Waive requirements for two toilets that are fully handicapped accessible. Require only one handicapped accessible unisex toilet for the building. 2. Require only one drinking fountain,which will be provided at a height of 28 inches above the floor. 3. Count the three sinks shown on the plan(two on the interior and one on the exterior)towards requirements for lavatories. Two of these sinks will be 28 inches above the floor. One sink(in the handicapped accessible toilet room) will be the standard accessible 34 inches above the floor. This variance is necessary due to the following special conditions: We believe the building code requirements for two handicapped toilet rooms for a facility of this size is unnecessary and unreasonable for the following reasons: 1. The building will house a maximum of 28 children and 4 adults: 12 to 14(maximum)children in each of two classrooms,plus a teacher and aide for each of the two classrooms. . (The middle room, labeled"Classroom 2"on the floor plan, is an overflow activity space used alternatively by both classrooms). These numbers have been used for several years for the almost identical classroom building immediately adjacent as the maximum number of children for a successful pre-school educational program. 2. The requested number of toilets, lavatories,sinks and drinking fountains will duplicate the number provided in the adjacent two classroom building. This has proven adequate for the life of the program. Although there is a second toilet room in the adjacent building, it is rarely used for toilet purposes,and serves primarily as a storeroom for supplies and equipment. 3. The Texas Department of Licensing and Regulation,Architectural Barriers Code Review and Inspections department has granted a variance to allow the lower sink heights and side approach of the sinks and drinking fountains,based on the proposed ADAAG. (There are no ADA standards in place at this time for heights and accessibility of sinks and drinking fountains for children of the ages that this building will serve). A copy of the letter granting that variance is attached. 4. Lavatories and sinks need to be lower for children of this age. Children in this pre-school program are required by the accrediting agency to wash their hands frequently(accreditation was recently delayed because at the last accreditation visit children were observed not washing their hands prior to eating). The sinks in the adjacent building are at a normal height,and the children have difficulty in reaching the sinks. The use of a stool has been used to help,but this has been prone to accidents. The sinks and lavatories are also used in arts crafts programs;so the children need easy and safe access to them. 5. Since only four adults(usually women)will be in the building except in extraordinary circumstances,there is no real need to have separate toilet facilities for both men and women. 6. There are other toilet facilities available on the church campus which are not used,or are used by a very few persons while the pre-school sessions are in progress on weekdays. On Sundays,occupancy of these classrooms is only for 1 '/� hours maximum. The unnecessary hardship(s)involved by meeting the provisions of the ordinance other than the financial hardship is/are: 1. The building is designed for efficient use of space,with only a few minor changes from the design of the adjacent previously built building. Providing a second handicapped accessible toilet will take a significant amount of space away from the active educational portions of the building. 2. Providing toilets and lavatories at the heights required by the ordinance(handicapped accessible)will be difficult for the children to use. Access to the"normal"heights of both toilets and lavatories will have to be made by the use of stools which are prone to tipping over,causing injury to the children. The following alternatives to the requested variance are possible: 1. Provide the code required toilet rooms,water closets,and lavatories,at a lessening of functionality of the facility and at additional cost. A redesign of the building,at least in part,will be necessary. This variance will not be contrary to the public interest by virtue of the following facts: 1. The school is a privately run facility. 2. The building will function well as intended. It will function in the same manner,with the same toilet facilities as the previously constructed facility,with which the school staff is satisfied. 3.
