Request variance to code. iurrent Zoning of Subject Property kpnlicable Ordinance Section Section R-210, 1992 Cabo one & two family dwelling code ;SBVARIANCE REQUEST 1 of 2 ;STAPP.DOC 3/24/99 VARIANCE REQUEST The following specific variation from the ordinance is requested: Request variance to second story bedroom window egress opening requirements. Current window provides more square surface area for exit than required by code but only allows for 19. 1/ 2" of verticle space while code calls for 24" verticle. Request variance to code for existing windows. This variance is necessary due to the following special conditions: With remodeling of attic space to residential (bedroom) space, window openings no longer met existing code. The unnecessary hardship (s) involved by meeting the provisions of the ordinance other than financial hardship is/are: Would have to remove some 65 year old brick veneer in order to replace windows and meet code althought pictures attached clearly demonstrate that exit in case of fire is not problematic. The following alternatives to the requested variance are possible: Framing, drywalling, and all finish work were completed and inspected. Window variance was noted at final electrical inspection. Would require brick veneer removal, new framing, drywall work, new trim, and repainting for no more access area but one and one half inches This variance will not be contrary to the public interest by virtue of the following facts: Fire access is still possible as evidenced by pictures. This vote was taken at the Board's regular meeting on 6 December 1999. Please notify the building department at 764-3741 to schedule an inspection after code compliance has been obtained. Also, as a reminder, the upstairs work covered by building permit# 9603097 can not be occupied until this office issues a Certificate of Occupancy. A request to allow a bedroom window as the emergency egress on a single family home that does not meet the minimum opening height requirement. Policy Issue Statement: Health and public Safety—Citizens benefit from available health and human services in a reasonably safe and secure environment. Item Background: On 25 October 1996 a building permit was issued to the applicant to remodel a single family home at 701 Hereford. As part of the remodel,part of the attic space was converted into a bedroom. The plan review comments included a statement outlining the minimum size requirements for bedroom windows. On the framing inspection, the building inspector noted that the windows that serve the new upstairs bedroom did not meet the code requirements for egress. Section R-210, 1992 CABO One and Two Family Dwelling Code, requires a minimum net clear opening height of 24 inches and a minimum net clear width of 20 inches for windows that serve as emergency egress openings. The window in question has a clear opening height less than the code requirement. Many of the deaths that occur in residential buildings are a result of fire that spreads and blocks off conventional exits while the occupants are asleep and unaware of the emergency. The code attempts to account for this occurrence by requiring emergency egress openings in sleeping rooms. These openings serve a dual purpose. Occupants can use the windows or doors to exit from the bedroom and the fire department can use the opening to enter the building for the purpose of fighting the fire or evacuating building occupants who need assistance. It is important to note that, in this case, the windows in question serve an upstairs bedroom. Therefore, any fire incident on the first floor is likely to result in smoke accumulation on the second floor. Staff recommendation: Denial. The applicant was made aware of the code requirement when the building permit was issued (see plan review comment sheet). Furthermore, emergency egress from sleeping rooms is a critical life safety component that should not be compromised. ,.
