Applicable Ordinances: Table 922.2 of the 1991 Standard Plumbing Code. Staff Comments: As the applicant has stated, the plumbing code uses the square footage of habitable space less permanent structures in determining the number of fixtures required. The applicant is requesting that additional areas which, although they are not "permanent structures", are always required in a retail store and do take up space which cannot be occupied by patrons. Current Zoning of Subject Land: Cl Applicable Ordinance Section: 1991 Standard Plumbing Code Table 922.2 COMPLETE THE FOLLOWING FOR A VARIANCE REQUEST The following specific variation from the ordinance is requested. Variance in the number of toilet fixtures required by the 1991 Standard Plumbing Code. This variance is necessary due to the following special conditions. The number of toilet fixtures required is excessive due to the method that the net area is calculated in table 922.2 of the plumbing code. We request that in lieu of "permanent portions of the building" being deducted from the gross area, all the areas within the building not occupiable by persons be deducted from the tenant area. There-by reducing the area on which the fixture count is based. This seems more reasonable since the areas occupied by the fixtures and displays cannot be simultaneously occupied by a person. Thus the number of persons occupying the store would be less than required in the current building code calculations.
