Policy Issue Statement: Health and Public Safety- Citizens benefit from available Health and Human Services in a reasonably safe and secure environment. Item Background: The applicant was granted a building permit for a single-family home on May 22, 1997. The plans submitted at that time indicated a "bonus room" upstairs. On the framing inspection, the inspector noted a bedroom and study was upstairs in lieu of the "bonus room" and requested the corrected floor plan be submitted for approval. The inspector also informed the framing contractor and the applicant that the bedroom window did not meet the minimum opening height dimension for egress. The window opening height dimension is 20 1/4" and the opening width dimension is 31 1/4". Amendment#10 to the CABO One and Two Family Dwelling Code requires a minimum opening height dimension of 24" and minimum opening width dimension of 20". Staff Recommendation: Denial based on the following reasons: 1. The minimum egress window dimensions are a "Life Safety" related code requirement. It is the minimum dimension deemed necessary to provide safe egress from a bedroom. In the event of an emergency. (See attached information). 2. Denial would not cause a unnecessary hardship on the applicant in that he was informed at the framing stage that the window did not meet the minimum code requirements. 3 C'JCITY OF COLLEGE STATION Post Office Box 9960 1101 Texas Avenue College Station,Texas 77842-9960 (409)764-3500 October 7, 1997 Philip Blackburn 208 D Southwest Parkway East College Station,Texas 77840 RE: Variance Request 97-008 Dear Mr. Blackburn: The Construction Board of Adjustments and Appeals voted 4-2 to deny your variance request to Chapter 3,Appendix 1,Amendment No. 20,Code of Ordinances.
