The length of curb to be designated and mar.ked for visitor parking measures 300 ft . along the western-most curb and 300 ft . along the eastern-most curb. :urrent Zoning of Subject Property R3 ,pplicable Ordinance Section Chapter 6 of the Fire Code SBVARIANCE REQUEST 1 of 2 STAPP.00C 3/24!99 VARIANCE REQUEST The following specific variation from the ordinance is requested: Approximately 600 linear feet of designated visitor parking along and against one outside curb of a 24 foot wide private roadway located in the Navarro Townhome Subdivision. The opposite curb of this street shall remain a designated no-parking fire lane. The driveways between the units will also be designated as fire lanes. This variance is necessary due to the following special conditions: Per paragraph 602.6.15 McClure Engineering Inc prepared plans that were submitted to the city Building Department for approval by the developer Brazos Triad Land Development Partnership. These plans provided for 3 assigned parking spaces per townhouse lot and a 24 foot wide private street that would be available for visitor and maintenance vehicle parking. These plans were reviewed and approved by the city and development permits were subsequently issued without any mention of future on-street fire lane requirements. After the development was completed and accepted by the city the development was then purchased by homebuilder B. A. Cathey, Ltd and 32 townhomes were then completed in August 2001. Following construction of the 32 townhomes and approximately one week before the last Certificate of Occupancy permits were issued,the homebuilder was required by the Fire Department to paint fire lanes along both curbs of the 24 feet wide private streets-thus eliminating all visitor parking within the subdivision. The unnecessary hardship (s) involved by meeting the provisions of the ordinance other than financial hardship is/are: Since the current fire-lane restriction eliminates all visitor parking inside the development, visitors are required to parallel park along both curbs of Navarro Avenue. It is the opinion of the Navarro Townhomes Owners Association that parking along Navarro posses an excessive and unnecessary public safety risk. Since on-street parking is allowed along both curbs of a 28 ft. wide street(which yields approximately 14 ft of fire lane access) then parking along one curb of a 24 ft wide street(which yields 17 ft of fire lane access)meets the spirit of the code. Furthermore, it is the opinion of the Navarro Townhomes Owners Association that the proposed off-street private parking will significantly enhance public safety by reducing traffic hazards along Navarro. Per paragraph 602.6.13 authority is provided to modify any provisions of the existing code"provided that the spirit of the code shall be observed,public safety secured, and substantial justice done." The following alternatives to the requested variance are possible: There are no known alternatives for off-street visitor parking inside the subdivision development. This variance will not be contrary to the public interest by virtue of the following facts: On-street parking along one curb of a 24 foot wide street provides approximately 17 feet of free access whereas parking along both curbs of a 28 foot wide street(e.g. Axis Court)provides approximately 14 feet of free access. Furthermore,the city of College Station has previously approved 24 foot wide public streets without fire-lane restrictions. Further, although the units are collectively described as townhomes; they are, in fact, individual single family homes. Individual units are on separate foundations and do not share a common wall or roof. All electrical runs which are in adjoining walls are in sealed conduit and sealed electrical boxes and each unit is equipped with smoke detectors and security systems.
