Dear Mr. Rowe,
A public hearing for the consideration of your variance request to allow the installation of CPVC
pipe for inside water distribution was considered by the Construction Board of Adjustments and
Appeals on Wednesday, August 17, 1994. As you are aware by the results of the voting of the
Board, the request for a variance at Lot 1 Block 1 in the Troy Subdivision, 2250 Dartmouth,
zoned PUD was denied.
The authority and responsibilities of the Construction Board of Adjustments and Appeals are to
hear appeals relating to code interpretations and special circumstances. The following is the
proviso by which the Board operates:
"The Board may vary the application of any provision of the code to any particular
case when, in its opinion, the enforcement thereof would do manifest injustice, and
would be contrary to the spirit and purpose of the code or public interest, or when
in its opinion the interpretation of the Building Official should be modified or
reversed."

Action Requested: To allow CPVC pipe and fittings to be used for water distribution
inside the building.
Applicable Ordinances: The 1991 edition of the Standard Plumbing Code Appendix 5
Section 3 Table 500 local amendment.
Staff Comments: Sections 1205.1.1 and 1205.1.2 both address the usage of materials
for distribution of potable water through the water service pipe and fittings. Likewise
1210.1. and 1210.1.2 allow certain materials to be used for water distribution in the
secondary portion of the water system regarding type of pipe, tubing and fittings. Both of
the above code sections of the 1991 Standard Plumbing Code do allow the usage of
CPVC.
Section 1005 pertains to strains and stresses and would not allow for usage of CPVC
under slab foundations due to the physical connections of fittings that are required for
installation. Likewise cooper piping is not allowed to have any physical connections
whatsoever under slab.
Local City Amendments of Ordinance 1919 delete the use of plastic piping for water
conveyance within a building.
