HomeMy WebLinkAbout1949-0124 - Ordinance - 02/16/1949ORDINANCE NO. 124 AN ORDINANCE PROHIBITING THE OPERATION OF ANY DEVICE, MACHINE, APPARATUS OR INSTRUMENT TO INTENSIFY OR AMPLIFY OR REPRODUCE THE HUMAN VOICE OR ANY OTHER SOUND ON ANY PUBLIC STREET OR IN ANY BUILDING WHEREBY THE SOUND TIIEREFROM IS CAST DIRECTLY UPON THE PUBLIC STREETS IN THE CITY OF COLLEGE STATION;I TO PRESERVE THE QUIET AND GOOD ORDER OF THE CITY AND TO PREVENT THE DISTURBANCE OF PERSONS OWNING, USING, OR OCCUPYING PROIERTY ADJACENT TO TIIE PUBLIC STREETS; PROVIDING A PENALTY FOR THE VIOLATION THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF TIE CITY OF COLLEGE STATION, TEXAS: Section 1. That it shall be unlawful for any person to use or operate, or cause to be used or operated, any mechanical or electrical device, machine, apparatus or instrument to intensify or to amplify or to reproduce the human voice, or any other sound, on any public street within the corporate limits of the City of College Station. Section 2. That it shall be unlawful for any person to use or operate, or cause to be used or operated, any mechanical or electrical device, machine, apparatus or instrument to intensify or to amplify or to reproduce the human voice, or to produce, reproduce, intensify or amplify any other sound, in any building or on any premises in the City of College Station, whereby the sound therefrom is cast directly upon the public streets or places or where such device is maintained and operated for advertising purposes or for the purpose of attracting the attention of the passing public, or which is so placed or operated that the sounds coming therefrom can be heard to the annoyance or inconvenience of travellers upon any street or public place, or of persons in neighboring premises. Section 3. The purpose of this ordinance is to prevent any noise in, on or near any public street which is reasonably calculated to disturb the peace and good order of the neighborhood or of persons owning, using or occupying property adjacent to such public streets. Section 4. That every person convicted of the violation of this ordinance shall be punished by a fine of not more than $100.00. Section 5. Each day on which such violation of this ordinance occurs shall constitute a separate offense, punishable as herein prescribed. Section 6. Since the peace and good order within the city is now disturbed by the amplication of sound from equipment on trucks operating on city streets, and since no measures are available to stop such disturbanceq an emergency exists and is hereby declared to exist, and the rule requiring that ordinances be read at tr e successive meetings is hereby suspended, and this ordinance shall be in full force and effect beginning March 1, 1949.
