This vote was taken at the regular meeting on 27 September 1999. Please contact me at 764-3742 if you have any questions about this case. Sincerely, Lance Simms Building Official "'Building a Better City in Partnership with You' Construction Board of Adjustments and Appeals Staff Report Item: Variance case#99-006. A request to allow Metal-Clad (MC) cable as a wiring method in a commercial remodel project. Policy Issue Statement: Health and public Safety—Citizens benefit from available health and human services in a reasonably safe and secure environment. Item Background: Metal Clad(MC) cable is a factory assembly of one or more insulated conductors enclosed in a metallic sheath. MC is recognized by the National Electrical Code (NEC) as a wiring method in Article 334. However, the City of College Station passed an ordinance prohibiting its use in commercial buildings (amendment no. 12, 1996 NEC). The applicant contacted the Building Department to inquire about the use of MC cable as a wiring method in the City of College Station and was informed that amendment no. 12 to the 1996 NEC prohibits the use of MC Cable as a wiring method in commercial buildings. The applicant stated that he had a commercial remodel project coming up in College Station and he wanted to use type MC cable as the wiring method. The applicant was informed of the variance process. Staff recommendation: Approval, with the condition that all MC cable be installed in compliance with Article 334, 1996 NEC. CONSTRUCTION BOARD OF ADJUSTMENTS AND APPEALS/BUILDING AND STANDARDS COMMISSION FORMAT FOR POSITIVE MOTION FOR VARIANCE I move to authorize a variance from the terms of this ordinance for the following • reasons: It would not be contrary to the public interest; a literal enforcement of the ordinance would result in unnecessary hardship and manifest injustice to this applicant. Further, granting this variance would observe and accomplish substantial justice. jr , A Motion made by //,i ` i , Date !7 ' Seconded by Voting Results Chair Signature Q Construction Board piAdjusjments and.Appals/ Building Standards Commission Guest Register l Date: 9124/q Name: Ly / Address: 1. 1✓EiC-j /D;l Sok e ,r-eev119y',rc 44RtkOC 2. % /' C glrtiG fJwiri` /fG` 3. 90— ZvtB e .
