haislet, Jessica Bullock, Madison Thomas, Lauren Basey, Kirk Price, and Crystal Derkowski AGENDA ITEM NO . 1 : Call to Order. Chairman Simpson called the meeting to order at 6 : 00pm . AGENDA ITEM NO . 2 : Presentation, possible action and discussion of an absence request for Ceci Matthews on May 3 , 2016 . Board Member Harvell motioned to approve the absence request. Board Member Lopez seconded the motion, which passed (5 - 0) . AGENDA ITEM NO . 3 : Presentation, possible action, and discussion regarding the minutes from January 5 , 2016 . Board Member Lopez motioned to approve the January 5 , 2016 meeting minutes . Board Member Echols seconded the motion, which passed (5 -0) . AGENDA ITEM NO . 4 : Discussion of approved Administrative Adjustments . * AWV2016-000002 2615 Warkworth; Side Setback * AWV2016 -000006 1406 Torey Pines Ct; Rear Setback There was no discussion. AGENDA ITEM NO . 5 : Public hearing, presentation, possible action , and discussion to consider a variance to Unified Development Ordinance Section 12-6. 4.E ` Specific Use Standards Drive-in/Thru Window ' being the requirements for drive-in/thru uses in Northgate Zoning Districts , for the property located at 801 University Drive, being approximately 1 acre within A005001 , JE SCOTT (ICL) , Tract 600 . 1 , generally Iocated near the northwest intersection of University Drive and College Avenue which is zoned NG-2 Transitional Northgate. Case# AWV2016-000009 (JBullock) Senior Planner Bullock presented the staff report and stated that the applicant is requesting a variance to the Unified Development Ordinance Section 12- 6 .4 . E ` Specific Use Standards Drive-in/Thru Window' being the requirements for drive-in/thru uses in Northgate Zoning Districts . She ended her staff report and stated that staff is recommending denial due to the lack of a hardship or extraordinary condition . There was a general discussion amongst the Board. Chairman Simpson opened the public hearing . Bridgette McKinney, applicant, spoke in favor of the variance request. Chairman Simpson closed the public hearing. There was a general discussion amongst the Board . Board Member Lopez motioned to deny the variance as it will be contrary to the public interest, due to the lack of any special conditions , and because a strict enforcement of the provisions of the ordinance would not result in unnecessary hardship to the applicant . Board Member Echols seconded the motion. Chairman Simpson called for the vote . Motion to deny passed (5 - 0) AGENDA ITEM NO . 6 : Public hearing, presentation , possible action, and discussion to consider a sign variance for 301 University Drive, generally located at the Northeast corner of University Drive and Boyett Street, which is zoned NG-1 Core Northgate. Case # AWV2016- 000005 (M.Thomas) Staff Planner Thomas presented the staff report and stated that the applicant is requesting a variance for a free-standing sign at 301 University Drive, generally located at the Northeast corner of University Drive and Boyett Street. She ended her staff report and stated that staff is recommending denial due to the lack of a hardship or extraordinary condition . There was a general discussion amongst the Board . Chairman Simpson opened the public hearing. Laura Walker, applicant ' s representative, spoke in favor of the variance request. Chairman Simpson closed the public hearing. There was a general discussion amongst the Board . Board Member Lopez motioned to deny the variance as it will be contrary to the public interest, due to the lack of any special conditions , and because a strict enforcement of the provisions of the ordinance would not result in unnecessary hardship to the applicant. Board Member Roberts seconded the motion . Chairman Simpson called for the vote . Motion to deny passed (5 - 0) AGENDA ITEM NO . 7 : Discussion and possible action on future agenda items - A member may inquire about a subject for which notice has not been given . A statement of specific factual information or the recitation of existing policy may be given. Any deliberation shall be limited to a proposal to place the subject on an agenda for a subsequent meeting. There was no discussion. AGENDA ITEM NO . 8 : Adjourn The meeting was adjourned at 6 : 50pm.
