A request to build a swimming pool without the enclosure provided for by Appendix lf(1), Chapter 3, College Station Code of Ordinances. Item background: On April 23,1999 the applicant submitted plans to construct a swimming pool in association with a new student housing facility located at 301 George Bush Drive West. During plans review we noted that the pool did not have the four-foot enclosure required by code. The applicant requested that a conditional permit be issued with the understanding that a variance is obtained or an enclosure is provided that complies with code. Section F(4) of appendix 1 provides for modification of the enclosure requirement by the Construction Board of Adjustments and Appeals. CONSTRUCTION BOARD OF ADJUSTMENTS AND APPEALS/BUILDING AND STANDARDS COMMISSION FORMAT FOR POSITIVE MOTION FOR VARIANCE I move to authorize a variance from the terms of this ordinance for the following • reasons: It would not be contrary to the public interest; a literal enforcement of the ordinance would result in unnecessary hardship and manifest injustice to this applicant.
