The Construction Board of Adjustments and Appeals voted 7-0 to grant the requested
variance for the above referenced case with the condition that a 40BC fire extinguisher be
provided in a location identified by the Fire Marshal.. This vote was taken at the regular
meeting on August 23, 1999.

Staff Report
Item: Variance case# 99-005. A request to allow a residential cook top in a new office
building without the required commercial exhaust hood and fire extinguishing system
provided for in the Standard Mechanical Code.
Policy Issue Statement: Health and public Safety—Citizens benefit from available health
and human services in a reasonably safe and secure environment.
Item Background: On 28 July 1999, the applicant submitted plans for a 4,000 square
foot model home/office building. The floor plan indicated that a fully operational "model
kitchen" including a range and cook top will be provided. After plan review, the applicant
was notified that the Standard Mechanical Code requires a commercial hood and fire
extinguishing system be installed over the cooking equipment.
Staff recommendation: Approval, with the condition that a 40BC fire extinguisher is
provided in a location to be designated by the Fire Marshal. Staff feels like the limited use
of the cook top coupled with the fact that it is a residential appliance warrants granting the
requested variance. This recommendation is consistent with previous variance requests of
this type.

I move to authorize a variance from the terms of this ordinance for the following •
reasons: It would not be contrary to the public interest; a literal enforcement of the
ordinance would result in unnecessary hardship and manifest injustice to this applicant.
Further, granting this variance would observe and accomplish substantial justice.
