COMPLETE THE FOLLOWING FOR A VARIANCE REQUEST
The following specific variation from the ordinance is requested.
Variance to Building Department ruling requiring one additional water closet in the
proposed expansion. This ruling relies on the interpretation of Section 922, Table 922.2,
Required Minimum Facilities, Standard Plumbing Code - 1991
This variance is necessary due to the following special conditions.
The existing Bronze Body Tanning Center facility, which opened in January 1994,
contains an area of 1,860 sq. ft. and includes two handicapped bathrooms. This facility
accommodates 13 tanning rooms, an office and a checking in/reception area.
The proposed expansion, into the available lease space next door, covers an area of
1,296 sq. ft. which will be connected to the existing facility. The resulting 3,156 sq. ft.
Tanning Center will continue to be served by the two existing bathrooms. The total
number of tanning rooms will be 28. As explained below the existing bathrooms will be
sufficient to satisfy the needs of this facility. Please see the attached drawing.
The following alternatives to this request are possible.
This facility by its nature should be considered a retail rather than a service facility.
Costumers come in for a very short and definite period of time, much like going into a
store or a restaurant. In many cases customers come in after having made
appointments so a waiting period is eliminated. There are no children customers. The
proposed expansion will further minimize or eliminate any waiting period.
This variance will not be contrary to the public interest by virtue of the following
facts:
Two handicapped bathrooms are already available. Average customer presence in the
establishment is 30 minutes. No services other than tanning are offered at the
establishment. The facility is fully computerized so that it can be run by one employee.
Upon completion of the expansion it is expected that no more than two employees will
be required at any time.
The facts stated by me in this application are true and correct to the best of my
knowledge.

I move to authorize a variance from the terms of this ordinance for the following •
reasons: It would not be contrary to the public interest; a literal enforcement of the
ordinance would result in unnecessary hardship and manifest injustice to this applicant.
Further, granting this variance would observe and accomplish substantial justice.
