Action Requested: A variance allowing a single unisex facility for the use of
physically disabled persons in a Group A - Assembly occupancy.
Applicable Ordinances: The variance is requested to ordinance #1919 of the City of
College Station Code of Ordinances Chapter #3 appendix #5 the 1991 Standard
Plumbing Code section 922.2.2. This section requires that every building and each
subdivision of a building provide sanitary facilities for both sexes. Additionally, a
variance would also be required for appendix #1 the 1991 Standard Building Code
appendix I-I103.2 which would require that at least one fixture of each type in each
restroom be provided for the use of physically disabled persons.
Staff Comments: We can grant a variance to our local ordinance because it is all
that we are required to enforce at our level presently. However, the Americans with
Disabilities Act would still require this business to provide its patrons with the
required facilities for both sexes of physically disabled persons. Although the
provisions of our local ordinance for the physically disabled will meet and sometimes
exceed the requirements of the federal law we have no power to grant a variance to
this higher law.

The College Station Construction Board of Adjustments and Appeals will hold a
public hearing to consider a variance request by Mohamad Mooti of the
following property:
Lot 1B & 2B, Block 1 in the Boyett Subdivision, zoned C-NG Commercial
Northgate
The hearing will be held in the Council Room of the College Station City Hall,
1101 Texas Avenue at 4:00 p.m. meeting of the Board on Thursday, September
17, 1992.
