This variance is necessary due to the following special conditions. Due to the reduced square footage of the proposed Toys R Us store the additional toilet fixtures would encroach on the necessary sales and presales arEas . The following alternatives to the requested variance are possible. See attached exhibits for zrcposed alternative floor flan . This variance will not be contrary to the public interest by virtue of the following facts: Due to the number of similar Toys R Us facilities across the cour.try , research has indicated that tY.e proposed reduced toilet facilities are adequate to service the public and employees for this store . Station, Taw CASE NUMBER: 93-005 CONSTRUCTION BOARD OF ACTION REQUESTED: VARIANCE (TOILET FIXTURES) CONSTRUCTION BOARD OF ADJUSTMENTS AND APPEALS STAFF REPORT Case Number: 93-005 Applicant: Toys 'R' Us - c/o Casco Corporation 14900 Landmark Blvd #373 Dallas, Texas 75240 Telephone: (214) 701-8786 Property Owner: Toys 'R' Us 461 From Road Paramus, New Jersey 07652 Telephone: (201) 599-7800 Location of Property: 1306 Harvey Road College Station, Texas 77840 Description of Property: Lot 2 ; Block 1; Post Oak Square Located in Post Oak Square Shopping Center Zoning of Property: G-1 - General Commercial Action Requested: A variance allowing a reduction in the number of plumbing fixtures to be provided for use by the general public. The owner feels that the number of water closets are excessive. Applicable Ordinances: The variance is requested to ordinance #1919 of the City of College Station Code of Ordinances Chapter #3 Appendix #5 the 1991 Standard Plumbing Code sections Table 922.2 Minimum Plumbing Fixtures Required. This table requires that the public rest room in a Group M - Mercantile for use by males have two water closets, one urinal and two lavatories (see exhibit "B"). The owner would like to reduce the number of required fixtures by one lavatory (see exhibit "A"). Further, Table 922.2 requires the public rest room facilities for use by females in a Group M - Mercantile to have five water closets and four lavatories (see exhibit "B"). The owner would like to reduce the number of required fixtures by three water closets and two lavatories (See exhibit "A"). Staff Comments: The Standard Plumbing Code sets forth the number and type of plumbing fixtures required for public rest rooms. The numbers are based on experience of the members of The Southern Building Code Congress International. Members of the congress propose changes and new amendments to all Standard Building Codes on a yearly basis. Members vote on proposals and if accepted become part of the code. We have received a few complaints from owners, architects and engineers that in some cases the required fixtures are excessive. This is particularly true for Group M - Mercantile occupancies.
