After considering the evidence presented the Commission finds: Notice of said hearing as required by Chapter 3,of the College Station city code was delivered to Mr.Juan Creixell by certified mail.The Commission also fmds that the structures(s)described above: is not an unsafe structure / is unsafe because of the following violations: /Sanitary facilities(sinks,lavatories,tubs,showers and water closets)are damaged or missing,in violation of the City's Building Regulations Code. The purpose of this meeting will be to hold a public hearing on the condition of the structures located at 306 Redmond Drive,Redmond Terrace,Block 4,Lots 11-17 (Meridian Apartments). At the public hearing you,as the owner's representative,will have the burden of proof to demonstrate the scope of any work that may be required to bring the structures into compliance with the city's ordinance and the time it will take to reasonably perform such work. The Fire Marshal, Jon Mies, and I will recommend to the commission that the structures be deemed unsafe and ordered demolished in a timely manner pursuant to Chapter 3, Section 1 (G) College Station Code of Ordinances. If you fail to perform any work ordered by the commission,the city may perform such work and charge the expense to you. Such charges shall include,but are not limited to:photography,publication, title search, attorney's fees, labor and equipment costs to demolish,clean-up and remove debris,and landfill fees. Scott League, Abstract No. 50, College Station, Brazos County, Texas, and being composed of Lots Eleven (11), Twelve (12), Thirteen (13), Fourteen (14), Fifteen (15), Sixteen (16), and Seventeen (17), Block Four (4), Redmond Terrace First Installment, a subdivision in College Station, Brazos County, Texas, according to the plat of record in Volume 188, Page 295, Deed Records of Brazos County, Texas. Prior to the hearing, the owner of record, Wolf Creek Partners, II, Ltd. (hereinafter referred to as "Owner"), whose address is 8305 Shoal Creek Boulevard, Austin, Texas 78757, was notified of the hearing by certified mail, return receipt requested, and publication. Owner's representative, Mr. Juan Creixell, appeared at the proceedings. At the conclusion of the presentation of evidence, the Commission deliberated and determined that the structures located on the property were a danger to the health, safety and welfare of the residents of the community and could not be rehabilitated because of their deteriorated condition in addition to the fact that the buildings were located within the 100 Year Flood Plain. The Commission thereafter ordered the demolition and removal of the structures and foundations located on the Property within ninety(90) days of the Order. At the March 23, 1998, meeting of the Building and Standards Commission, the Owner presented a proposal wherein Owner requested that the Commission reconsider the scope of the Order to demolish to allow the Owner to retain some of the structural foundations and table the issue to provide additional time to prepare an implementation plan for the demolition. The Commission voted unanimously to reject the Owner's proposals and confirmed its original Order issued February 23, 1998. Although duly notified, the Owner failed to comply with the Order to demolish within the ninety(90) day deadline. Thereafter, as provided by TEXAS LOCAL GOVERNMENT CODE, CHAPTER 214, the City of College Station commenced plans to demolish the structures at its own expense. The City of College Station asserts a lien on the above referenced property for the costs of an asbestos survey, asbestos abatement and'demolition of the structures on the Property in the amount of One Hundred Seventy-Six Thousand Six Hundred Thirty=Three and No/100 Dollars ($176,633.00) any penalties, interest, and costs authorized by law. The interest rate to be charged shall be ten percent (10%) per annum.
