See Attachment C This variance will not be contrary to the public interest by virtue of the following facts: See Attachment D The facts stated by me in this application are true and correct to the best of my knowledge. _>% �����ds-tj• March 27, 1992 applicant Date Attachment A Allowing the application of Table 400 - Allowable Height and Building Area, of the Building Code, that indicates that buildings classified as Assembly-Small Type 4 Structures can cover 8,000 sq. ft. per floor up to a maximum of two floors. The addition of 405 sq. ft. at first floor level would bring the total area of the first floor to 6,579 sq. ft. , and the total combined area in the two floors to 8,919 sq. ft. The kitchen area, occupying 1,684 sq. ft. , is already separated from the rest of the first floor by a 3-hr fire wall . Attachment B The existing building is a Type 4 structure, non-combustible, steel and concrete, with 4-hr exterior fire walls. Just as it was in 1989, the installation of a fire sprinkler system would be very difficult due the complexity of extending a 6" diam. water line to the building because of a lack of available space to run the line and to install the sprinkler vault. The attached drawing shows the location of the existing electric, water and natural gas services to the building, and the concrete parking lot and driveway which would affect the location of the 6" diam. fire line. This restaurant is an adaptation of a previous structure designed and built for a liquor and specialty store. The adaptation to a restaurant was approved and implemented in 1989 upon approval and construction of the 3-hr wall referred to in Attachment A, and upon approval of parking variances that currently give the restaurant a total of 133 parking spaces, a sufficient number to meet the requirements of a total restaurant building area of 9,975 sq. ft. The addition of 405 sq. ft. would provide a second vaulted ceiling dining room similar to the one existing in the opposite side of the building and would enhance the quality of service offered by the restaurant. Attachment C The current Ordinance would require that the entire 405 sq. ft. addition be separated from the existing building by a 4-hr fire wall . In reality and in order to maintain the same Type 4 Structure of the existing building approximately 75% of the addition's walls will be 4-hr fire walls leaving_ only the inside wall that communicates internally with the rest of the dining area to be devoid of this barrier. As an alternative to this situation an additional fire exit is proposed, in the dining area, at the closest possible location to this addition. Attachment D By waiving the more restrictive aspects of the 1991 Ordinance the spirit of the adaptation of this building approved in 1989 would not be changed. The current dining area in the first floor covers 4,490 sq. ft. , this would become 4,895 sq. ft. after the addition, still under the 5,000 sq. ft. considered in 1989. In addition there would still be appropriate separation and fire retardation within the discreet parts of the restaurant and the building would remain in compliance with the minimum requirements of the Building Code. The building is free standing, surrounded completely by parking lots and driveways, with easy accessibility by fire trucks and emergency vehicles and with a fire hydrant at one of the corners of the tract. Presently, building is a total of 8,000 square feet and this was allowed by a variance that the owner received when the occupancy was changed from a Group M - Mercantile to a to the present occupancy. The owner wants to add an additional 405 square feet without the addition of a sprinkler system. Applicable Ordinances: The variance is requested to ordinance #1919 of the City of College Station Code of Ordinances Chapter #3 appendix #1 and in particular local amendment #13 to section 901.8.6 of the 1991 Standard Building Code which requires that all Group A - Assembly occupancies in excess of 5,000 square feet to be sprinkled. Staff Comments: This amendment was adopted to afford a greater amount of protection for the most restrictive of occupancies, Group A - Assemblies, and was based on the first response efforts of the fire department. The Fire department has determined that with their first response team that they could adequately control a fire in a structure on 5,000 square feet or less. Additionally, sprinkler systems offer a greater amount of protection for buildings with a large fire load and a large number of people, as contained in Group A-Assemblies, than unsprinkled buildings.
