FORMAT FOR NEGATIVE MOTION FOR A VARIANCE
I move to deny a variance from the terms of this ordinance for the following reasons: A
variance would be contrary to the public interest; no special conditions exist by which a
strict enforcement of the provisions of the ordinance would result in unnecessary
hardship to this applicant; in addition, granting a variance would not observe nor
accomplish substantial justice.

Staff Report
Item: Variance case# 99-003. Request to allow a gameroom on the third level of a
single-family residence without the required sprinkler system.
Item Background: On April 23, 1999, the applicant submitted plans for a single family
home that included a gameroom on the third floor. After plan review, the applicant was
notified that amendment # 14 to the Standard Building Code, and Table 500, Standard
Building Code requires an approved sprinkler system in this situation. A building permit
was issued for the home with the condition that a variance be obtained for the third floor
gameroom, the house is sprinkled, or the third level be deleted.
