Call to Order and Announce a Quorum is Present With a quorum present, the Workshop of the College Station City Council was called to order by Mayor Mooney at 3:33 p.m. on Thursday, July 13, 2017 in the Council Chambers of the City of College Station City Hall, 1101 Texas Avenue, College Station, Texas 77840. 2. Presentation, possible action, and discussion concerning the City Internal Auditor's Fire Prevention Audit. Madison Rorshach, Assistant Internal Auditor, reported that the Fire Prevention Division is compliant with all applicable federal, state, and local laws and regulations and aligns with industry best practices. The department excels at providing fire education to the public. However,two areas were identified where operations could be improved. He noted that due to the City's rapid growth, the Fire Prevention Division is forced to allocate most of its resources towards new construction reviews and tests, hindering existing structure inspections. There is no evidence that fires in the City could have been prevented by direct inspector action; however, this exposes the City to unidentified hazards and an unknown level of risk. The Fire Prevention Division's reporting system currently presents inaccurate and limited fire origin and cause information. This hinders WKSHP071317 Minutes Page 1 the Division when attempting to conduct needed analysis to evaluate the impact and effectiveness of Division operations. The Internal Auditor offered two recommendations that will further aid the Division in addressing the findings: • Investigate strategies to bolster annual existing inspection activities. • Develop a process to report fire cause and origin information to aid public education and code enforcement efforts. 3. Presentation, possible action, and discussion regarding the Wanda and Bob Meyer restricted gift fund. David Schmitz, Director of Parks and Recreation, noted that in 2013, Bob Meyer bequeathed a portion of his estate to the City of College Station Parks and Recreation Department. The stated intent of the money was "for the benefit and advancement of programs for senior citizens." The restricted fund amount received to date equals $570,245.00. The Parks and Recreation Advisory Board, Senior Advisory Board, and staff, met and arrived at several recommendations: • Bob Meyer Annual "Pool Trout Fish Out" (Scheduled for Fall of 2018) • Plaque recognizing Wanda and Bob Meyer for their contribution to the community as well as their gift to the City. (Completed 2016) • Additional public meeting space with a priority given to Senior Programming The current plan to use allocated project funds ($363,202) as well as the Wanda and Bob Meyer gift funds ($570,245) to renovate the Arts Council building to accommodate the needs for additional public meeting space. Once the Arts Council vacates the building, the building will renovated to serve as a Community Center with an emphasis on senior programs. The building will be used by the general public whenever the facility is not being used by senior programming. 4. Executive Session In accordance with the Texas Government Code §551.071-Consultation with Attorney, §551.072- Real Estate, §551.074-Personnel, and §551.087-Economic Incentive Negotiations, the College Station City Council convened into Executive Session at 3:50 p.m. on Thursday, July 13,2017 in order to continue discussing matters pertaining to: A. Consultation with Attorney to seek advice regarding pending or contemplated litigation;to wit: • Kathryn A. Stever-Harper as Executrix for the Estate of John Wesley Harper v. City of College Station and Judy Meeks; No. 15,977-PC in the County Court No. 1, Brazos County, Texas; and • Charlton F. Clayton v. City of College Station; Case: 4:16-cv-03485 in the US District Court for the Southern District of Texas Houston Division. • McCrory Investments II, LLC d/b/a Southwest Stor Mor v. Deliberation on the purchase, exchange, lease or value of real property; to wit: • Property located generally south of the intersection of SH 6 and William D. Fitch Parkway in the College Station Business Park in College Station, Texas; • Property located generally at the intersection of FM 60 and Wellborn Road in College Station, Texas C. Deliberation on the appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of a public officer; to wit: • City Manager • City Secretary • Council Self-evaluation D. Deliberation on the offer of financial or other incentives for a business prospect the City seeks to have locate, stay or expand in or near the City; to wit: • Potential economic incentives for the development of the City-owned Spring Creek Corporate Campus The Executive Session recessed at 6:08 p.m. 5. Take action, if any, on Executive Session. No action was required from Executive Session. 6. Presentation, possible action and discussion on items listed on the consent agenda. No items were pulled from Consent. 7.Presentation,possible action,and discussion regarding an overview of the 85th Texas State Legislature Jennifer Rodriquez, lobbyist, updated the Council on the outcomes of the 85th Texas State Legislature and briefed the Council on the upcoming Special Session. 6,631 bills were filed, and 1,211 were sent to the Governor, with 1,008 signed by the Governor. A brief overview of the Stte budget was also provided. Significant bills that failed included, revenue caps, the bathroom bill, short term rentals, eminent domain, annexation, and city fees. Significant bills that passed included a statewide texting ban, statewide TNC regulations, sanctuary cities, right-of-way for small cell technology, ad TXDOT sunset. Governor Abbott has called a special session of the Legislature to convene next Tuesday, July 18th at 10 a.m. Special session items that will be of interest to cities include property tax reform, caps on state and local spending, preventing cities from regulating what property owners do with trees on private land,preventing local governments from changing rules midway through construction projects, speeding up local government permitting process, municipal annexation reform, texting while driving preemption, and privacy. 8. Presentation, possible action, and discussion regarding the Rental Registration program. WKSHP071317 Minutes Page 3 Debbie Eller, Director of Community Services, updated the Council on the Rental Registration Program. Each owner or real estate manager of Rental Property is required to annually register the property with the City on a form provided by the Administrator. A new registration is also required upon any change in the conditions reported through registration. She defined rental property as any single-family or duplex dwelling that is not owner-occupied, whether or not rent is charged. Registration can be completed in person, by mail, by phone, or online through eTRAKit. A process has been developed to allow management companies the ability to have all properties on the same registration timeline. They can provide a list of all managed rental properties and City staff works to adjust the renewal schedule so that all properties are on the same schedule. Data is maintained in TRAKit as a license, and data is accessed to investigate any violation or complaint. An annual analysis of BCAD data is done to determine properties that could be subject to the ordinance, but are not currently registered. Challenges to program management include the identification of rental properties, educating property owners so that they better understand the use and practicality of the program, and compliance with property owners registering properties. There are currently 8,323 properties registered. Estimated revenue for FY17 is $100,727 and estimated FY17 expenses are $108,633. Staff was directed to bring back to Council a change in the process to move to a one-time registration (plus anytime there is any change), eliminating the renewal requirement. It was also suggested to add four-plexes to the initial registration requirement. 9. Presentation, possible action, and discussion regarding issues related to Experience Bryan College Station. This item was pulled from the agenda. 10. Council Calendar Council reviewed the calendar. 11. Councilmember Brick noted that the history book is available for sale in the City Secretary's Office for$15. Councilmember reported on BVWACS. 12.
