The commission agreed to open the floor to Lance for discussion on the subject. Lance told the commission that he had two items he wished to discuss,one being the Meridian Apartments, and the progress in adopting a new minimum foundation standard. Lance said that at the last meeting the commission ordered the city to demolish the Meridian Apartments even though at that point the city did not have a source of funding for the project. However, since that time, the city has received a grant through Community Development of approximately$300,000,which would hopefully cover the costs necessary to complete the demolition of the apartments. Lance said he is also working with Community Development to have an asbestos survey performed on the property. Lance said he felt confident that the project is proceeding as anticipated,but it would take some time to complete. BUILDING STANDARDS COMMISSION September 28, 1998 Minutes "SUBJECT TO APPROVAL" The next item Lance discussed with the commission was the progress with the upgrade of the minimum foundation standards. Lance said he had made a presentation to council at a workshop meeting on September 24, 1998. He told the commission that he didn't have an ordinance prepared,but simply wanted to present to council all the steps that had taken place to develop the standard. He told the commission that he informed council about the organizations and people he had been working closely with in order to update the standard. Lance said that at the workshop meeting,council voted to have an ordinance prepared for adoption,however,there was also a vote to have any reference to architects deleted from the standard. The commission discussed this, saying that state allows for registered architects and engineers to be involved with foundation design. Dan Sears wanted it known on the record,that he was personally against the decision by council to delete architects from the standard. He said that it was not right to discriminate against qualified architects who are allowed by state to design foundations. Lance said he explained to council that an architect knows when he needs a registered engineer to assist in the design process. He said an architect affiliated with Texas A&M had called him that day and said he would fax him a copy of the state requirement allowing architects to design foundations. Lance said he was going to forward the information to the city attorney for review and consideration. Dan Sears commended Lance and staff for their hard work on this subject and agreed with the proposed minimum standards presented to council. Lance said he would update the commission as soon as he received more information. At this time,Lance briefed the new members on their duties and responsibilities as Construction Board Members and Building Standards Commission Members. AGENDA ITEM NO. 3: Oath of Office and introduction of new board members Debra Charanza, Staff Assistant, swore in new board members Kevin Kuddes and Helene Weber and swore in reappointed members,Dan Sears,James Holster, and George McLean. AGENDA ITEM NO.4: Approve Minutes from Building Standards Commission Meeting June, 29, 1998. Glenn Thomas made a motion to approved the minutes,Robert Mooney seconded the motion, the commission concurred, (7-0). AGENDA ITEM NO.5: Public hearing to consider a report by the Building Official concerning the property located at 1108 Detroit,Lot 20,Block 5,McCullough Subdivision. Dan Sears asked staff to brief the board on the agenda item. Lance Simms took the floor to bring the commission up-to-date since the last meeting. He said that on June 29, 1998,he presented photographs of the property in question and explained the condition of the property to the commission. BUILDING STANDARDS COMMISSION September 28, 1998 Minutes page 2 "SUBJECT TO APPROVAL" Lance reminded the commission that the property had been without water, sewer and electric service for over a year and at that time, someone was occupying the building. After reviewing the information presented by staff,the commission ordered the property vacated within 30 days and condemned within 60 days. Since that time,the property has been vacated and secured and Lance has learned from Community Development that funds are available for demolishing this structure. Lance stated that the owner has not taken any action to comply with the commissions original order and recommended that the commission issue an order to request the City of College Station demolish the structure. Dan Sears opened the public hearing. No questions were raised Dan Sears closed the public hearing. George McLean made a motion to have the city demolish the structure at 1108 Detroit Street,Lot 20, Block 5,McCullough Subdivision. Robert Mooney seconded the motion,the commission concurred, (7-0). Item background: On 25 November1996 the single-family residence located at 1205 Westover Street was involved in a fire and suffered extensive damage. The city has received numerous complaints about the condition of the structure and an inspection of the premises by city officials revealed a number of code violations (see attached). Based on this investigation, there is probable cause to conclude that the structure is unsafe. Staff recommendation: Staff recommends that the structure be declared unsafe and ordered demolished within 30 days pursuant to Chapter 3, Section 1(G) 8(a), College Station code of Ordinances. Dan Sears asked staff to brief the commission on the structure in question. 4 "SUBJECT TO APPROVAL" BUILDING STANDARDS COMMISSION August 23, 1999 Minutes Lance Simms, the Building Official took the floor to explain the situation with the property in question. He said that the structure sustained a fire back in November 1996 and has been abandoned ever since. Lance said that over the past few months staff had been working with the owners to try to reach a decision regarding the situation of the property,however,a variety of problems had delayed the owners in making a decision on what to do with the property. Lance said that after recent conversations with the owners,he felt like the situation would not resolved it's self,and staff recommended this case be presented to the commission for their consideration. Lance showed the commission photographs of the property that revealed extensive fire damage to the exterior,including the windows,walls,roof,etc. Lance said the structure was,in his opinion,beyond repair and recommended to the Commission that the structure be considered unsafe and ordered demolished. Lance told the commission that staff did not have pictures of the interior of the structure,however,the Fire Department was present and could discuss the results of their investigation into the fire and testify to the condition of the interior of the structure. Lance read a list of Structural Standards Code violations to the commission Lance said staff recommendation was to declare the structure unsafe and to order the structure demolished within 30(thirty)days pursuant to the College Station Code of Ordinances. George McLean asked Lance if the building was demolished,would there be another meeting against whoever owns the lien on the property. Lance said that he had visited with the city's Legal Department and they were researching that question. Lance said worse case scenario, if the property would be another meeting with the new owner. Lance also clarified the definition f`demolish"from a ably safety standpoint. He stated that in this case,demolition should include the entire structure,but not necessarily the concrete slab. Lance told the commission that he had heard that there was a contract on this house to be sold so he checked with the city's Legal Department to find out what the circumstances would be if the commission ordered the structure unsafe and ordered demolished. The Legal Department told Lance that the commission still had a decision to make on the structure regardless of who the owner(s)were and to continue with the hearing. In the event that the house was sold,the order would stand no matter who the owner(s)were at the time. At this time,Raymond Olson,Fire Prevention Lieutenant,took the floor to discuss the condition of the structure based on the Fire Departments investigation report. He told the commission that the interior of the building sustained extension damage from the fire. He said that the fire had destroyed all but a couple of support beams,and only some of the rafters remained intact. He said the only thing holding up the structure is the gable ends,the ridge and some of the remaining rafters. Raymond said that because some of the walls were paneled,the house burned quickly. Dan Sears opened the public hearing. Raymond Olson spoke in favor of the commission ordering the structure unsafe. He said that besides the structure being unsafe,it also provides a haven for kids to play around and for rodents to live. Dan Sears asked staff if there was any part of the structure that was salvageable,or what percent would he suggest is salvageable. Jon Mies,the Fire Marshal,told the commission that his staff met with the owners'attorney at the site so as to get an idea of the damaged sustained by the fire. He said that when they removed some boards in the back of the house to have the attorney enter the structure,the brick veneer actually rattled upon entry. "SUBJECT TO APPROVAL" BUILDING STANDARDS COMMISSION August 23, 1999 Minutes Lance told the commission that on the south side of the house there was some indication that some of the wall framing could be salvageable. But other than that,the structure was destroyed. Jon Mies said the neighbors have been very patient and easy to work with through the whole situation,but they were growing impatient and after three years of waiting for something to be done,they wanted action taken. George McLean asked about the"contract"on the house and if staff had seen it. Staff said they had not seen the contract. Jon Mies said in his opinion,the structure could not be saved. Dan Sears closed the public hearing. Robert Mooney made a motion to declare the structure unsafe and demolished within 30 days. Kevin Kuddes seconded the motion,the commission concurred,(6-0).
