Current Zoning of Subject Land R-6 Applicable Ordinance Section 602.6.7 (Specifications (a) ) COMPLETE TIIE FOLLOWING FOR A VARIANCE REQUEST The following specific variation from the ordinance is requested. Non-permanent barriers to be erected at both connecting drives between Treehouse I Apts. and Treehouse II Apts. for the sole purpose of securing the private property of Treehouse I Apts. (Please see attached copy of site plans with specific locations of proposed barriers. ) This variance is necessary due to the following special conditions. Residents of adjoining using private drives for access: excessive traffic causing undue damage to property and drives, illegal use of private parking areas by adjoining property, vehicular accidents due to excess traffic The following alternatives to the requested variance are possible. The barriers will be pole gates secured by padlocks designed to give immediate access to any emergency vehicle by removal of the lock with the bolt cutters all emergency vehicles are required to carry. This variance will not be contrary to the public interest by virtue of the following facts: The gates are non-permanent barriers that will not deny access by any emergency vehicle if required. Drives will be properly marked as Fire Lanes on both sides of each gate as required by ordinance 602.6.8. The gates are designed to open into the property of Treehouse I Apts. to prevent damage to any property of Treehouse II Apts. The facts stated by me in this application are true and correct to the best of my knowledge. STAFF REPORT Subject : Appeal for variance by Treehouse Apartments (phase I) with regards to obstructing the fire lane between Treehouse Apartments phase I and II . Prepared by: George Spain, Fire Marshal October 14, 1993 Section 602 . 5 . 1 Standard Fire Code No person shall place or keep an fence, growth, trash or other material near any fire hydrant that would prevent such hydrant from being immediately discernible or in any other manner hinder the Fire Department from gaining immediate access to a fire hydrant . Section 602 . 6 . 2 Standard Fire Code The required width of access roadways shall not be obstructed in any manner, including the parking of vehicles . Installation of No Parking signs or other appropriate notice, or of approved obstructions inhibiting parking, may be required and if installed shall be maintained. The owner or his representative of a building which is adjacent to the fire lane shall be responsible for keeping the fire lane free of obstructions . Section 602 . 6 . 7 Specifications, City Code of Ordinances (a) Any fire lane more than one hundred feet (100 ' ) in length shall either connect at each end to a dedicated street or be provided with a turnaround having a minimum radius of eighty feet (80 ' ) when measured from curb to curb. All fire lanes shall be maintained and kept in a state of good repair at all times by the owner, manager, or person in charge of the premises, and the City of College Station shall never be responsible for the maintenance thereof . (b) The Fire Official or his authorized representative is hereby authorized to designate adequate fire lanes and/or turnarounds to any building when deemed necessary for fire department access in the event of fire in such building. The City of College Station Fire Department respectfully asks for denial of the applicants request of a variance to obstruct the fire lane between Treehouse Apartments phase I and II, because of the following: If the fire department receives a report of a fire in this area of the complex, access to fire hydrants and buildings will be reduced. All the driving surfaces in both phases, including the area with a gate, are fire lanes . Buildings in this area are constructed of wood and range from two to three stories in height . These buildings house a large number of citizens . Fire can spread from one building to another while we are attempting to open a locked gate . Some locks can ' t be cut with the use of bolt cutters and any attempt to do so, will waste even more valuable time . Blocking off this fire lane, will by code, require that Treehouse Apartments phase II, provide an eighty feet diameter turnaround at the end of the blocked drive (the only entrance into the area blocked by this gate would be the back drive of Treehouse Apartments phase II . This drive is a fire lane and would exceed the 100 feet limit on fire lanes without turnarounds) . Treehouse Apartments phase II does not have the room to provide this size turnaround without a reduction of parking spaces . Without this turnaround the fire department might not be able to enter and exit this area under fire conditions . The complex was originally built as Treehouse Apartments phase I and phase II . Like most projects that are built in phases, the infrastructure of the second phase usually supports the first phase or may be supported by the first phase . When supporting areas of a complex are blocked from one another life safety problems can occur.
